The Corps agrees that the installation of the fence using the method depicted would not trigger a permit. The hand
clearing described would also not be considered a discharge of fill.

One more thing, just to be clear they most likely won't need the entire 15' access corridor, but we
wanted to set limits for the contractor so that they didn't track across the entire wetland, but also allow
them enough room to reasonably work and work around some of the larger shrubs that were not a
surveyed tree (4" dbh).

That's right. The pink line with the squares represents the wood fence just inside the property line
represented by the bold black hatched line. The wetlands are located inside the red "WET" dashed
line. The brown hatched polygon is the proposed 15' access corridor. Sorry for not including the
labeling or legend.

Yes you can remove Rachel from your contact list as she no longer works for the Corps. I am the correct contact until we
hire another Reg Specialist (if that happens). I want to make sure I understand the plans, the pink line is the fence
correct? There is no label apparent but it appears to be the case. I just learned a long time ago not to assume anything.

Attached are the USACE and DWR verifications associated with this project which is currently under
construction. The permitted wetland impact has been completed, but work on the project is
continuing.
Part of that work includes the installation of the "Proposed Wood Fence" along the southern property
line as depicted on the impact maps approved in the permit application. The fence is being installed
within the wetlands with wood posts inserted into the ground until refusal (no concrete footers or fill).
Which we understand does not require a 404/401 approval. This work was initially intended to be
completed by hand to avoid the need for equipment within the wetlands. However, the contractor has
determined that a track mounted pile driver is needed.
They intend to use small equipment with a track width of +/- 5'-2" wide. However, they believe that
due to the swivel radius and simply to allow room for construction that they will need as much as a 15'
access path through the wetlands along the property line. See attached plans. Again, no fill will occur.
Also, no trees (4" dbh or greater) will be removed. Understory brush will need to be cut which will be
done by hand and left in place to further help prevent any potential damage to the wetland soils.
The fence construction is consistent with the original permitted plans and I do not believe that a
permit is needed for this vegetation clearing work, but we wanted to make you aware of their plans.
The City of Wilmington has not requested concurrence on this, so as of now we do not need a
response, unless of course you disagree and believe that a permit is needed. Otherwise, please save
a copy of this to your files or let me know if you would like for me to submit it through the online portal.
