Brett,
While you may have also received an automated response, the below email was sent directly to
interested parties because the approval you are seeking does not meet the requirements of a
courtesy notification or a for the record only permit. The General Certification you are requesting
would require written approval for greenway construction with any associated impacts to wetlands,
streams or open waters. Our rules state that whenever written approval is required, a review fee
must first be paid before the project review can begin.
Please find attached the General Certification requirements for a GC4135 which corresponds to the
NW14 you have requested from the Corps for further clarification. All Wetlands and Streams – 401
Water Quality Certification information can be found at the following link:

If changes need to be made to the application there is currently an online form that would allow for
modification without full resubmission. That form can be found under Division of Water Resources,

I am wondering if this is email was an automated response and would appreciate clarification. The
notification I submitted for this project was only a courtesy notification as we are under the
threshold for NWP 14 notification and the project meets all other standard Nationwide Permit
conditions and General Certification conditions.

The automated system may also send this information, but in accordance with the current policy
regarding COVID-19, all parties identified are being notified in the chance that the primary contact is
not currently working office hours.
Please note this fee needs to only be paid by one interested party as the system will allow double
payments if they are made on the same day.
Further, we will process any form of payment outlined below, however our office staff is utilizing
working from home strategies. This means bringing a check directly into the office or mailing a check
to our office may result in small delays in processing. Advance notice of check payment is helpful in
reducing the delay times. Online payments are still being processed as soon as payments clear per
normal procedure with electronic check processing incurring no additional processing fees. Email is
the fastest way to reach me if you have any questions or concerns.
We have received your request for Section 401 Approval related to TPB City of Wilmington -
Greenville Avenue Loop Trail - Holly Tree Road, DWR 20211337 Version 1 on 10/8/2021.
This project requires a review fee in order to receive written approval and is currently on hold
awaiting that fee before being released for review.
Fee schedule information for the 401 & isolated Wetlands/Waters Program & 401 Stormwater
program can be found at the following link:

Fees for this project would be in the amount of $240.00 and could be submitted in any of the
following ways:
1. If Project is being DOT funded have DOT provide me with the WBS Element code that would
allow internal transfer.
2. If Project is not being DOT funded:
A. A check made out to NC Division of Water Resources and including the above DWR# in
the memo line can be mailed to:
