Dear Mr. Tharriugton,
The Town is in receipt of your NOV & Intent to Assess Civil Penalty dated August 16, 2021. The NOV
is for recording keeping and aeration basins leak. We request that no civil penalties be assessed for these
violations and offer the following comments:
The most recent Annual Wastewater Report has now been completed and is attached with this letter.
We will ensure that future annual reports are completed in a timely manner and submitted for the
Division's records as required. The previous annually reports and copies of the monthly reports
will be printed and the hard copies will be filed at the WWTP as required by tine permit.
The wastewater leak located at the back end of the original aeration basin # 1 and noted during the
May 2019 inspection was addressed but reappeared. The Town attempted to seal the leak from the
outside and inside, but it failed. The Town contacted Axel McPherson Construction, Inc. to repair
the leak around the end of May 2019. The leak was repaired and the Town paid $6,894.44 foil the
repairs (see attached) on June 10, 2019. The leak reappeared sometime after the repairs were
completed. The Town installed a sunup pump at the hole where the leak was coming out in order
to capture the leakage and pumped it back into the basin. The Town has contacted LKC
Engineering to evaluate the leak and provide a recommendation for a permanent repair. Once LKC
evaluates and provides a recommendation to repair, we will forward their recommendation and a
schedule for completion for your records.
No environmental damage was observed due to this violation.
It is the goat of the Town of Chadbourn to always maintain fill compliance with the NPDES requirements.
We regret this inadvertent instance attd have taken measures to prevent any additional missed monitoring
events.
