This letter is to inform you of certain conditions of your Stormwater permit that have not been met. In accordance with
Title 15A NCAC 2H.100, the Stormwater Management Regulations, deed restrictions and protective covenants are
required where lots will be subdivided and sold. Deed Restrictions and protective covenants are necessary to ensure that
the development maintains a "built -upon" area consistent with the applicable regulations governing the density level.
A DWQ file review confirms that copies of the recorded deed restrictions have not been provided to this Office. failure to
record the required deed restrictions constitutes a violation of Permit Number SW7080107 which states "Deed restrictions
are incorporated into this permit by reference and must be recorded with the Office of Register of Deeds prior to the sale
of any lot. In addition, a copy of the recorded restrictions must be received by this Office within 30 days of the date of
recording. Recorded deed restrictions must include as a minimum certain statements related to stormwater management
as outlined in both the permit and the notarized statement signed by the applicant at the time of permit request submittal.
Please provide proof of these required deed restrictions to this Office at the address listed on the letterhead within 30 days

High Density Residential Subdivisions
Deed Restrictions & Protective Covenances
In accordance with Title 15 NCAC 2H.1000, the Stormwater Management Regulations, deed restrictions and
protective covenants are required for High Density Residential Subdivisions where lots will be subdivided and
sold and runoff will be treated in an engineered stormwater control facility. Deed restrictions and protective
covenants are necessary to ensure that the development maintains a "built -upon" area consistent with the
design criteria used to size the stormwater control facility.
I, Steve Tyson , acknowledge, affirm and agree by my signature below, that I will
cause the following deed restrictions and covenants to be recorded prior to the sale of any lot:
1. The following covenants are intended to ensure ongoing compliance with State Stormwater
Management Permit Number as issued by the Division of Water Quality under
NCAC 2H.1000.
2. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to
maintain compliance with the Stormwater management permit.
3. These covenants are to run with the land and be binding on all persons and parties claiming under
them.
4. The covenants pertaining to stormwater may not be altered or rescinded without the express written
consent of the State of North Carolina, Division of Water Quality.
5. Alteration of the drainage as shown on the approved plan may not take place without the concurrence
of the Division of Water Quality.
6. The maximum allowable built -upon area per lot is *See Below square feet. This allotted amount
includes any built -upon area constructed within the lot property boundaries, and that portion of the
right-of-way between the front lot line and the edge of the pavement. Built upon area includes, but is not
limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking areas, but does
not include raised, open wood decking, or the water surface of swimming pools.
OR, if the proposed built -upon areas per lot will vary, please REPLACE #6 above with the following:

This allotted amount includes any built -upon area constructed within the lot property boundaries, and
that portion of the right-of-way between the front lot line and the edge of the pavement. Built upon area
includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and
parking areas, but does not include raised, open wood decking, or the water surface of swimming
pools.
All runoff from the built -upon areas on the lot must drain into the permitted system. This may be
accomplished through a variety of means including roof drain gutters which drain to the street, grading
the lot to drain toward the street, or grading perimeter swales to collect the lot runoff and directing them
into a component of the stormwater collection system. Lots that will naturally drain into the system are
not required to provide these additional measures.

Hey Joe & Kevin,
Here are some comments about a couple of projects in the review stage:
(1) SW7071209 - Oriental Plaza: Joe, I will be in Friday, we can discuss the items
in my 2/25 Email.
(2) SW7080107 - Lake New Bern: Kevin, here is a brief list of items to address for
Lake New Bern project. sheet 610;` surface area &
storage volume #Is did not print clearly; I found Vs in Gals and wrote them on the
plan sheet in ink; please check your plan sheets.
- deed restriction supplement sheet should have
specific square footage for each lot; or attach a table with allowable BUA. It
appears that 3387sf would be the proper
number to insert on line 6. Since all drainage goes to a wet pond system, I would
make sure that whatever deed restriction #Is are
used, would not restrict/hamper development of the lots.
- (Vegetation plans should closely mirror the ;
language/items in the 2007 BMP manual, chapter 6. We are currently working on a
sample vegetation plan that would
highlight the requirements in the BMP manual; it may be awhile before its ready; will
provide a copy when available. For the current
projects, I recommend that you expand your existing vegetation plans to include some
of the items listed in the chapter. You could
accomplish this by adding a box on the plans with notes; maybe similar format to the
seeding specs for erosion control plans.
(3) SW7080113 - Gideon Creek Marina: Jvt, some preliminary thoughts about the
drainage basin adjacent to Gideon Creek. If you keep the BUA at or below the original
development & maximize the use of sheet flow/vegetated practices/buffers; then we
might could justify a permit without engineered sw controls for that drainage basin.
On the other hand, if there is any increase in BUA for this basin; then we will
probably have to consider engineered sw controls. Lets discuss this one.
