The crops for the past few decades. Prior to its current agricultural use, the property had a camp have been in row house and an in- ground pool in the late 1960's. The high ground on the property has an elevation of approximately 3' above normal water level (NWL) of the Scuppernong River. There is a documented archaeological site, TY6, on the west side of the applicants' property. The Scuppernong River is classified SC by the Environmental Management Commission and Joint Waters and Joint Anadromous Fish Spawning Area AFSA arine F by the isheries Commission and Wildlife Resources Commission. Project Description The applicants propose to excavate a new 500' long by 200' wide (10,000 ft2) upland basin, consisting f 20,604 ft2 (±0.47 acres) of wetlands, 10,160 ft2 of man-made canal bottom, and 69,227 ft of hi g upland excavation will be done by an excavator sitting on land or on mats where necessary, 2 ground The to removal of an earthen plug for connection to the river. A 285' long by 70' wide access channel is also being p new excavation into the Estuarine Waters (EW), Public Trust Area (PTA) Area of Environmental Concern (AEC) of the Scuppemong River, at connecting water depths of -10'. Average existing water depths near shore are -2.5' and gradually deepen to -10' approximately 225' offshore on the west side of the property adjacent th proposed basin and approximately 450' offshore on the east side of the property. The -10' contour will extend through the entire access channel and up ±320 feet into the full width of the new basin where depths will gradually decrease to -6' at the back end of the basin with -5' contour rounded comers to promote flushing. The channel excavation will be conducted by a barge mounted excavator with a spoil containment structure The Roger and Connie Hudson • Scuppernong River Page 2 of 2 barge will be moved adjacent shore where the containment structure will be emptied by a backhoe, to a dump truck, and moved to the designated onsite spoil area. Heavy equipment will be -used to - spread spoil material over 174,240 ft2 of onsite uplands once dry. The entire perimeter of the new basin and upland portion of Scuppernong River shoreline is proposed bulkhead for a total of 1,554 linear feet, 320 linear feet of which will be located l' below NV,7L of the Scuppernong River shoreline, resulting in 320 ft' of filling of EW, PTA AEC. In the middle of the south (back) end of the basin, a 70' long by 26' wide boat ramp (1,820 ft2) with two 55' long by 6' wide launch piers (660 ft2 total), is proposed. There are 27 mixed use wet slips proposed on the west side of the basin and 1 barge slip proposed on the east side of the basin, for a total of 28 slips. The western slips will be created by construction of a 463' long by 8' wide (3,704 ft2) upland dock located immediately landward of the new basin bulkhead that will connect to a total of 14 finger piers, tapered at the end, and a total of 40 associated tie pilings. The finger pier sizes are as follows: 5 at 22' long by ±3' wide (280 ft2 total), 4 at 16' long by ±3' wide (176 ft2 total), and 5 at 12' long by ±3' wide (155 ft2 total). The barge slip is being proposed to moor a typical 150' long by 50' wide barge against the bulkhead on the eastern side of the basin with no offshore dolphin clusters. Two new pile - driven channel markers are proposed at the north end of the new channel and one no wake can buoy is proposed approximately halfway down the length of the channel. These structures will be located at least 250' from the upstream and downstream riparian property lines, and at least 0.4 miles from any structures in either direction. The applicants propose a total of 496 linear feet of impervious gravel surface within 30' of NWL (14,880 ft2) of the new basin for the boat ramp and barge terminal accesses. The proposed gravel access, parking,' and turnaround areas will cover a total of 105,417 ft2 uplands, 40,698 ft2 of which will be located within the 75' AEC of the basin and river. A 40' long by 40' wide (1,600 ft2) building with bathroom facilities is proposed, partially located within the 75' AEC of the east side of the basin. The spoil containment area and the graded out dried spoil material area totals 211,631 ft2 (4.6 acres) of temporary cover of grassy uplands. Existing Tyrrell County water and sewer will be servicing the new marina development. Anticipated Impacts Total excavation within EW, PTA AEC will be 30,164 ft' ( ±8,289 yds3) of new channel in the Scuppernong River and man-made canal off the river. Total wetland excavation, partially located within the ES AEC, will be 20,604 ft' (±8,400 yds3). Therefore, total excavation of wetlands and open water areas for the project is 50,768 ft' (1.17 acres). Total upland excavation, partially located within the ES AEC, will be 69,227 ft2 ( ±32,347 yds3) to create the basin. Total fill within the EW, PTA AEC of Scuppernong River.will be 320 ft2 ( ±12 yds3) for river front bulkhead. Total fill within EW, PTA AEC of the new upland basin will be 1,820 ft2 for the boat ramp. Total shading within EW, PTA AEC of the new upland basin will be 1,271 ft2 for the finger piers. Total upland fill for the impervious gravel areas and the building will be 107,017 ft2, 44,248 ft2 of which will be located within the 75' AEC of the new basin and river, resulting in 20.2% impervious surfaces within 75' ES AEC, and 8% impervious surfaces over the entire project site. Total upland land disturbance will be 211,631 ft2 for spoil area containment and spreading once dry, and total upland shading by a pervious upland dock and ramp launch piers, the majority of which will be located within 30' of the new basin, is 4,064 W. Kimberly Hedrick — 27 August 2013 ICM AUG 9. 7 2013 PROJECT NARRATIVE CAMA MAJOR PERMIT — Barge Landing Marina - K Columbia, Tyrrell County July 23, 2013 Revised August 21, 2013 LOCATION OF PROJECT: The proposed project is located within a mixture of commercially developed and residentially developed properties. The subject property is located adjacent to Ramp Road (SR 1228) off NC Hwy 94, located at approximate latitude 35 055'05 "N and longitude 76 016'28 "W, adjacent to the Scuppernong River, in Tyrrell County, North Carolina. SUBJECT SITE PROPOSED FOR DEVELOPMENT: The 30.61 acre subject site is comprised of 28.77 acres of uplands and 1.8 acres (28,794 s.f.) of U.S. Army Corp of Engineers (USACE) jurisdictional Section 404 wetlands. The US Army Corp of Engineers jurisdictional Section 404 wetlands within the 30.61 acre subject property were delineated by US Army Corp of Engineers, Josh Pellitier, during the Spring of 2013. The 30.61 acre subject property mostly comprises of undeveloped agricultural farm fields. A portion of the 30.61 acres consists of mature forested area with an approximate 20`x 500' manmade farm ditch intersecting the west Section 404 wetland area and an approximate 30' x 380` manmade ditch connecting to the east Section 404 wetland area. This site supports Altavista soils, which is classified as P1, Prime Farmland and Dorovan muck which wetness is the main limitation for agricultural uses (phone conversation with James Munden, Pasquotank County Soil & Water Conservation). The upland portion of the 30.61 acre subject property gradually slopes from a three foot elevation to a two foot topography drop to the Scuppernong River, and less than a foot topography drop within the west manmade ditch and northeast corner of the property where Section 404 wetlands connect to the Scuppernong River. An existing manmade canal is located on the east side of the 30.61 acre subject property, which connects to the northeast Section 404 wetlands, which connect to the Scuppernong River. The subject site is located on the Scuppernong River, which comprises of Public Trust Waters and is directly connected to Bulls Bay and the Albemarle Sound. According to the Wildlife Resource Commission and Marine Fisheries Commission, the Albemarle Sound is classified as Coastal fishing waters, and the Scuppernong River is classified as Joint waters. The stream classifications for the Scuppernong River from the mouth of Rider Creek to Bull Bay is classified as SC. The Scuppernong River is within the Pasquotank River Basin. The 30.61 acre subject property currently has access from Ramp Road (SR 1228), and Hwy 94 (18' easement). Currently the 30.61 acre subject property is undeveloped, therefore wastewater is not currently generated on this site. Central water and sewage is currently provided by Tyrrell County Municipalities, which will be available and utilized by the proposed Barge Landing Marina once construction takes place. According to Shellfish Sanitation, shellfish harvesting is closed to Scuppemong River. The substrate in the Scuppernong River in the vicinity of the project site is a hard bottom dominated by dense hard clay. The Scuppernong River is a recreational and commercial fishery with white perch, yellow perch, spot, catfishes, croaker, river herring, blueback herring, alewife and blue crabs. (project narrative - -Barge Landing - Marina .--pg. 2)- - The Scuppernong River and the Albemarle Sound are both recreational and commercial fisheries. A gillnet fishery is within Bulls Bay. Crab pots and gill nets are used by commercial fisheries to catch fish "in season" such as croaker and perch within the Scuppernong River. The Scuppernong River has been documented by N.C. Division of Marine Fisheries as spawning and nursery areas for blueback herring and alewife According to NC Marine Fisheries, this area supports stripe bass, which is an anadromous fish, and anadromous fish spawning ends in June. On According to NC Marine Fisheries a moratorium on dredging in this area is from February 15th through September 30`t'. Ron Sechler with the National Marine Fisheries Service was contacted (documented conversation on 9- 16 -05) to determine whether the Scuppemong River had been identified as an area of Essential Fish Habitat (EFH). The Federally managed species listed by Mr. Sechler are: red drum, bluefish, summer flounder, brown shrimp, white shrimp and pink shrimp Since these species have not been identified within the Scuppernong River it is not classified as a Primary Nursery Area (PNA) or considered as an Essential Fish Habitat (EFH). Wildlife and Natural Vegetation --The Division of Parks and Recreation, Natural Heritage Program was previously contacted in 2005 to examine whether threatened or endangered flora or fauna species exist at a project site % mile from the subject parcel (Cypress Retreat). The response stated The Natural Heritage Program has no record of rare and endangered species, significant natural communities, or priority natural areas at the site or within a mile of the site. Site observations by AEC concluded that there were no species identified within the project area that are listed in the rare and endangered species list for Tyrrell County. PROJECT DESCRIPTION: This CAMA major application is being prepared for marina development, which will allow deep water access for recreational and commercial purposes within the Scuppernong River and Albemarle Sound. The proposed marina (Barge Landing Marina), includes the construction of 27 boat slips with 14 finger piers, 1 barge landing, shoreline bulkheading, walkways, upland and wetland excavation for boat basin construction and new dredge to access the Scuppernong River and Albemarle Sound. The upland portion of the property will be developed with a gravel access road from Ramp Road (SR 1228), with two cul -de -sac's and parking (16,407 sf), a concrete boat ramp (390 so, a building with restrooms (1,600 sf), wood walkways ( 3,704 sf), shoreline bulkhead (1,554 U.). The proposed marina development will allow the import of materials to be transported by commercial barge to the subject property, which will be transported off site for residential and commercial uses. New dredge is proposed for the marina project to include dredging out from the shoreline (NWL) 285 feet at a width of 70 feet (19,950 s.f.) and a 200'x 500' basin will be excavated on the landward side of the normal water level. The excavation of the boat basin will take place first starting from the south end of the basin to a depth of -6.0 feet and working toward the north to a depth of -10.0 feet. The 10' contour will extend into the basin 300' to accommodate the barge and taper up to a depth of -6' at the bulkhead to allow adequate flushing in the basin. The excavated material will be placed in dumps trucks and brought to the spoil disposal area located on the south end of the property. (project narrative - Barge Landing Marina - pg. 3) Prior to any excavation in the Scuppernong River a plug will remain at the north end of the basin until the basin excavation is complete to prevent sediment runoff into the river. After the boat basin is constructed, the plug will be removed and the boat basin will be connected to the Scuppernong River. The new channel will be dredged 70' wide, extending 285' feet to meet the -10.0 foot natural contour within the Scuppernong River. After construction of the boat basin and new channel, construction of the proposed 27 boat slips will be constructed within the boat basin which will include: (9) 15' x 25' boat slips, (8) 17'x 35' boat slips, and (10) 19'x 45' boat slips, which includes the construction of 14 finger piers (5) 56 s.f. each, (4) 44 s.f. each, and (5) 31 s.f. each. The barge landing will be 50'x 300' on the east side of the basin. Proposed disturbance within Section 404 wetlands includes excavation in wetlands (0.47), which includes a portion of the boat basin construction. Boat basin construction includes the excavation of high ground (69,227 s.f.) and excavation in wetlands (20,604 s.f.) = 29,700 cubic yards of excavated material. A spoil containment area 174,240 s.f. (4.0 ac) with a capacity of 38,000 cubic yards will be located on the subject property to contain the excavation /dredge spoil. Once excavation and new dredge has taken place, spoil material contained in the spoil containment area will be spread and graded on the existing farm fields using a dump truck, front end loader and dozer. Area of disturbance for spoil material dispersal is approximately four (4) acres. No fueling facilities proposed for this project, since an existing fueling facility is located approximately 0.1 nautical mile downstream from the proposed marina (Cypress Cove Marina). The proposed marina includes dockside power, potable water, lighting, restrooms located on uplands, a boat ramp, parking and two cul -de -sacs for trailer turn around. The fueling facility is located approximately 0.1 nautical mile downstream within the Cypress Cove Marina. Since this fueling facility is adjacent to the proposed marina, there is no need to propose a fueling station. Impervious surfaces proposed for upland development for property include: gravel access road, gravel parking, concrete boat ramp, storage /restroom building, totaling 107,017 square feet of impervious surfaces. Once approved and constructed, a "NO WAKE" bouy will be moored into the sediment, out 400' from the shoreline, outside the proposed new dredge (285' x 70'), and four 6 "x 6" timber posts channel markers with green and red reflective tape will be placed on both sides of the access channel (2 posts on each side) to provide a visual aid for recreational boaters ingress and egress to the new channel. The following permits were obtained for the property: A previous CAMA Minor Permit issued to Roger Hudson on an undetermined date for upland disturbance within the AEC. Sedimentation and erosion control plan or stormwater plans have not been submitted at this time. (project narrative - Barge Landing Marina - pg. 4) PURPOSE OF THE PROJECT: - -- — - - -- -- - - -- The purpose for the proposed activity is to allow the opportunity for recreational and commercial dockage and access to the Scuppernong River and Albemarle Sound, and to also provide deep water access for barged material to be transported to the subject property for transportation off site. Currently there is limited public access and dockage within the Scuppernong River, and limited access for barged materials. According to Tyrell County tax records the vicinity of the proposed project comprises of commercially developed, agriculture, and residentially developed properties. There is limited public access and dockage within the Scuppernong River. The closest public boat ramp from this project is the Wildlife Resource Commission Public Boat Ramp located adjacent to the subject property west of Ramp Road (SR 1228). Parking at this public boat ramp facility is limited and boat lengths proposed for this project would be difficult and unsafe to trailer and launch beyond 25' in length. The closest marina to the subject property is the Cypress Cove Marina located approximately 0.2 miles downstream from the subject site with approximately 50 boat slips, a pump -out and fueling facilities. FIELD MEASUREMENTS: Prior to this application, the property owner /applicant, Roger Hudson conducted a scoping meeting along with Quible Assoc. to include staff representing N.C. Division of Coastal Management, N.C. Division of Water Quality, N.C. Marine Fisheries, NC Wildlife Commission (via phone), NC Division of Water Quality, and the US Army Corp of Engineers at the NC Washington office on March 14, 2013 to discuss the proposed construction of the marina. The platted US Army Corp of Engineers jurisdictional Section 404 wetlands were delineated and approved by US Army Corp of Engineers, Josh Pellitier in the Spring of 2013. Water depths and SAV study were surveyed by Quible Associates staff August 2012. Submerged Aquatic Vegetation (SAV) study was conducted by NC Marine Fisheries in the Spring of 2013. According to the NC Marine Fisheries staff, no submerged aquatic vegetation (SAV's) was identified within the proposed new dredge or outside the proposed new dredge area. Existing water depths do not exist within the proposed 28 boat slips, since the proposed slips are located within uplands and a less than an acre of wetlands (0.47 ac.). The proposed dredge in uplands and wetland for the boat basin will slope from -6.0' to a maximum water depth of -10.0 feet at the entrance to the Scuppemong River. The proposed docking facility will provide docking for 18' to 50' length boats and the barge to be temporarily docked at the barge terminal location.
