V. SUPPLEMENT AND O&M FORMS
The applicable state stormwater management permit supplement and operation and maintenance (O&M) forms
must be submitted for each BMP specified for this project. The latest versions of the forms can be downloaded
from http://h2o.enr.state.nc.us/su/bmp forms.htm.
VI. SUBMITTAL REQUIREMENTS
Only complete application packages will be accepted and reviewed by the Division of Water Quality (DWQ).
A complete package includes all of the items listed below. A detailed application instruction sheet and BMP
checklists are available from ht!p://h2o.enr.state.nc.us/su/bmp—forms.htm. The complete application
package should be submitted to the appropriate DWQ Office. (The appropriate office may be found by locating
project on the interactive online map at http:/ /h2o.enr.state.nc.us/su/msi ma sp htm.)
Please indicate that the following required information have been provided by initialing in the space provided for
each item. All original documents MUST be signed and initialed in blue ink. Download the latest versions for
each submitted application package from h_pt ://h2o.enr.state.nc.us/su/bmp forms.htm.

VII. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
For all subdivisions, outparcels, and future development, the appropriate property restrictions and protective
covenants are required to be recorded prior to the sale of any lot. If lot sizes vary significantly or the proposed
BUA allocations vary, a table listing each lot number, lot size, and the allowable built -upon area must be provided
as an attachment to the completed and notarized deed restriction form. The appropriate deed restrictions and
protective covenants forms can be downloaded from
http://h2o.enr.state.nc.us/su/bmp forms.htm#deed restrictions. Download the latest versions for each submittal.
In the instances where the applicant is different than the property owner, it is the responsibility of the property
owner to sign the deed restrictions and protective covenants form while the applicant is responsible for ensuring
that the deed restrictions are recorded.
By the notarized signature(s) below, the permit holder(s) certify that the recorded property restrictions and
protective covenants for this project, if required, shall include all the item's required in the permit and listed
on the forms available on the website, that the covenants will be binding on all parties and persons claiming

Brian;
We are submitting a minor revision for the Ft. Bragg Green Fuel Facility. The oil/water separator
was deleted and a baysaver was added as shown on the drawings. The outlet from the baysaver
created the need for another small forebay in the bioretention cell. The only water flowing into the
baysaver would be the rain water that possibly blew under the canopy and the rain water that fell on
the depressed loading areas.

Based on our recent telephone conversations; it is this office's understanding that DPW is seeking guidance concerning
the installation of an oil/water separator to be connected to the proposed onsite stormwater system or the existing sanitary
sewer for the subject project.
Upon review of our regulations, there does not appear to be any prohibition for allowing stormwater to enter the sanitary
sewer collection system provided that the owner/operator of the sanitary sewer collection system grants their approval.
This decision should be based on the guidelines set forth in the applicable sewer use ordinance. However, allowing
stormwater flow that may contain potentially volatile substances from a fueling facility to enter the sanitary sewer
collection system and subsequently the receiving treatment plant is not advisable. Considering this, the Division of Water
Quality recommends the connection of the oil/water separator, which according to plans provided by e-mail on September
15, 2009 would receive stormwater via several catch basins located throughout the project site, to the proposed
stormwater system that leads to a permanent bio-retention cell.
Please be advised that the fueling operations must have secondary containment that can be secured during loading and
unloading operations. If the oil/water separator serves the loading and unloading area, written procedures must be in
place and implemented whenever loading and unloading take place to secure the area in the event of a spill. Regular
inspections and maintenance of the oil/water separator must be documented. Any release other than stormwater to the
bio-retention cell would be considered a" release to the environment and subject to the issuance of a Notice of Violation.

The Division of Water Quality Central Office received a Stormwater Management Permit Application for
the subject project on September 21, 2009. A preliminary review of that information has determined that
the application is not complete. The following information is needed to continue the stormwater review:
1. Please provide a cross-section of the bioretention cell.
2. Please show the underdrain locations on the plan sheets.
3. The narrative indicates there is an orifice at nine inches above the invert of the cell and the top
of the riser is additional nine inches. This creates the potential for ponding up to eighteen
inches. The ponding depth must be 12 inches or less and nine inches is preferred. Please
revise the overflow structure so the ponding depth is less than 12 inches.
4. The design includes a forebay. It is difficult to tell on plan sheet C-3.1 if the forbay elevation
is for the sediment and erosion control or for the bioretention cell. Please provided more detail
on the forebay because there is a risk that water in the forebay could flow into the underdrains
without first following through the cell. The forebay should be lined.
Please note that this request for additional information is in response to a preliminary review. The
requested information should be received by this Office prior to October 24, 2008, or the application will
be returned as incomplete. The return of a project will necessitate resubmittal of all required items,
including the application fee.
If you need additional time to submit the information, please mail or fax your request for a time extension
to the Division at the address and fax number at the bottom of this letter. The request must indicate the
date by which you expect to submit the required information. The Division is allowed 90 days from the
receipt of a completed application to issue the permit.
Any original documents that need to be revised have been sent to the engineer or agent. All original
documents must be returned or new originals must be provided. Copies are not acceptable. If you have

The site is currently undeveloped. The site is being developed as an alternative fueling station. The
site has average slopes with drainage generally from north to south.
The site meets the qualifications of a high density development. There is one drainage area for the
site. The storm water from the site is treated by a grassed bioretention cell. The storm water enters
the bioretention cell through storm drain pipe. A forebay treats the storm water prior to entering the
main body of the bioretention cell. The storm water leaves the cell through a standard riser. There is
an orifice located nine inches above the invert of the cell to prevent the storm water from ponding
above nine inches. The top of the riser is located an additional three quarters of a foot above the
orifice and a half a foot below the top of the cell. The difference between the orifice and the top of
the riser is for storage of stormwater above the minimum required 1 year storm event.

Dear Mr. Brown,
An evaluation of soil properties and hydraulic conductivity (Ksat) has been conducted at
your request on the aforementioned property. The purpose of the investigation was to
determine soil water table depths. In addition, Ksat was to be provided at varying depths
for use with bioretention pond design.
Saturated hydraulic conductivity of the unsaturated zone was measured in a similar
method as described in the Soil Science Society of America Journal, Vol. 53, no 5, Sept. -
Oct. 1989, "A Constant Permeameter for Measuring Saturated Hydraulic Conductivity of
the Vadose Zone" and Comparison of the Glover Solution with the Simultaneous
Equations Approach for Measuring Hydraulic Conductivity."
Soils at this site are most similar to the Blaney soil series (see attached boring log). Two
borings were advanced to 10 feet. Seasonal High Water Table (SHWT) as determined by
evidence of colors of chroma 2 or less (and/or concentrations of high redox mottles) was
encountered at 96 inches below the ground surface (no free water was noted within 120
inches of the soil surface during the day of testing).
Three compact constant head permeameter (CCHP) tests were conducted at depths
ranging from 2 to 7 feet. The two Ksat measurements in the Bt horizon averaged 0.419
cm/hr (.165 in/hr). The Ksat measurement in the E horizon was 14.20 cm/hr.
