All of the vegetation was submerged; inspectors noted soft rush, lizard tail, blue flag iris, and pickerel weed (shallow water plants). However, none of the shallow land plants noted on the planting plan (attached) were observed during the inspection. Since the pond was full of water the amount of sediment accumulation could not be determined. The pond outlet needs to be re -armored where it discharges into the receiving stream. Grass needs to be established on the perimeter of the BMP (bypass areas and near outlet). The outlet control structure could not be inspected due to the height of the water in the pond, It was noted that there is no way to safely access the outlet structure during periods of high flow as was noted during the inspection, There was some erosion near the bypass structure for the off -site drainage. Most of them were of the fiber optic cable because this company has really caused some problems getting this cable installed. As soon as we discovered the actual problem we got right on it and corrected it. It was very helpful to have a trachoe on sight to dig up the parking lot. Thank you also for your help. My assistant superintendent really takes these things seriously and worries about the consequences. Again please let me know if this isn't sufficient. A plumber responded but didn't see anything at that time but would return tomorrow to do a detailed investigation. Tuesday November 9, 2010..........after looking in all of the manholes and catch basins it appeared that the line from the cafeteria including the grease trap and one toilet was emptying into the storm drain line and being routed to the creek across the road. This was discovered around 11:00 am. Use of the toilet was stopped immediately. Trying to decide what action to take and looking further it was thought that the "Y" fitting was bad. Since there was no definitive answer the decision was made to call Lake Norman Sewer Company to bring their camera and see what was actually going on. Realizing that there was a problem with the sewer line directly out from the cafeteria a trachoe on site was used to dig up the parking lot, At around 2:00pm a call was made to Wes Bell with DWQ/DENR to inform him of what was going on and asking what we needed to do. After speaking to Wes the first time the actual cause of the problem was discovered. In early September, Broadplex installed fiber optic cable and apparently bored through the storm water piping and then the sewer line. After exposing the drilled through place in the parking lot the line was cut out and a new pipe was installed. Rick Sain, Director of Facilities Management made a call to Kevin Greer with the City of Hickory Public Works Department to inform them of the problem that was found and the corrective actions that were taken. Wednesday November 10, 2010...........Another trip was made to wash out the sewer line as well as the storm drains and catch basins. Leatherman's Septic Tank Service was there to pump out the drainage. Lime was spread over the area after it was cleaned up. There appeared to be no damage at the creek as this is a small intermittent flow and there is an artesian well that flows in dose proximity to this area. Jane T. Foard WWTP NC0029297 Record Keeping: The amended DMR was submitted with the December DMRs, Septic Tank: The alarms were not operating due to the fact that the lights get shot out since the plant is in an isolated area. We will look into installing just the horns to the alarm float. Sand Filters: The hole will be filled and if the pressure cannot be reduced to keep this from happening then a stainless steel screw will be installed into that opening. Bandys High School NC 0051608 Dechlorination Facilities: The foam has been replaced with ,grout. Blackburn Elementary NC0074233 Facility in Compliance Bunker Hill High School NC0044059 Septic Tank: The alarms were not operating due to the fact that there had been some vandalism to the lights. We will look into installing horns. This system will go off line by December 31, 2007. Mill. Creek Middle School NC00863 04 Septic Tank: The alarms and lights were orking at the time of the inspection. Effluent Pipe: An extension of the right of way agreement was extended for an additional 3 years and permission was granted so that a gate can be installed. Sherrills Ford Elementary NC004543 8 Dechlorination Facility: The foam has been replaced with grout material. Septic Tank: As with the other facilities with this deficiency, the alarms have not worked for several years. This one was due to lightning. We will install horns at this location. Bidding requirements have changed for projects that are advertised after January 1,'2002. The documents must be revised to address the new MBE requirements and the new dispute resolution requirements. (9) Notice of the pre -bid meeting for prospective bidders. (10) The contract duration should be clearly identified in the specifications. (11) The information from a reasonable subsurface investigation must be made available to the contractor. (18) Plans should clearly identify the 100-year flood elevation. The 100-year flood elevation was not included in your submittal. Please note that if the rim elevation above the 100-year flood elevation is greater than one foot, then the manhole needs to be watertight. (19) Confirm that all mitigative measures required by other permits and environmental assessments have been incorporated in the plans and specifications. Provide a summary of those measures in your written response. (20) Advise if there are gas stations in the vicinity of the proposed project. If yes, then an investigation should be performed on the soils and groundwater to determine if they are petroleum contaminated. When the contamination exists, plans and specifications must address how the contaminated soils and groundwater must be handled. All materials used in petroleum contaminated soils need to be compatible with petroleum. We are hereby supplying limits that would currently be assigned to the facility if the capacity were 0.0065 million gallons per day (MGD) discharging to Balls Creek in Catawba County. The proposed discharge location on Balls Creek has a drainage area of approximately 3.48 square miles. An estimated summer 7Q10 flow of 0.60 cubic feet per second was derived for this location based on U.S. Geological Survey (USGS) methodology for determining low flows. Balls Creek is within the Catawba River Basin and flows northeast until it discharges to Lake Norman. NC0034657 AND NORTH CAROLINA GENERAL STATUTE 143-215.1(a)(6) FINDINGS AND DECISIONS AND ASSESSMENT OF CIVIL PENALTIES Acting pursuant to North Carolina General Statute (G.S.) 143-215.6A, I, A. Preston Howard, Jr., Acting Director of the Division of Environmental Management (DEM), make the following: I. FINDINGS OF FACT: A. The Catawba County School System (hereafter CCSS) is a public school system organized and existing under the laws of the State of North Carolina. B. The CCSS operates a 0.010 MGD wastewater treatment plant NE of Hickory, North Carolina, which is located in Catawba County, North Carolina. C. The CCSS was issued NPDES Permit No. NC0034657 on March 2, 1992, effective April 1, 1992, with an expiration date of June 30, 1995. D. Said permit contains the following relevant effluent limitations: Parameter Limitation Units Monthly Daily Average Maximum Fecal Coliform 200.0 * 400.0 * #/100 ml RES/TSS 30.0 * 45.0 * mg/1 BOD 30.0 * 45.0 * mg/1 * Limit effective both summer and winter. E. Monthly self -monitoring reports since October, 1991 _lave revealed the following exceedances of the above - cited permit effluent limits: (See Attachment A) F. Notices of Violation concerning the monthly average permit limitations violations at the subject plant were sent to the CCSS by DEM's Mooresville Regional Office. Catawba County School System Page Two G. None of the above -cited exceedances of the permit effluent limitations were the result of a bypass or power failure at the plant as defined inthe permit. H. The costs to the State of the enforcement procedures in this matter totalled $ 238.63. Based upon the above Findings of Fact, I make the following: II. CONCLUSIONS OF LAW: A. The CCSS is a "person" within the meaning of G.S. 143- 212(4).- B. NPDES Permit No. NC0034657 is required by G.S. 143- 215.1. C. The effluent limitations contained in the subject permit are terms, conditions, or requirements of said permit. D. The CCSS violated G.S. 143-215.1(a)(6) and NPDES Permit No. NC0034657 on three (3) occasions during October, 1991 through September, 1992 in the manner and to the extent described in Attachment A, when the permittee permitted waste to be discharged into the waters of the State in violation of the monthly average permitted effluent limit for Fecal Coliform. E. The CCSS violated G.S. 143-215.1(a)(6) and NPDES Permit No. NC0034657 on six (6) occasions during October, 1991 through September, 1992 in the manner and to the extent described in Attachment A, when the permittee permitted waste to be discharged into the waters of the State in violation of the daily maximum permitted effluent limit for Fecal Coliform. F. The CCSS violated G.S. 143-215.1(a)(6) and NPDES Permit No. NC0034657 on two (2) occasions during October, 1991 through September, 1992 in the manner and to the extent described in Attachment A, when the permittee permitted waste to be discharged into the waters of the State in violation of the monthly average permitted effluent limit for Total Suspended Residue (TSS). The CCSS violated G.S. 143-215.1(a)(6) and NPDES Permit No. NC0034657 on two (2) occasions during October, 1991 through September, 1992 in the manner and to the extent described in Attachment A', when the permittee permitted waste to be discharged into the waters of the State in violation of the daily maximum permitted effluent limit for Total Suspended Residue (TSS). H. The CCSS violated G.S. 143-215.1(a)(6) and NPDES Permit No. NC0034657 on five (5) occasions during October, 1991 through September, 1992 in the manner and to the extent described in Attachment A, when the permittee permitted waste to be discharged into the waters of the State in violation of the monthly average permitted effluent limit for Biochemical Oxygen Demand (BODS). I. The CCSS violated G.S. 143-215.1(1)(6) and NPDES Permit No. NC0034657 on four (4) occasions during October, 1991 through September, 1992 in the manner and to the extent described in Attachment A, when the permittee permitted waste to be discharged into the waters of the State in violation of the daily maximum permitted effluent limit for Biochemical Oxygen Demand (BODS). J. General Statute 143-215.6A(a) provides that a civil penalty of not more than ten thousand dollars per violation may be assessed against a person who violates or fails to act in accordance with the terms, conditions, or requirements of a permit required by G.S. 143-215.1. K. The State's enforcement costs in this matter may be assessed against CCSS pursuant to G.S. 143-215.3(a)(9) and G.S. 143B-282.1(b)(8). L. The Director, Division of Environmental Management, pursuant to delegation provided for by G.S. 143- 215.6A(h), has the authority to assess civil penalties. DECISION: Accordingly, the CCSS is hereby assessed a civil penalty of: $ For of the three (3) subject violations of G.S. 143-215.1(a)(6) and NPDES Permit No. NC0034657, by discharging waste into the waters of the State in violation of permit monthly average effluent limit for Fecal Coliform. For of the two (2) subject violations of G.S. 143-215.1(a)(6) and NPDES Permit No. NC0034657, by.discharging waste into the waters of the State in violation of permit monthly average effluent limit for Total Suspended Residue. For of the five (5) subject violations of G.S. 143-215.1(a)(6) and NPDES Permit No. NC0034657, by discharging waste into the waters of the State in violation of permit monthly average effluent limit for Biochemical Oxygen Demand. For of the six (6) subject violations of G.S. 143-215.1(a)(6) and NPDES Permit No. NC0034657, by discharging waste into the waters of the State in violation of permit daily maximum effluent limit for Fecal Coliform. Catawba County Schools Page Five $ TOTAL CIVIL PENALTY, which is percent of the maximum penalty authorized by G.S. 143-215.6A. $ 238.63 Enforcement costs. $ TOTAL AMOUNT DUE Pursuant to G.S. 143-215.6A(c), in determining the amount of the penalty I have taken into account the Findings of Fact and Conclusions of Law and the factors set forth at G.S. 143B-282.1(b), which are: (1) The degree and extent of harm to the natural resources of the State, to the public health, or to private property resulting from the violations; (2) The duration and gravity of the violations; (3) The effect on ground or surface water quantity or quality or on air quality; (4) The cost of rectifying the damage; (5) The amount of money saved by noncompliance; (6) Whether the violations were committed willfully or intentionally; (7) The prior record of the violator in complying or failing to comply with programs over which the Environmental Management Commission has regulatory authority; and (8) The cost to the State of the enforcement procedures. The degree and extent of harm to the natural resources of the State, to the public health, or to private property resulting from the violations: There is no documented evidence to indicate harm; however, the Fecal Coliform violations exceed the levels necessary to protect human health. 2. The duration and gravity of the violations: During the twelve months for which data was reviewed, violations occurred in October, 1991 through September, 1992, excluding January and July, 1992. Four of the violations were Technical Review Criteria violations 3. The effect on ground or surface water quantity or quality or on air quality: It is unlikely that the violations would have an effect on either groundwater quality or quantity or air quality. No adverse impact has been documented. 4. The cost of rectifying the damage: No damage was documented as a result of the violations. 5. The amount of money saved by noncompliance: There is no evidence to suggest any monetary benefit was gained as a result of the noncompliance. 6. Whether the violations were committed willfully or intentionally: There is no evidence to suggest that the violations were either' willfully or intentionally committed. s Catawba County Schools Enforcement Case Assessment Factors Page two 7. The prior record of the violator in complying or failing to comply with programs over which the Environmental Management Commission has regulatory authority: There has been no previous enforcement actions for NPDES Permit limits violations; however, the facility has a history of NPDES Permit limits violations, and seven (7) Notice's of Violation (NOV'S) have been issued in the previous Twelve (12) Months. 8. The cost to the State of the enforcement procedures: 5 hours by the investigator for investigating = $ 68.35 and drafting report at.$13.67/hour 1 hour by Regional Water Quality Supervisor for review at $31.56/hour 1 hour by Regional Supervisor for review at $24.95/hour Central Office review and processing 1 hour for clerical support = $ 31.56 = $ 24.95 = $100.00 13.77 Total = $238.63 9. Type of violator and general nature of business (i.e. individual vs. large corporation): The violator is a public school system. 10. Violator's degree of cooperation (including efforts to prevent or restore) or recalcitrance: The School System has taken action which should result in the elimination of the discharge by connection to the City of Hickory. Connection should occur by January 31, 1993; however, since four of the school system's schools are already operating under an SOC, the current enforcement recommendation could have possibly been precluded by placing this school on an SOC schedule to eliminate the discharge.
