A Division of Energy, Mineral, and Land Resources file review has determined that
Stormwater Permit SW7960103 for a stormwater treatment system consisting of a wet
detention pond serving the Moyock Concrete Plant located on Windchaser Way near
Moyock, NC expires on April 4, 2021. This is a reminder that permit renewal
applications are due 180 days prior to expiration. We do not have a record of receiving
a renewal application.
The Coastal stormwater rules and the NC General Statutes require a stormwater permit
for this project. Stormwater permits are not automatically transferred when property is
sold. The stormwater permit was originally issued to Coastal Ready Mix Concrete Co.,
Inc. A review of the Currituck County tax records shows that Commercial Ready Mix
Products, Inc. now owns the property. Please submit a completed permit renewal
application and a stormwater ownership transfer application along with a $505.00
processing fee. Permit application forms can be found on our website at:

Coastal Stormwater rules require that this property be covered under a stormwater

Dear Coy Tillet,
The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW 7960103
to Coastal Ready Mix Concrete for Coastal Ready Mix-Moyock on 1/24/1996. This permit expires on
1/24/2006. Section .1003(h) of 15 A NCAC 2H .1000 (the stormwater rules) requires that applications
for permit renewals shall be submitted 180 days prior to the expiration of a permit and must be
accompanied by a processing fee, which is currently set at $420.00. If this is still an active project
please complete and submit the enclosed renewal application in a timely manner. If this project has not
been constructed and a permit is no longer needed, please submit a request to have the permit
rescinded. If you have sold the project, or are no longer the permittee, please provide the name, mailing
address and phone number of the person or entity that is now responsible for this permit. Enclosed is a
form for change of ownership, which should be completed and submitted if the property has changed
hands.
Your permit requires that upon completion of construction and prior to operation of the permitted
treatment units a certification of completion be submitted to the Division from an appropriate designer
for the system installed. This is to certify that the permitted facility has been installed in accordance with
the permit, the approved plans, specifications and supporting documentation. Please include a copy of
the certification with your permit renewal request and processing fee. Enclosed is a copy of a sample
certification.
You should be aware that failure to provide the Designer's Certification and the operation of a
stormwater treatment facility without a valid permit, are violations of NC General Statute 143-215.1 and
may result in appropriate enforcement action including the assessment of civil penalties of up to
$10,000 per day.

The Washington Regional Office received the completed
Stormwater Application for the subject project on January 16, 1996.
Staff review of the plans and specifications has determined that
the project, as proposed, will comply with the Stormwater
Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding
Permit No. SW7960103 dated January 24, 1996 to Mr. Coy Tillet.
This permit shall be effective from the date of issuance until
January 24, 2006, and shall be subject to the conditions and
limitations as specified therein. Please pay special attention to
the Operation and Maintenance requirements in this permit. Failure
to establish an adequate system for operation and maintenance of
the stormwater management system will result in future compliance
problems.
If any parts, requirements, or limitations contained in this
permit are unacceptable, you have the right to request an
adjudicatory hearing upon written request within thirty (30) days
following receipt of this permit. This request must be in the form
of a written petition, conforming to Chapter 150B of the North
Carolina General Statutes, and filed with the Office of
Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447.
Unless such demands are made this permit shall be final and
binding.

This permit shall be effective from the date of issuance until
January 24, 2006, and shall be subject to the following specified

I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and
volume of stormwater described in the application and other
supporting data.
2. This stormwater system has been approved for the management of
stormwater runoff as described on pages 4 and 5 of this
permit, the Project Data Sheet(s).
3. Approved plans and specifications for this project are
incorporated by reference and are enforceable parts of the
permit.

4. No homeowner/lot owner/developer shall be allowed to fill in,
alter, or pipe any vegetative practices (such as swales) shown
on the approved plans as part of the stormwater management
system without submitting a revision to the permit and
receiving approval from the Division.
5. The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size
b. Project name change
C. Transfer of ownership
d. Redesign or addition to the approved amount of built -upon
area
e. Further subdivision of the project area.
In addition, the Director may determine the other revisions to
the project should require a modification to the permit.
6. The Director may notify the permittee when the permitted site
does not meet one or more of the minimum requirements of the
permit. Within the time frame specified in the notice, the
permittee shall submit a written time schedule to the Director
for modifying the site to meet minimum requirements. The
permittee shall provide copies of revised plans and
certification in writing to the Director that the changes have
been made.
II. SCHEDULE OF COMPLIANCE
1. The permittee will comply with the following schedule for
construction and maintenance of the stormwater management
system.
a. The stormwater management system shall be constructed in
its entirety, vegetated and operational for its intended
use prior to the construction of any built -upon surfaces
except roads.

b. During construction, erosion shall be kept to a minimum
and any eroded areas of the system will be repaired
immediately.
2. The facilities must be properly maintained and operated at all
times. The approved Operation and Maintenance Plan must be
followed in its entirety and maintenance must occur at the
scheduled intervals.
3. The permittee shall at all times provide the operation and
maintenance necessary to assure the permitted stormwater
system functions at optimum efficiency including, but not
limited to:
a. Semiannual scheduled inspections (every 6 months)
b. Sediment removal
C. Mowing and revegetation of side slopes
d. Immediate repair of eroded areas
e. Maintenance of side slopes in accordance with approved
plans and specifications
f. Debris removal and unclogging of outlet structure,
orifice device and catch basins and piping.
Records of maintenance activities must be kept and made
available upon request to authorized personnel of DEM. The
records will indicate the date, activity, name of person
performing the work and what actions were taken.
This permit shall become voidable unless the facilities are
constructed in accordance with the conditions of this permit,
the approved plans and specifications, and other supporting
data.
Upon completion of construction and prior to operation of this
permitted facility, a certification must be received from an
appropriate designed for the system installed certifying that
the permitted facility has been installed in accordance with
this permit, the approved plans and specifications, and other
supporting documentation. Mail the Certification to the
Washington Regional Office, 1424 Carolina Avenue, Washington,
North Carolina, 27889, attention Water Quality Section.
A copy of the approved plans and specifications shall be
maintained on file by the Permittee for a minimum of five
years from the date of the completion of construction.

III. GENERAL CONDITIONS
This permit is not transferable. In the event there is a
desire for the facilities to change ownership, or there is a
name change to the Permittee, a formal permit request must be
submitted to the Division of Environmental Management
accompanied by an application fee, documentation from the
parties involved, and other supporting materials as may be
appropriate. The approval of this request will be considered
on its merits and may or may not be approved.
Failure to abide by the conditions and limitations contained
in this permit may subject the Permittee to enforcement action
by the Division of Environmental Management, in accordance
with North Carolina General Statute 143-215.6(a) to .143-
215.6(c).
The issuance of this permit does not preclude the Permittee
from complying with any and all statutes, rules, regulations,
or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
In the event that the facilities fail to perform
satisfactorily, including the creation of nuisance conditions,
the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as
the construction of additional or replacement stormwater
management systems.
5. The permit may be modified, revoked and reissued or terminated
for cause. The filing of a request for a permit modification,
revocation and reissuance or termination does not stay any
permit condition.

Please find enclosed 2 sets of revised plans and specifications for Moyock plant
site. The following modifications will be made to the existing storm water management
system. These modifications are as follows:
1) Existing pond will be enlarged to satisfy SA/DA ratios.
2) A forebay will be included in enlarged pond. This forebay will be separated
from remainder of wet detention basin by a shallow baffle one foot below
permanent pool elevation.
3) The required storage depth will be provided above permanent pool to store
runoff from 1 in.storm.
4) A new outlet device will be installed to release runoff from one inch storm
over 2-5 days.
5) A 12-foot-wide aquatic bench with a gentle slope (6H:IV) will be constructed
around the perimeter of the pond.
6) An emergency overflow will be constructed.

Site Description
Site consists of a concrete ready mixed plant with a material handling storage
facility. Concrete materials are brought to the site by rail and/or truck, stored on
site, and used to prepare concrete mixes as needed. Site includes buildings,
crushed stone driveways, material storage areas and work areas for trucks and
equipment

Entire Tract = 16.11 acres
Pervious (Farmland) = 8.5 acres

Storm Water Management System
Sheet flow runoff flows form plant and gravel area into grassy swales which
convey storm water into wet detention pond. Detention pond includes forebay and
outlet control device. Pond is design to achieve 85 percent TSS removel with
surface area based on Table 3.3-2-coastal counties. Ponds temporary storage is
designed to hold the runoff that results from a 1-inch rain and the outlet device is
designed to release this runoff over a 2 to 5 day period. Rains which exceed the I -
inch rain will be released over the emergency overflow. Pond outlet directs
overflow into existing grassy swale which continues for about 400 feet before
empting into drainage ditch. Existing drainage ditch flows toward highway 168.
Site modification
The following modifications will be preformed:
1) Existing pond will be enlarged to satisfy SA/DA ratio as calculated
2) Forebay will be included in new design. Forebay will contain a baffle that
separates the forebay from the remainder of wet detention basin. This baffle
will be ab to 1 foot below permanent pool elevation.
3) The required storage depth will be provided above permanent pool to store
runoff from 1 in storm.
4) A new outlet device will be installed, as shown on plan, to release runoff from
1 in storm over 2-5 days.
5) A 12-foot-wide aquatic bench with a gentle slope (6H:IV) extending to a
depth of 2 feet will be constructed around perimeter of pond.

Monitoring and maintenance of stormwater management system
I- Detailed inspection by qualified inspector should occur annually. Schedule
maintenance during wet weather to verify facility in operating correctly.
Qualified inspector should inspect the following:
a) Inspect plantings -grasses and aquatic plants
b) Inspect for settling, woody growth, and animal burrowing.
c) Inspect for excessive erosion or sedimentation in or around the basin
d) Inspect riprap around inlets, outlets, and emergency overflow
e) Check that emergency spillway meets design
f) Check that outlet control is operating correctly
g) Check sediment build-up in pond and swales
II- Operation and maintenance activities should be preformed, by Moyock plant
operator, after every significant runoff and at least monthly.
a) Remove debris and litter at inlet and outlet after storms -producing runoff
b) Check and clear orifice after storms -producing runoff
c) Vegetation management / mowing of grassy swales and area around pond
d) Remove wetland plant when they cover 50% of basin surface. These
plants shall be encouraged to grow along shelf and forebay berm.
e) Check sediment build up every six months, remove if required
f) Check for erosion along swales, pond, inlet and outlet areas
g) Inspect and repair collection system (piping, swales, riprap, etc.)
** Sediment removal is required when basin has lost 25% capacity or swales have lost
25% depth.

OPERATI-:"'.I AND MAINTENANCE
The proper operation :.,d maintenance of the stormwater
management plan for this f:-:ility shall be the responsibility
of the Owner, Coastal Read,' Mix Concrete, Inc. The main
features of the stormwater aanagement plan include vegetated
buffers between stone/sand ,::arlcing and equipment work 'areas
and grassy swales, grassy �:rales which convey stormwater to a
wet detention pond, a dete;:,.:icn pond with forebay, a pond
overflow swale (vegetated) .'zic.h allows water to exit the
pond thru a culvert into ail existing ditch, and a dry
sediment basin to retain ce!,rete materials derived from
washing out concrete mixer:> .-nd trucks.
Maintenance of these :.:atures shall include the
following measures:
1. Grass in swales an,,'. along swale edges shall be
maintained by fertl.].';.zing, reseeding and mowing'as
needed. Immediate :.ceps shall be taken to repair
any erosion which :..y occur in the swales and along
the banks and edges. Swales shall be cleaned when
sediment and debr'.. reach 20% to 25% of swale
depths.
2. The sediment basin. ;:;hall be cleaneu out when
sediments reach 1.!:' to 1.5' in depth or when
sediments have fil;.!d basin outlet swale 20% to 25%
of swale ciepth or ".:,re frequently if deemed
appropriate by the ":wner.
3. The detention pond shall be cleaned out when

This office received your request for renewal of your stormwater permit for the subject project on
June 22, 2006. 1 visited the Moyock plant site on August 23, 2006 and found that the development of the
plant site and the location of the wet pond are different from the originally approved site plan.
I have reviewed the "as built" plans and the calculations submitted along with the application by Mr.
Marcus Felton. Before a stomrwater permit can be issued, the following items must be addressed:
1) Revise stormwater calculations; including SA/DA Ratio, volumes, & outlet orifice.
2) Revise design of outlet structure to provide adequate storage volumes and small diameter
orifice to release design storm in 2-5 days.
3) Provide (2) sets of plans & specifications sealed by an engineer.
4) Provide stormwater narrative that describes modifications to site.
The above requested information must be received in this office prior to October 23, 2006, or your
application will be returned as incomplete. The return of this project will necessitate resubmittal of all
required items including the application fee. If you need additional time to submit the required information,

STORMWATER MANAGEMENT PLAN
OPERATION AND MAINTENANCE
The proper operation and maintenance of the stormwater
management plan for this facility shall be the responsibility
of the Owner, Coastal Ready Mix Concrete, Inc. The main
features of the stormwater management plan include vegetated
buffers between stone/sand parking and equipment work areas
and grassy swales, grassy swales which convey stormwater to a
wet detention pond, a detention pond with forebay, a pond
overflow swale (vegetated) which allows water to exit the
pond thru a culvert into an existing ditch, and a dry
sediment basin to retain concrete materials derived from
washing out concrete mixers and trucks.
Maintenance of these features shall include the
following measures:
1. Grass in swales and along swale edges shall be
maintained by fertilizing, reseeding and mowing as
needed. Immediate steps shall be taken to repair
any erosion which may occur in the swales and along
the banks and edges. Swales shall be cleaned when
sediment and debris reach 20% to 25% of swale
depths.
2. The sediment basin shall be cleaned out when
sediments reach 1.0' to 1.5' in depth or when
sediments have filled basin outlet swale 20% to 25%
of swale depth or more frequently if deemed
appropriate by the Owner.
3. The detention pond shall be cleaned out when
sediments reach approximately 1' in depth. The
earthen berm within the Dond shall be checked
annually to insure proper operation. Any erosion
which may occur along the pond edges shall be
repaired immediately. Necessary measures to prevent
future erosion shall be performed by the Owner.
