Dear Mr. Buie:
The Central DEQ Office received and accepted a State Stormwater Permit Application for the subject
project on June 29, 2021. A preliminary in-depth review of that information has determined that the
application is not complete and additional information is needed to determine whether the project
complies with 15A NCAC 02H.1043. To continue the review, please provide the following additional
information:
1. When the applicant is a corporation or LLC, documentation from the NC Secretary of State or
other official documentation showing the titles and positions held by the person who signed the
application is required. Because the business registration from the NC Secretary of State does not
list Jason K. Bria as a company official, other documentation from the LLC will be required to
verify that he has the authority to sign on behalf of the LLC.
2. The Supplement EZ form specifies that the vegetation in the bioretention cells will be trees and
shrubs; however, the details specify sod. Please correct this discrepancy and, if the bioretention
cells will have trees and shrubs instead of sod, submit a planting plan for the bioretention cells
(Bioretention MDC 10).
3. Please upload an electronic copy of the property deed.
4. Provide pdfs of all revisions, 2 hardcopies of revised plan sheets, and 1 hardcopy of other
documents. Pdfs must be uploaded using the form at:

Please remember to confirm that any revised information is presented consistently throughout the
application documents. Please also remember to provide two hard copies and one electronic copy of any
updated or requested documents per 15A NCAC 02H.1043(3).
The requested information should be received in this Office by September 10, 2021, or the application
will be returned as incomplete. The return of a project will necessitate resubmission of all required items,

including the application fee. Please note that the Division is allowed 30 days from the receipt of a
complete application to issue the authorization to construct permit.
The construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement
action pursuant to NCGS 143-215.6A.
