Attached please find our revised request for a variance from the Neuse River Buffer rules for 2,920 sf of
Zone 2 of the buffer adjacent to the existing clubhouse at MacGregor Downs Country Club. The club
plans to expand its food and beverage services and is proposing an expansion of the existing outdoor
seating areas.
We have revised our submittal per comments received from you and Ms. Annette Lucas. The revisions
include a plan to offset proposed impacts using credits from a private mitigation bank, and revisions to the
proposed rainwater harvesting system.
The cistern has been revised to a 2,500 gallon cistern, and the location of the installation has been
moved of the club's maintenance facility. Although a passive drawdown device is proposed, the club may
also use a portion of the captured rainwater for maintenance purposes such as hand watering around the
golf course.

On June 20, 2013, the Division of Water Quality (Division) received your application dated June
5, 2013, requesting a Minor Variance from the Neuse Riparian Area Protection Rule for your
project. The Division has determined that your application is incomplete and cannot be
processed until we receive information regarding the mitigation of Zone 2 impacts totaling
2,920 square feet.
Approval of a Variance is contingent upon mitigation for the impacts that are considered
prohibited by this Rule. In this case, the required mitigation is 4,380 square feet (2,920
multiplied by 1.5). This mitigation can be satisfied through payment to a mitigation bank,
payment to the NC Ecosystem Enhancement Program (NC EEP), or mitigation conducted by the
applicant. If payment to a mitigation bank or NC EEP is chosen, please provide the approval
letter regarding the availability of the appropriate buffer mitigation credits.
Pursuant to Title 15A NCAC 02B .0233 (8), the applicant shall furnish all of the above requested
information for the proper consideration of the application. If all of the requested information
is not received in writing within 30 calendar days of receipt of this letter, the Division will be
unable to approve the application and it will be returned. The return of this project will
necessitate reapplication to the Division for approval, including a complete application package
and the appropriate fee.

This document confirms that MacGregor Downs Country Club. (Applicant) for the Project:
MacGregor Downs Deck Addition has expressed an interest to utilize 4,380 Square Feet of
Riparian Buffer Mitigation Credits from either of the EBX Neuse Riparian Buffer Umbrella
Mitigation Bank /Rudolph Site, the Forrest Creek Riparian Buffer Mitigation Bank, or the Upper
Neuse Buffer - Nutrient Reduction Mitigation Bank /Cedar Grove Site, all located in and approved
to serve the Neuse HUC 03020201. As the Bank Sponsor for all sites, EBX attests to the fact that
mitigation is available for transfer upon permit issuance at this time.
Banker will notify applicant if the 4,380 Sq. Ft. of Buffer Mitigation become considered "At
Risk" of not being available prior to permit issuance. Credits are not considered secured until
payment in full is received from the applicant resulting in the issuance of a Bill of Sale and
Affidavit of Sale by the bank acknowledging that the applicant has fully secured credits from
the bank and the Banker has accepted full responsibility for the mitigation obligation requiring
the credits /units.
The Banker will issue the Affidavit of Sale within three (3) days of receipt of the balance of the
Purchase Price. Banker shall provide to Applicant with a copy of the Affidavit of Sale and a
documented copy of the debit of credits from the Bank Official Credit Ledger(s) showing the
permit number and the resource type secured by the applicant. A copy of the Affidavit of Sale,
with an updated Official Credit Ledger will also be sent to regulatory agencies showing the
proper documentation.
