Dear Donna L. Fowler:
On June 22, 2021, Jane Bernard from the Raleigh Regional Office (RRO) inspected the above subject
wastewater treatment system to evaluate compliance with the subject General NPDES Permit. Your assistance
as well as your staff and contractor's assistance during the inspection was greatly appreciated.
Our records indicate the treatment system consists of a septic tank, filter dosing tank, six peat bio-filters, tablet
chlorinator with chlorine contact chamber, pump tank, water meter and a rip -rap apron for post aeration.
General NPDES Permit NCG550000 and Certificate of Coverage (COC) NCG551223 authorize the discharge
of domestic wastewater from your treatment system to receiving waters designated as an unnamed tributary to
Milburnie Lake (classified C-NSW) in the Neuse River Basin. The authorized discharge is in accordance with
the effluent limits and monitoring requirements established within the General Permit. The items below show
what conditions were noted at your facility:
Violations noted during the inspection were as follows:
1. Treatment system operation: The wastewater treatment system shall be maintained at all times to
prevent seepage of sewage to the surface of the ground. At the time of this inspection effluent was
ponding before the rip -rap in a large area.
2. System Components: All system components, including but not necessarily limited to, septic tanks,
surface sand filters, other filter components, pump/recirculation tanks, controls and alarms, disinfection
units, dechlorination apparatus, and the outfalls shall be maintained at all times and in good operating
order.
a. At the time of this inspection the six peat bio-filters were ponded and heavily saturated with sludge.

b. In addition to the failing bio-filters the water meter is not functioning as designed. Flows for this
facility can only be determined by the water bills. Within 30-days receipt of this letter, please
submit the water bills for the subject facility for calendar year 2018 (prior to COVID-19).
3. Chlorine tablets in the chlorinator: Part 1, Section D (1) of General NPDES Permit NCG550000
requires the permittee to inspect the tablet chlorinator weekly to ensure there is an adequate supply of
tablets for continuous and proper operation. Section D (4) requires the permittee to maintain all system
components, including...disinfection units...at all times and in good operating order. The inspector
observed the chlorinator filled to the top with old tablets that have absorbed moisture and fused together.
As a result, the tablets would not move down in the tubes as necessary for proper disinfection.
4. Analyzing the effluent: Part 1. C., Effluent Limitations and Monitoring Requirements, within General
Permit NCG550000 requires a permittee to sample and analyze the effluent leaving his:'her treatment
system prior to discharge annually. Parameters to be sampled and analyzed include Flow, BOD
(Biochemical Oxygen Demand), Total Suspended Solids, Fecal Coliform and Total Residual Chlorine.
Failure to monitor the effluent discharge as required is a violation of NPDES General Permit
NCG550000.
a. The annual monitoring requirement for calendar year 2020 was not completed.
b. The annual chlorine residual for calendar year 2021 was not completed.

Both samples (12 19 2019 and 6.21 '2021) listed above included analyte qualifiers which state the following: "Reported
value should be considered a minimum estimate since it is the maximum reportable number for this method based on the
sample volume used. The true value is likely greater than the value reported."
6. Discharge outlet location. The permittee is required to conduct a visual review of the outfall location
at least twice each year (one at the time of sampling) to ensure that no visible solids or other obvious
evidence of system malfunctioning is observed. Any visible signs of a malfunctioning system shall be
documented and steps taken to correct the problem. The discharge pipe was visible and accessible the
day of the inspection, but the effluent was ponding before the rip -rap. Pee -gravel had been added to the
area but neither Eagle's Express staff nor the contractor have any knowledge as to how it got there or
why. Even with the addition of the gravel there is a large area that is saturated and draining to the edge
of the parking lot.
This inspection report is being issued as a Notice of Violation because the Bio-filters are ponding and saturated
with sludge, and the effluent is not discharging as designed. Pursuant to G.S. 143-215.6A, a civil penalty of not
more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or fails
to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S.
143-215.1.
