The 15-Day MYO/As-Built review for the Buffalo Creek Tributaries Mitigation Site (SAW-2018-00425) ended August 20,
2021. Per Section 332.8(o)(9) of the 2008 Mitigation Rule, this review followed the streamlined review process. All
comments received from the NCIRT are incorporated in the email below. Please address IRT concerns in the MY1 Report
and provide a response to comments. A site visit is not requested at this time. There were no objections to issuing the
initial 30% credit release of 1,226.550 warm SMUs and 1.037 riparian WMUs. Please find attached the current signed
ledger.
Was the drawing from the approved final mitigation plan used to show the red -lined changes? I noticed a few minor
differences, near the BMPs and crossings.
I also share the concern of potential future encroachment from the adjacent subdivision.
In future monitoring years please capture veg data (in a random plot) in areas where the old channel was filled
and wetland restoration is proposed.
DWR Comments, Erin Davis:
1. The CCPV figure and redline as -built drawing both show the FG-1 on R4 located outside of the channel. Please
confirm and accurately show this gauge location.
2. In the agency comments, the IRT asked for random veg plots along R5 and R6, which were not shown on the
CCPV. Please update accordingly.
3. Photos along R5 show a lot of large stone lining the channel. Was this stone size included in the approved design
plan? Based on the R5 reach drainage area is this armoring necessary?
4. Has the excess sediment shown in PS-2 Photo downstream of the MS-R2 culvert flushed through the project?
5. DWR appreciated the inclusion of the drone video. It was nice to see the effort made to minimize the
construction footprint and disturbance to surrounding mature trees.
USACE Comments, Casey Haywood:
1. Concur with DWR comments.

2. Appreciate the inclusion of the drone footage and photos of all monitoring devices.
3. The downstream photo of MS-R2 culvert appears to have significant amounts of sediment accumulation. Does
WLS have any concerns in this area or is the sediment being flushed out? Also, please note USACE expressed
sediment concerns on this reach in the MP comments and as a result WLS agreed to establish fixed photo points
along this reach to document stream channel characteristics. Please establish these fixed photo points in future
reports.

1 - For NCDMS, no credits are released during the first milestone (Site Establishment).
2 - For NCDMS projects, the initial credit release milestone occurs when the as -built report (baseline monitoring report) has been approved by the NCIRT and
posted to the NCDMS Portal, provided the following criteria are met:
1) Approval of Final Mitigation Plan;
2) Recordation of the preservation mechanism, as well as a title opinion acceptable to the USACE covering the property;
3) Completion of all physical and biological improvements to the mitigation site pursuant to the mitigation plan;
4) Receipt of necessary DA permit authorization or written DA approval for projects where DA permit issuance is not required.
3 - A 10% reserve of credits is to be held back until the bankful event performance standard has been met.
