P ARRISH, PE E XECUTIVE D IRECTOR OF U TILITIES AND I NFRASTRUCTURE S ERVICES T OWN OF H OLLY S PRINGS 128 S OUTH M AIN S TREET H OLLY S PRINGS, N ORTH C AROLINA 27540 Subject: Permit No. WQ0032289 Utley Creek WWTP Reclaimed Water System Reclaimed Water Local Program and Reclaimed Water Generation, Conjunctive Utilization, Bulk Distribution, and Distribution System Wake County Dear Ms. Parrish: In accordance with your permit minor modification and renewal request received June 29, 2021, we are forwarding herewith Permit No. WQ0032289 dated September 23, 2021, to the Town of Holly Springs for the continued operation of the subject reclaimed water generation, conjunctive utilization, bulk distribution, distribution system, and local program. The following modifications to the subject permit are as follows: updated the size of the feed pumps in the liquid sodium hypochlorite disinfection system to 33.7 gallons per hour (GPH); added Twelve Oaks Conjunctive Utilization System (Permit No. WQ0039842) as an approved conjunctive reclaimed water offsite user. This permit shall be effective from the date of issuance through February 29, 2028, shall void Permit No. WQ0032289 issued January 19, 2017, and shall be subject to the conditions and limitations therein. The Permittee shall submit a renewal application no later than September 2, 2027. Please pay attention to the monitoring requirements listed Attachments A, B, and D for they may differ from the previous permit issuance. Failure to establish an adequate system for collecting and maintaining the required operational information shall result in future compliance problems. The Division has removed the following permit conditions since the last permit issuance dated January 19, 2017: Old Condition III.4. This condition has been incorporated in the new Condition III.3. Old Condition III.10. This condition is included in the new Condition IV.9. Old Condition III.22. This condition is included in the new Condition III.22. Ms. Kendra D. Parrish, PE September 23, 2021 Page 2 of 3 Old Condition IV.3. This condition was removed because the flow is required in NPDES permit, and not in this permit. Old Condition VII.1. This condition duplicated the new Condition VI.2. Old Condition VII.3. This permit is not voidable. The following permit conditions are new since the last permit issuance dated January 19, 2017: Condition I.1. Operation of the reclaimed water distribution facilities shall be contingent upon construction and operation of permitted reclaimed water distribution lines immediately upstream and downstream of the reclaimed water distribution facilities permitted herein. Condition II.3. Construction of Permittee-approved reclaimed water distribution facilities shall be scheduled as not to interrupt service of existing utilities. Condition II.19. The Permittee shall ensure any landowner who is not the Permittee and owns land within the compliance boundary shall execute and file with the Wake County Register of Deeds an easement. Condition II.20. Setbacks were updated based on when the facilities were originally permitted. Condition III.9. Irrigation equipment shall be tested and calibrated once per permit cycle. Condition III.11. The Permittee shall ensure that approved users do not allow vehicles or heavy machinery on the irrigation area, except during equipment installation or maintenance activities. Condition III.16. The Permittee shall ensure that a protective vegetative cover shall be established and maintained on all berms, pipe runs, erosion control areas, surface water diversions, and earthen embankments. Condition III.17. The Permittee shall ensure that Permittee-approved metering equipment is tested and calibrated annually. Condition III.19. Continuous online monitoring and recording for turbidity or particle count and flow shall be provided prior to storage, distribution, or utilization of reclaimed water. Condition III.29. The Permittee shall develop and maintain a record keeping program for the bulk distribution of reclaimed water. Condition III.30 The Permittee shall develop and maintain a routine review and inspection program of those accepting bulk distributed reclaimed water. Condition III.31. The Permittee shall provide to its users and the Division of Water Resources an annual report summarizing the performance of the reclaimed water generation facility and the extent to which the facility has violated this permit, or federal or State laws, regulations, or rules related to the protection of water quality. Condition IV.8. The Permittee shall maintain a record of all residuals removed from this facility. Condition VI.9. The Permittee shall inspect each Permittee-approved site for compliance with the requirements of the reclaimed water local program at least once during construction. Conditions VII.8. and VII.9. Updated general permit language. Condition VII.10 Prevents the permit from being renewed if the Permittee has any unpaid overdue fees. Attachment A Added PPI 007 to monitor the reclaimed water distributed to Twelve Oaks Conjunctive Utilization System (Permit No. WQ0039842). Attachment B Added Twelve Oaks Conjunctive Utilization System (Permit No. WQ0039842) as a new approved site. If any parts, requirements, or limitations contained in this permit are unacceptable, the Permittee has the right to request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This request shall be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings at 6714 Mail Service Center, Raleigh, NC 27699-6714. The local reclaimed water program shall be limited to the reclaimed water generating facilities listed below: Permit No. Facility Status Facility Name NC0063096 Primary Utley Creek WWTP continued operation of a 1,500,000 gallon per day (GPD) reclaimed water generation facility consisting of: a continuous on-line turbidity meter; a liquid sodium hypochlorite disinfection system with two 33.7 gallon per hour (GPH) feed pumps and two 330 gallon storage tanks; two 1,050 gallon per minute (GPM) vertical turbine reclaimed water pumps; a totalizing flowmeter; and all associated piping, valves, controls, and appurtenances; the continued operation of a reclaimed water distribution system extension consisting of: approximately 610 linear feet (LF) of 30-inch reclaimed water force main; approximately 18 LF of 16-inch reclaimed water force main; approximately 8,840 LF of 12-inch reclaimed water force main; approximately 5,250 LF of 6- inch reclaimed water force main; approximately 110 LF of 4-inch reclaimed water force main; five air release valves; a 500,000 gallon elevated reclaimed water storage tank with a totalizing flow meter; and all associated piping, valves, controls and appurtenances; the continued operation of a conjunctive reclaimed water utilization system at the Green Oaks Parkway Medians consisting of: 0.65 acres of drip irrigation area; 1.73 acres of spray irrigation area; eight magnetic flow meters; and all associated piping, valves, controls and appurtenances; and the WQ0032289 Version 3.0 Shell Version 200201 Page 1 of 14 continued operation of a reclaimed water bulk distribution system extension consisting of: Fill Location Owner County Latitude Longitude Station 1 Utley Creek WWTP Town of Holly Springs Wake 34.644722° -78.850833° and all associated piping, valves, controls and appurtenances to serve the Utley Creek WWTP Reclaimed Water System, with no discharge of wastes to surface waters, pursuant to the application received June 29, 2021, and in conformity with the Division-approved plans and specifications considered a part of this permit. This permit shall be effective from the date of issuance through February 29, 2028, shall void Permit No. WQ0032289 issued January 19, 2017, and shall be subject to the following conditions and limitations: I. SCHEDULES 1. Operation of the reclaimed water distribution facilities shall be contingent upon construction and operation of permitted reclaimed water distribution lines immediately upstream and downstream of the reclaimed water distribution facilities permitted herein. Specifications for future upstream and downstream reclaimed water distribution lines shall include quality assurance testing procedures, which shall be adhered to prior to operation of the reclaimed water distribution facilities permitted herein. \[G.S. 143-215.1\] 2. The Permittee shall request renewal of this permit on Division-approved forms no later than September 2, 2027. \[15A NCAC 02T .0105(b), 02T .0109\] II. PERFORMANCE STANDARDS 1. The Permittee shall maintain and operate the subject reclaimed water facilities so there is no discharge to surface waters, nor any contravention of groundwater or surface water standards. In the event the facilities fail to perform satisfactorily, including the creation of nuisance conditions due to improper operation and maintenance, the Permittee shall take immediate corrective actions, including Division required actions, such as the construction of additional or replacement reclaimed water generation, conjunctive utilization, bulk distribution, and distribution facilities, or cessation of reclaimed water utilization, bulk distribution, and distribution activities. \[15A NCAC 02T .0108(b)(1)(A)\] 2. This permit shall not relieve the Permittee of their responsibility for damages to groundwater or surface water resulting from the operation of this facility. \[15A NCAC 02T .0108(b)(1)(A)\] 3. Construction of Permittee-approved reclaimed water distribution facilities shall be scheduled as not to interrupt service of existing utilities. \[15A NCAC 02T .0108(b)(1)(A)\] 4. Effluent limitations for generated reclaimed water shall not exceed those specified in Attachment A. \[15A NCAC 02U .0301\] 5. Reclaimed water may only be utilized for the delegated activities listed in Condition VI.3., distributed to Permittee-approved user sites/facilities, or utilized at the sites and for the activities specified in Attachment B. \[15A NCAC 02U .0401(g), 02U .0901(a)\] 6. Bulk distributed reclaimed water shall only be utilized in accordance with the approved uses specified in Attachment D. \[15A NCAC 02T .0108(b)(1)(A)\] WQ0032289 Version 3.0 Shell Version 200201 Page 2 of 14 7. The conjunctive utilization of bulk distributed reclaimed water permitted herein in no way negates, precludes, or invalidates Permit No. NC0063096. \[15A NCAC 02T .0108(b)(1)(A)\] 8. All reclaimed water valves, storage facilities, and outlets shall be tagged or labeled to warn the public or employees that the water is not intended for drinking. \[15A NCAC 02U .0403(b)\] 9. All reclaimed water piping, valves, outlets, and other appurtenances shall be color-coded, taped, or otherwise marked to identify the source of the water as being reclaimed water as follows: a. All reclaimed water piping and appurtenances shall be either colored purple (Pantone 522 or equivalent) and embossed or integrally stamped or marked "CAUTION: RECLAIMED WATER - DO NOT DRINK" or be installed with a purple (Pantone 522 or equivalent) identification tape or polyethylene vinyl wrap. The warning shall be stamped on opposite sides of the pipe and repeated every three feet or less; b. Identification tape shall be at least three inches wide and have white or black lettering on purple (Pantone 522 or equivalent) field stating "CAUTION: RECLAIMED WATER - DO NOT DRINK". Identification tape shall be installed on top of reclaimed water pipelines, fastened at least every 10 feet to each pipe length and run continuously the entire length of the pipe; and c. Existing underground distribution systems retrofitted for the purpose of conveying reclaimed water shall be taped or otherwise identified as noted in II.9.a. and II.9.b. This identification need not extend the entire length of the distribution system but shall be incorporated within 10 feet of crossing any potable water supply line or sanitary sewer line. \[15A NCAC 02U .0403(c)\] 10. All reclaimed water valves and outlets shall be of a type, or secured in a manner, that permits operation by personnel authorized by the entity that operates the reclaimed water system. \[15A NCAC 02U .0403(d)\] 11. Hose bibs shall be located in locked, below grade vaults that shall be labeled as being of non-potable quality. As an alternative to the use of locked vaults with standard hose bib services, other locking mechanisms such as hose bibs that can only be operated by a tool may be placed above ground and labeled as non-potable water. \[15A NCAC 02U .0403(e)\] 12. There shall be no direct cross-connections between the reclaimed water and potable water systems, unless such connection has been approved by the Department pursuant to 15A NCAC 18C .0406. \[15A NCAC 02U .0403(f)\] 13. Reclaimed water distribution lines shall be located at least 5 feet horizontally from and 18 inches below any water line if practicable. If these separation distances cannot be met, the piping and integrity testing procedures shall meet water main standards in accordance with 15A NCAC 18C. \[15A NCAC 02U .0403(g), 02U .0403(h)\] 14. Reclaimed water distribution lines shall not be less than 50 feet from a well unless the piping and integrity testing procedures meet water main standards in accordance with 15A NCAC 18C, but in no case shall they be less than 25 feet from a private well. \[15A NCAC 02U .0403(g), 02U .0403(i)\] 15. Reclaimed water distribution lines shall meet the separation distances to sewer lines in accordance with 15A NCAC 02T .0305. \[15A NCAC 02U .0403(g), 02U .0403(j)\] 16. Reclaimed water irrigation fields permitted on or after September 1, 2006 have compliance and review boundaries established at the irrigation area boundaries. Any exceedance of groundwater standards at or beyond the compliance boundary shall require corrective action. Division-approved relocation of the compliance boundary shall be noted in Attachment B. Multiple contiguous properties under common ownership and permitted for use as a disposal system shall be treated as a single property with regard to determination of a compliance boundary. \[15A NCAC 02L .0106, 02T .0105(h), 02U .0501(a)(6), G.S. 143-215.1(i), G.S. 143-215.1(k)\] WQ0032289 Version 3.0 Shell Version 200201 Page 3 of 14 17. The Permittee shall apply for a permit modification to establish a new compliance boundary prior to any sale or transfer of property affecting a compliance boundary (i.e., parcel subdivision). \[15A NCAC 02L .0107(c)\] 18. No wells, excluding Division-approved monitoring wells, shall be constructed within the compliance boundary except as provided for in 15A NCAC 02L .0107(g). \[15A NCAC 02L .0107\] 19. Except as provided for in 15A NCAC 02L .0107(g), the Permittee shall ensure any landowner who is not the Permittee and owns land within the compliance boundary shall execute and file with the Wake County Register of Deeds an easement running with the land containing the following items: a. A notice of the permit and number or other description as allowed in 15A NCAC 02L .0107(f)(1); b. Prohibits construction and operation of water supply wells within the compliance boundary; and c. Reserves the right of the Permittee or the State to enter the property within the compliance boundary for purposes related to the permit. The Director may terminate the easement when its purpose has been fulfilled or is no longer needed. \[15A NCAC 02L .0107(f)\] 20. The facilities herein were permitted per the following setbacks: a. The reclaimed water irrigation sites were originally permitted June 25, 2010. The setbacks for irrigation sites originally permitted or modified from September 1, 2006 to June 17, 2011 are as follows (all distances in feet): i. Surface waters classified SA: 100 ii. Surface waters not classified SA: 25 iii. Each well with exception of monitoring wells: 100 \[15A NCAC 02T .0912(b)\] b. The storage and treatment units were originally permitted March 20, 2008. The setbacks for storage and treatment units originally permitted or modified from September 1, 2006 to June 17, 2011 are as follows (all distances in feet): 1 i. Each habitable residence or place of assembly under separate ownership: 100 ii. Each private or public water supply source: 100 iii. Surface waters: 50 iv. Each well with exception of monitoring wells: 100 2 v. Each property line: 50 1 Habitable residences or places of assembly under separate ownership constructed after the facilities herein were originally permitted or subsequently modified are exempt from this setback. 2 Setbacks to property lines are not applicable when the Permittee, or the entity from which the Permittee is leasing, owns both parcels separated by the property line. \[15A NCAC 02T .0912(a)\] WQ0032289 Version 3.0 Shell Version 200201 Page 4 of 14 III. OPERATION AND MAINTENANCE REQUIREMENTS 1. Only reclaimed water from the generating facilities listed in the facility description are approved for distribution under the conditions of this permit. \[15A NCAC 02T .0108(b)(1)(A)\] 2. The Permittee shall operate and maintain the subject facilities as a non-discharge system. \[15A NCAC 02U .0101\] 3. The Permittee shall maintain an Operation and Maintenance Plan, which shall include: a. A description of the operation of the system in detail to show what operations are necessary for the system to function and by whom the operations are to be conducted; b. A sampling and monitoring plan to evaluate quality of reclaimed water within the bulk distribution system to provide quality assurance at the time of reuse, and specify actions to be taken in response to unsatisfactory monitoring results; c. A map of all reclaimed water bulk distribution points; d. A map of all reclaimed water distribution lines; e. A description of anticipated maintenance of the system; f. Provisions for safety measures, including restriction of access to the site and equipment; g. Spill control provisions that include response to upsets and bypasses, including control, containment, and remediation, and contact information for personnel, emergency responders, and regulatory agencies; h. Approval procedures for bulk distribution users; i. Operational requirements for bulk distribution users; and j. A description of how compliance with reclaimed water quality standards will be ensured the time of use if bulk distributed reclaimed water is stored for greater than 72 hours prior to use. \[15A NCAC 02U .0801(a)\] 4. classification of the subject non-discharge facilities, the Permittee shall designate and employ a certified operator in responsible charge (ORC), and one or more certified operators as back-up ORCs. The ORC or their back-up shall operate and visit the facilities as required by the WPCSOCC. \[15A NCAC 02T .0117\] 5. An operator certified by the Water Pollution Control System Operators Certification Commission (WPCSOCC) of a grade equivalent or greater than the facility classification shall be on call 24 hours per day. \[15A NCAC 02U .0401(e)\] 6. The Permittee shall maintain vegetative cover on the irrigation sites, such that crop health is optimal, allows even effluent distribution, and allows inspection of the irrigation system. \[15A NCAC 02U .0801(b)\] 7. The Permittee shall take measures to prevent effluent ponding in or runoff from the irrigation sites listed in Attachment B. \[15A NCAC 02U .0801(c)\] 8. The Permittee shall not irrigate treated effluent during inclement weather, or when the soil is in a condition that will cause ponding or runoff. \[15A NCAC 02U .0401(k)\] 9. Irrigation equipment shall be tested and calibrated once per permit cycle. \[15A NCAC 02U .0801(d)\] WQ0032289 Version 3.0 Shell Version 200201 Page 5 of 14 10. Only reclaimed water generated from the Utley Creek WWTP (Permit No. NC0063096) shall be utilized or conveyed in Permittee-approved bulk distribution, distribution, and conjunctive utilization facilities, operations, and activities, as well as the reclaimed water bulk distribution, distribution, and conjunctive utilization facilities permitted herein. \[15A NCAC 02U .0101\] 11. The Permittee shall ensure that approved users do not allow vehicles or heavy machinery on the irrigation area, except during equipment installation or maintenance activities. \[15A NCAC 02U .0801(e)\] 12. The Permittee shall prohibit public access to the wastewater treatment and storage facilities. \[15A NCAC 02T .0108(b)(1)(A)\] 13. The Permittee shall ensure that public access to reclaimed water utilization sites shall be controlled during active site use. Such controls may include the posting of signs showing the activities being conducted at each site. \[15A NCAC 02U .0501(a)(2)\] 14. The Permittee shall dispose or utilize generated residuals in a Division-approved manner. \[15A NCAC 02T .1100, 02U .0802\]. 15. The Permittee shall not divert or bypass untreated or partially treated reclaimed water from the subject facilities unless diverted to an alternate treatment or collection system. \[15A NCAC 02T .0108(b)(1)(A)\] 16. The Permittee shall ensure that a protective vegetative cover shall be established and maintained on all berms, pipe runs, erosion control areas, surface water diversions, and earthen embankments (i.e., outside toe of embankment to maximum allowable temporary storage elevation on the inside of the embankment). Trees, shrubs, and other woody vegetation shall not be allowed to grow on the earthen dikes or embankments. Earthen embankments shall be kept mowed or otherwise controlled and accessible. \[15A NCAC 02U .0801(g)\] 17. The Permittee shall ensure that Permittee-approved metering equipment and metering equipment approved herein is tested and calibrated annually. \[15A NCAC 02U .0801(d)\] 18. An automatically activated standby power source or other means to prevent improperly treated wastewater from entering the storage, distribution, or utilization system shall be provided. \[15A NCAC 02U .0401(d)\] 19. Continuous online monitoring and recording for turbidity or particle count and flow shall be provided prior to storage, distribution, or utilization of reclaimed water. \[15A NCAC 02U .0401(b)\] 20. If turbidity exceeds 10 NTUs or if the permitted pathogen levels cannot be met, all effluent shall be prohibited from entering the storage, bulk distribution, distribution, or utilization system, and shall be disposed of in accordance with Permit No. NC0063096 until the reclaimed water standards are met at the generating facility. \[15A NCAC 02U .0401(c)\] 21. The Permittee shall provide notification to the public and its employees about the use of reclaimed water, and that reclaimed water is not intended for drinking. Such notification shall be provided to employees in a language they can understand. \[15A NCAC 02U .0501(a)(2)\] 22. The Permittee shall develop and implement an education program to inform users and its employees about the proper use of reclaimed water. Educational material shall be provided to all residents and/or other facilities provided with reclaimed water, and these materials shall be maintained consistent with the reclaimed water uses. All educational materials shall be made available to the Division upon request. \[15A NCAC 02U .0501(a)(4)\] 23. Bulk distributed reclaimed water used for activities other than irrigation shall not be used in a manner that causes exposure to aerosols. \[15A NCAC 02U .0501(b)(6)\] WQ0032289 Version 3.0 Shell Version 200201 Page 6 of 14 24. Bulk distributed reclaimed water shall not be used for swimming pools, hot tubs, spas, or similar uses. \[15A NCAC 02U .0501(c)\] 25. Tank trucks and other equipment used to transport bulk distributed reclaimed water shall be identified with advisory signs stating that they contain reclaimed water that is not intended for drinking. \[15A NCAC 02U .0601(a)\] 26. Tank trucks used to transport bulk distributed reclaimed water shall not be used to transport potable water. \[15A NCAC 02U .0601(b)\] 27. Tank trucks used to transport bulk distributed reclaimed water shall not be filled through on-board piping or removable hoses that may subsequently be used to fill potable water tanks. \[15A NCAC 02U .0601(c)\] 28. The Permittee shall develop and maintain an education and approval program for those accepting bulk distributed reclaimed water. Educational materials shall instruct those accepting bulk distributed reclaimed water about its proper use in accordance with Subchapter 02U and those approved activities in Attachment D. \[15A NCAC 02U .0601(d)\] 29. The Permittee shall develop and maintain a record keeping program for the bulk distribution of reclaimed water. \[15A NCAC 02U .0601(e)\] 30. The Permittee shall develop and maintain a routine review and inspection program of those accepting bulk distributed reclaimed water. \[15A NCAC 02U .0601(f)\] 31. the local program. \[15A NCAC 02T .0108(b)(1)(A)\] IV. MONITORING AND REPORTING REQUIREMENTS 1. The Permittee shall conduct and report any Division required monitoring necessary to evaluate this groundwater and surface water. \[15A NCAC 02T .0108(c)\] 2. A Division-certified laboratory shall conduct all analyses for the required effluent, groundwater, and surface water parameters. \[15A NCAC 02H .0800\] 3. The Permittee shall monitor the generated reclaimed water at the frequencies and locations for the parameters specified in Attachment A. \[15A NCAC 02T .0108(c)\] 4. The Permittee shall maintain adequate records tracking the amount of reclaimed water distributed and shall include the following information: a. Date reclaimed water distributed; and b. Volume of reclaimed water distributed to each site specified in Attachment B (monthly total). Monthly tracking records shall be summed and reported per requirement of Condition VI.11. This value shall represent the total volume of reclaimed water distributed for that month. \[15A NCAC 02T .0108(c)\] WQ0032289 Version 3.0 Shell Version 200201 Page 7 of 14 5. The Permittee shall maintain records tracking the amount of reclaimed water bulk distributed to each user and shall include the following information: a. Date and time of bulk distribution event; b. Name of receiver or town-issued bulk fill certification number; c. Intended use of the bulk distributed reclaimed water; d. Volume of reclaimed water per each bulk distribution event; and e. Monthly total volume of reclaimed water bulk distributed. Monthly tracking records for all users shall be summed and reported per the requirements of Condition VI.11. This value shall represent the total volume of reclaimed water bulk distributed to all users for that month. \[15A NCAC 02T .0108(c)\] 6. Three copies of all monitoring data (as specified in Conditions IV.3., IV.4., and IV.5.) on Form NDMR for each PPI shall be submitted on or before the last day of the following month. If no activities occurred during the monitoring month, monitoring reports are still required documenting the absence of the activity. Pursuant to G.S. 143-215.1C(a), the Permittee shall provide to its users and the Division of Water Resources an annual report summarizing the performance of the reclaimed water generation facility and the extent to which the facility has violated this permit, or federal or State laws, regulations, or rules related to the protection of water quality. This report shall be prepared on either a calendar or fiscal year basis and shall be provided no later than 60 days after the end of the calendar or fiscal year. The Permittee shall maintain a record of all residuals removed from this facility. This record shall be maintained for five years, and shall be made available to the Division upon request. This record shall include: a. Name of the residuals hauler; b. Non-Discharge permit number authorizing the residuals disposal, or a letter from a municipality agreeing to accept the residuals; c. A maintenance log shall be kept at this facility. This log shall be maintained for five years, and shall be made available to the Division upon request. This log shall include: a. Date of flow measurement device calibration; b. Date of irrigation equipment calibration; c. Date of turbidimeter calibration; d. Date and results of power interruption testing on alternate power supply; e. Visual observations of the bulk distribution facilities; f. Visual observations of the plant and plant site; and g. Record of preventative maintenance (e.g., changing of equipment, adjustments, testing, inspections and cleanings, etc.); and h. Record of all discharges of reclaimed water to surface waters or the land surface, including the date of occurrence, estimated volume, and corrective action taken. \[15A NCAC 02U .0801(h)\] 10. The Permittee shall develop and maintain a routine review and inspection program for offsite users of conjunctive reclaimed water. An inspection log shall be maintained for five years, and shall be made available to the Division upon request. This log shall include: a. Visual observations of the reclaimed water user sites; and b. Record of preventative maintenance (e.g., pump and valve maintenance, cross connection control, etc.). \[15A NCAC 02U .0801(i)\] 11. Noncompliance Notification: The Permittee shall report to the Raleigh Regional Office, telephone number (919) 791-4200, within 24 hours of first knowledge of the following: a. Treatment of wastes abnormal in quantity or characteristic, including the known passage of a hazardous substance. b. Any process unit failure (e.g., mechanical, electrical, etc.) rendering the facility incapable of adequate wastewater treatment. c. Any failure rendering the reclaimed water bulk distribution and distribution facilities incapable of adequately conveying the reclaimed water (e.g., mechanical or electrical failures, line blockages or breaks, etc.). d. Any failure resulting in a discharge untreated or partially treated wastewater to surface waters. e. Any failure resulting in a discharge of distributed reclaimed water to surface waters. f. Any failure resulting in a discharge of reclaimed water directly to surface waters or any unpermitted release of reclaimed water to land surface greater than or equal to 5,000 gallons. Unpermitted releases less than 5,000 gallons to land surface shall be documented by the Permittee in accordance with Condition IV.9hg. but do not require Regional Office notification. g. Any time self-monitoring indicates the facility has gone out of compliance with its permit limitations. h. Ponding in or runoff from the irrigation sites. Emergencies requiring reporting outside normal business hours shall call Response personnel at telephone number (800) 662-7956, (800) 858-0368, or (919) 733-3300. All noncompliance notifications shall file a written report to the Raleigh Regional Office within five days of first knowledge of the occurrence, and this report shall outline the actions proposed or taken to ensure the problem does not recur. \[15A NCAC 02T .0108(b)(l)(A)\] WQ0032289 Version 3.0 Shell Version 200201 Page 9 of 14 V. INSPECTIONS 1. The Permittee shall perform inspections and maintenance to ensure proper operation of the reclaimed water generation, conjunctive utilization, bulk distribution, and distribution facilities. \[15A NCAC 02U .0801(i)\] 2. The Permittee shall inspect the Permittee-approved reclaimed water generation, conjunctive utilization, bulk distribution, and distribution facilities to prevent malfunctions, facility deterioration, and operator errors that may result in discharges of wastes to the environment, threats to human health, or public nuisances. The Permittee shall maintain an inspection log that includes the date and time of inspection, observations made, and maintenance, repairs, or corrective actions taken. The Permittee shall maintain this inspection log for a period of five years from the date of the inspection, and this log shall be made available to the Division upon request. \[15A NCAC 02U .0801(h), 02U .0801(i)\] 3. Division authorized representatives may, upon presentation of credentials, enter and inspect any property, premises, or place related to the reclaimed water generation, conjunctive utilization, bulk distribution, and distribution facilities permitted herein at any reasonable time for determining compliance with this permit. Division authorized representatives may inspect or copy records maintained under the terms and conditions of this permit, and may collect groundwater, surface water, or leachate samples. \[G.S. 143-215.3(a)(2)\] 4. The Permittee shall inspect the conjunctive utilization sites of all reclaimed water users who obtain more than 10,000 gallons per day of bulk distributed reclaimed water. Permittee inspection of these bulk distribution reclaimed water utilization sites shall need to exceed one inspection per quarter. The Permittee shall maintain records of these inspections for five years, and shall make them available to the Division upon request. \[15A NCAC 02T .0108(b)(1)(A)\] 5. The Permittee shall develop and maintain a program of routine review and inspection of Permittee- approved reclaimed water users. \[15A NCAC 02T .0108(b)(1)(A)\] VI. LOCAL PROGRAM 1. The Permittee shall properly operate and maintain the reclaimed water local program pursuant to the requirements of 15A NCAC 02U .0901 and G.S. 143-215.1(f). Any future amendment to the requirements in 15A NCAC 02U .0901 shall be incorporated into the reclaimed water local program within 60 days of the effective date of the amendments. The reclaimed water local program shall include the following: a. Require users to obtain a permit from the Permittee prior to utilizing reclaimed water generated by the Permittee; b. Require industrial, commercial, or institutional users to develop and implement an educational program targeted at individuals who may come in contact with reclaimed water. The program shall identify the source of reclaimed water and provide information on its proper use; c. Require that plans and specifications for all construction, extensions, alterations, and changes to reclaimed water utilization system be prepared by or under the direct supervision of a North Carolina licensed Professional Engineer when required by G.S. 89C; d. Provide for the adequate administrative organization, engineering staff, financial and other resources necessary to effectively perform the local plan review activities; and e. Provide adequate resources for the continued operation, service, and maintenance of the reclaimed water distribution and utilization system. \[G.S. 143-215.1(f), 15A NCAC 02U .0901, 02U .0901(c)\] WQ0032289 Version 3.0 Shell Version 200201 Page 10 of 14 2. The reclaimed water local program delegated to the Permittee by the Environmental Management Commission (EMC) may be suspended or revoked unless the documentation within the approved delegation application package and any modifications thereto are valid, the requirements in 15A NCAC 02U .0901 and G.S. 143-215.1(f) are met, the conditions of this permit are met, and the reclaimed water system constructed in accordance with the conditions and specifications of the delegated program. \[G.S. 143-215.1(f), 15A NCAC 02U .0900\] 3. The reclaimed water local program shall be limited to permitting construction, modification, and operation of reclaimed water distribution lines, and the following conjunctive utilization activities: residential irrigation sites, non-residential irrigation sites less than or equal to five acres in size within the Town of Holly Springs and areas under the contractual control of the Town of Holly Springs, and bulk distribution of reclaimed water from Utley Creek WWTP bulk fill station limited to approved uses as allowed pursuant to 15A NCAC 02U .0501 (see Attachment D). \[15A NCAC 02U .0901(a)\] 4. Construction of and modifications to treatment works, including pump stations for reclaimed water distribution, shall be approved by the Division. \[15A NCAC 02U .0901(a)\] 5. The reclaimed water local program is not approved to permit dedicated reclaimed water treatment and utilization systems. \[15A NCAC 02U .0901(a)\] 6. The Permittee shall establish by ordinance its legal authority to: require new reclaimed water distribution lines and utilization systems to be properly constructed and operated; ensure proper inspection and testing of reclaimed water distribution lines, service laterals, and utilization systems; and take enforcement action. The ordinance shall provide the following: a. Require users to obtain a permit from the reclaimed water local program prior to construction and utilization of the reclaimed water utilization system. b. Establish procedures for administrative review and judicial review of the local permit decision. c. Establish enforcement authority (civil, criminal, and injunctive) for failure to obtain the required permit, and violations of the local permit. d. Establish procedures for processing permit applications compatible with those contained in 15A NCAC 02T .0107, 02T .0108, and 02T .0109. e. Establish procedures for setting local permit requirements compatible with those contained in 15A NCAC 02U. \[15A NCAC 02U .0901(b)\] 7. The Permittee shall develop and implement an enforcement program under which the Permittee can take enforcement against users who have not properly installed, operated and maintained reclaimed water distribution and utilization systems as permitted, or otherwise violated the terms of the local ordinance pertaining to reclaimed water use. \[15A NCAC 02U .0901(b)(2)\] 8. The Permittee shall have on staff or shall retain a licensed North Carolina Professional Engineer to review unusual situations or designs, and to answer questions that arise in the review of proposed projects if required by G.S. 89C. The Permittee shall also provide staff or retain a consultant to review all other non-engineering related program areas (i.e., soil science, agronomy, hydrogeology, etc.). \[15A NCAC 02U .0901(d)\] 9. The Permittee shall inspect each Permittee-approved site for compliance with the requirements of the reclaimed water local program at least once during construction. \[15A NCAC 02U .0901(e)\] WQ0032289 Version 3.0 Shell Version 200201 Page 11 of 14 10. The Permittee shall maintain adequate records pertaining to user violations, enforcement actions, and complaints for five years. These records shall include: a. Date of violation, enforcement, or complaint; b. Description of the violation or complaint; c. Estimated duration of the violation; d. Division personnel that were informed about the violations and/or complaint, (if applicable); and e. Corrective actions taken to address violation (if applicable). \[15A NCAC 02U .0901(g)\] 11. The Permittee shall submit two copies of an annual report to the Division. The annual report shall include: a description of all permitting actions taken during the year; a list and description of all enforcement actions taken or pending during the year; bypasses from distribution lines; and a monitoring summary of the distribution system. The report shall also include a copy of all program documents such as minimum design criteria (i.e., specifications), permit applications, permit shells, shell certification forms and a summary of any other program changes (e.g., staffing, processing fees, and ordinance revisions). The report shall be submitted to the Division within 30 days after the end of each year. \[15A NCAC 02U .0901(g), 02U .0901(h)\] 12. Any modification of the reclaimed water local program procedures or requirements specified in 15A NCAC 02U .0901 shall be approved by the Division to assure that the procedures and requirements remain as stringent as the State-wide requirements in 15A NCAC 02U. \[15A NCAC 02U .0901(i)\] 13. Appeal of individual permit denials or issuance with conditions the reclaimed water local program permit applicant finds unacceptable shall be made according to the approved local ordinance. The Division shall not consider reclaimed water local program individual permit denials or issuance with conditions to which a Permittee-approved user objects. \[15A NCAC 02U .0901(j)\] 14. The Permittee shall maintain records of all modifications and extensions to the reclaimed water distribution system. The Permittee shall maintain a copy of the construction record drawings and specifications for modifications/extensions to the reclaimed water distribution system for the life of the system. Information concerning the extension shall be incorporated into the comprehensive reclaimed water distribution system map within one year of completion of construction. \[15A NCAC 02T .0105(o), 02T .0108(b)(1)(A)\] 15. The Permittee shall maintain an accurate and up-to-date comprehensive map of its reclaimed water distribution system. The map shall include: pipe size; pipe material; pipe location; approximate pipe age; number of active service taps; and each pump station identification, location, and capacity. The map shall also include the location of all reclaimed water bulk fill stations. \[15A NCAC 02U .0801(a)(3)\] 16. Any reclaimed water local program user application requiring an Environmental Assessment under 15A NCAC 01C Conformity with North Carolina Environmental Policy Act shall be approved by the Division. \[15A NCAC 01C, 02T .0105(c)(4)\] WQ0032289 Version 3.0 Shell Version 200201 Page 12 of 14 VII. GENERAL CONDITIONS 1. Failure to comply with the conditions and limitations contained herein may subject the Permittee to a Division enforcement action. \[G.S. 143-215.6A, 143-215.6B, 143-215.6C\] 2. This permit is effective only with respect to the nature and volume of wastes described in the permit application, and Division-approved plans and specifications. \[G.S. 143-215.1(d)\] 3. Unless specifically requested and approved in this permit, there are no variances to administrative codes or general statutes governing the construction or operation of the facilities permitted herein. \[15A NCAC 02T .0105(n)\] 4. The issuance of this permit does not exempt the Permittee from complying with all statutes, rules, regulations, or ordinances that other jurisdictional government agencies (e.g., local, state, and federal) may require. \[15A NCAC 02T .0105(c)(6)\] 5. If the permitted facilities change ownership, or the Permittee changes their name, the Permittee shall submit a permit modification request on Division-approved forms. The Permittee shall comply with all terms and conditions of this permit until the permit is transferred to the successor-owner. \[G.S. 143- 215.1(d3)\] 6. The Permittee shall retain a set of Division-approved plans and specifications for the life of the facilities permitted herein. \[15A NCAC 02T .0105(o)\] 7. The Permittee shall maintain this permit until the proper closure of all facilities permitted herein, or until the facilities permitted herein are permitted by another authority. \[15A NCAC 02T .0105(j)\] 8. This permit is subject to revocation or modification upon 60-day notice from the Division Director, in whole or part for: a. violation of any terms or conditions of this permit or Administrative Code Title 15A Subchapter 02U; b. obtaining a permit by misrepresentation or failure to disclose all relevant facts; c. sentation of credentials: i. to enter the where a system is located or where any records are required to be kept; ii. to have access to any permit required documents and records; iii. to inspect any monitoring equipment or method as required in this permit; or iv. to sample any pollutants; d. ee for administering and compliance monitoring; or e. a Division determination that the conditions of this permit are in conflict with North Carolina Administrative Code or General Statutes. \[15A NCAC 02T .0110\] WQ0032289 Version 3.0 Shell Version 200201 Page 13 of 14 9. Unless the Division Director grants a variance, expansion of the facilities permitted herein shall not occur if any of the following apply: a. The Permittee or any parent, subsidiary, or other affiliate of the Permittee has been convicted of environmental crimes under G.S. 143-215.6B, or under Federal law that would otherwise be prosecuted under G.S. 143-215.6B, and all appeals of this conviction have been abandoned or exhausted. b. The Permittee or any parent, subsidiary, or other affiliate of the Permittee has previously abandoned a wastewater treatment facility without properly closing the facility. c. The Permittee or any parent, subsidiary, or other affiliate of the Permittee has not paid a civil penalty, and all appeals of this penalty have been abandoned or exhausted. d. The Permittee or any parent, subsidiary, or other affiliate of the Permittee is currently not compliant with any compliance schedule in a permit, settlement agreement, or order. e. The Permittee or any parent, subsidiary, or other affiliate of the Permittee has not paid an annual fee. \[15A NCAC 02T .0120(b), 02T .0120(d)\] 10.
