Avoidance and Minimization 1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. SBEC was hired by the owner back in 2002 to delineate all jurisdictional waters and buffers. The project engineer and designers have taken every effort to work around these regulated features, and were successful in limiting their impacts to only 121 feet of intermittent stream and "allowable" uses within the buffer 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. The road was reduced in width at the location of the proposed crossing, retaining walls are proposed to allow for steeper fill slopes and reduced impacts. The alignment of the road is set by the existing intersection. Temporary erosion control measures will be installed around project boundaries to avoid and minimize any indirect impacts to remaining jurisdictional wetlands. Permanent stormwater best management practices (BMPs) will be used (e.g., stormwater wetlands), and approved by the Town of Cary, a DWQ certified local government 2. The site is currently accessible by Weston Parkway and is adjacent to Crabtree Lake. In a letter dated December 18, 2002, the Division of Water Quality confirmed the Neuse Riparian Buffer determination made by Soil & Environmental Consultants, Inc. at this property. Since that time a question has come up, based on field inspection of this property, regarding the streams that were labeled "F" and "G" in the 2002 Neuse Riparian Buffer determination. I concur with your assessment that the stream previously labeled as "G ", now labeled "F" on the attached map dated February 1, 2013, is the stream feature subject to the Neuse Riparian Buffer Rules starting at the pipe under Weston Parkway. The stream labeled "F'" is a remnant channel prior to the construction of Weston Parkway and is no longer transporting the flow of the stream channel. 'T is, therefore, not subject to the Neuse Riparian Buffer Rules. Stream "G" is located and flows into Stream "E" off property, south of Weston Parkway.
