Hello IRT;
Thanks for your help with the review of the draft Prospectus and the review of the initial
comments from the sponsor. I wanted to update you on some thoughts from the Corps'
perspective on a few outstanding items. Please provide any opinions on this that you might
have, especially if you don't believe your agency can't support the direction these items are
moving. Our goal is to present a consolidated IRT response on these items to the sponsor in
a week or two.
1) The limits of the impoundment: Our site visit helped with this quite a bit. It appeared
that the impoundment limits matched the conditions found in the field. John Hutton still
needs to send in survey data to confirm the field determinations. Officially, we (the Corps)
cannot concur on the impoundment limits without this data. Hopefully, we will see it soon.
2) The amount of credit generation: Under the old Dam Removal Guidance, credit could be
earned beyond the limits of the impoundment thru components such as anadromous fish, etc.
This has always been an issue with the Corps, and with the suspension of the Guidance we
would like to modify this slightly. Our initial thoughts are to align dam removal credits
with other forms of stream restoration and allow for a ceiling of credit generation to be set
at a 1:1 ratio with the limits of the impoundment. So, if our impoundment limit is 2,000
linear feet (for example) the total number of credits that could be earned would be 2,000.
The goals of the bank (endangered species, water quality, etc.) would divide the total
credits into achievable portions, but under no circumstances could the total number of
credits extend beyond the limits of impoundment.
3) Expanded service area: Our current thoughts are to limit Hoosier to the 8 -digit HUC and
allow the use outside this area on a case -by -case basis at the time of permitting.
Please provide any thoughts you have on these items. I'll wait a few days to send to the
sponsor in order to give the Team time to provide comments...
Also, I'm moving to the Corps Operations (Lakes), so my last day with Regulatory is this
Friday (8- 30 -13). Thomas Brown will be the new USACE Chair for the IRT on Hoosier Bank.
