DANIEL SMITH Interim Director April 8, 2019 NORTH CAROLINA Environmental Quality Ronald Saucier, Owner c/o Ann Brown (power of attorney, via email: ann@speckids.com} 165 Vision Drive Wilmington, NC 28403 Subject: Notice of Inspection - Not Compliant SPEC Daycare - Leland State Stormwater Management Permit No. SW8 051143 Brunswick County Dear Mr. Saucier: On March 29, 2019, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR) conducted a follow-up inspection of the subject project in preparation of transferring the permit to a new owner. The Division had previously inspected the project on October 24, 2018 and found deficiencies, which were supposedly addressed. State Stormwater Management Permit Number SW8 051143 was issued on January 5, 2006 and was subsequently modified and reissued on March 8, 2013. DEMLR file review and site inspection revealed that the site is still not in compliance with the terms and conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the recent inspection. As indicated in the attached inspection report, the following deficiencies must be resolved: 1. The constructed wetland stormwater control measure has dead vegetation and debris within the wetland which must be removed. 2. Cattails have taken over the wetlands and must be removed. 3. The originally approved grading plan and planting plan must be followed to restore the wetland to design condition. Please be advised that, unless other arrangements have been made with the proposed permittee, you remain responsible for compliance with the terms, conditions and limitations of the Stormwater Management Permit issued under Title 15A North Carolina Administrative Code 2H .1003 and North Carolina General Statute 143-214.7, including the operation and maintenance of the permitted stormwater system. Failure to resolve the identified deficiencies, or to respond to this letter with a plan of action, including a timeline to resolve the identified deficiencies, by May 8, 2019, are considered violations of the permit. If the deficiencies are not resolved or if the requested plan of action is not submitted to this office by the due date, then DEMLR staff will re -inspect the site and may issue a Notice of Violation. Please also note that any individual or entity found to be in noncompliance with the provisions of a stormwater management permit or the stormwater rules is subject to enforcement action as set forth in NCGS 143 Article 21, including the assessment of civil penalties. The wetland still has maintenance issues that prevent the transfer of the permit at this time. The area around the wetland has been cleared, but dead vegetation and debris is still lying within the wetland. Please remove all of the dead vegetation and debris from within the wetland itself, The original wetland vegetation has apprarently died and cattails are taking over. Please remove the cattails and regrade and replant the wetland vegetation as per the wetland planting plan which is part of the March 8, 2013 approved plan set. All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that this letter references DEMLR as the Division responsible for compliance with the permit. On July 31, 2018, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR) received final information regarding a request to transfer the subject permit to Excel Leland Properties, Inc. Due to Hurricane Florence, the required compliance inspection of the facility, located at 11 1 and 1 l3 "Thomas Garst Lane, Leland, in Brunswick County, was delayed until October 24, 2018. State Stormwater Management Permit Number SW8 051 143 was issued on January 5, 2006 and was subsequently m6dified and reissued on March 8, 2013. DEMLR file review and site inspection revealed that the site is not in compliance with the terms and conditions of this permit. As indicated in the attached inspection report, the following deficiencies must be resolved: 1. The constructed wetland stormwater control measure is overgrown with dense vegetation on the slopes and in the deep pools that must be removed. 2.
