Dear Mr. & Mrs. Cottle:
Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified. Please note that this permit references DEMLR as the Division responsible for issuance of the
permit.
The Wilmington Regional Office received a complete, modified Stormwater Management Permit
Application for the subject project on February 17, 2020. Staff review of the plans and specifications has
determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title
15A NCAC 211.1000 effective September 1, 1995. We are forwarding modified Permit No. SW8
990107, dated March 10, 2020, for the construction, operation and maintenance of the built -upon areas
and the stormwater collection system and/or vegetated conveyance system associated with the subject
project. Please replace the previous application (SWU-101) and permit with the attached modified
versions.
This permit shall be effective from the date of issuance until rescinded and shall be subject to the
conditions and limitations as specified therein, and does not supersede any other agency permit that may
be required. Please pay special attention to the permit conditions regarding the limitation of built -upon
area, modification of the project, the operation and maintenance of the Stormwater collection system
and/or vegetated conveyance system, and the procedures for changing ownership of and/or transferring
the permit. Please also pay attention to the permit conditions that requires the recordation of deed
restrictions, easements, and the maintenance agreement, which must all be provided along with
certification upon completion of the project. Failure to comply with these requirements will result in
future compliance problems.
The following modifications are included and covered by this permit:
This permit is being converted from a high density project with an onsite wet detention pond to a high
density project that drains to an offsite wet detention pond under master permit # SW8 990462.
Please note that the renewed, updated, and re -issued permit does not impose new or different terms; it
merely restates and clarifies some of the previous terms to provide you with a better understanding of
your obligations under the permit."

request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings
(OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes and
must be filed with the OAH within thirty (30) days of receipt of this permit. You should contact the OAH
with all questions regarding the filing fee (if a filing fee is required) and/or the details of the filing process

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina
as amended and other applicable Laws, Rules, and Regulations,
PERMISSION IS HEREBY GRANTED TO

FOR THE
construction of impervious areas with runoff to be treated in an offsite permitted stormwater
facility, in compliance with the provisions of Title 15A NCAC 2H .1000 (hereafter referred to as the
"stormwater rules') and the approved stormwater management plans, application, supplement,
specifications and other supporting data as attached and on file Division of Energy, Mineral and
Land Resources (the "Division" or "DEMLR") and considered an enforceable part of this permit.
The stormwater runoff from the site will be routed to wet detention pond #1 operated and
maintained by Eagle Investments, LLC under the terms and conditions set forth in the latest
version of Permit No. SW8 990462_
This permit shall be effective from the date of issuance until rescinded, and shall be subject to the
following specified conditions and limitations:
I. DESIGN STANDARDS
The runoff associated with this project has been approved to be discharged into a
stormwater management system permitted under the latest version of SW8 990462.
2. This project is comprised of Lot 3 and Lot A under Stormwater Management Permit No.
SW8 990462, which allocates a maximum of 89,299 square feet of built -upon area (BUA) to
Lot 3 and a maximum of 77,551 square feet of BUA to Lot A, for a total of 166,850 square
feet. This project proposes 59,979 square feet of BUA on Lot 3. The amount available for
future development is 106,871 square feet.
3. All stormwater conveyance and collection systems must be located in dedicated common
areas or recorded easements. The final plats for the project will be recorded showing all
required public rights -of -way, common areas and easements, in accordance with the
approved plans.
4. The runoff from the permitted built -upon area of this project must be collected and conveyed
to the permitted offsite stormwater BMP, Pond #1.

II. SCHEDULE OF COMPLIANCE
This permit is issued contingent on the construction of the permitted offsite stormwater BMP
being complete and in compliance with the conditions of permit number SW8 990462, issued
to Eagle Investments on December 2, 2005, as subsequently revised, modified, or renewed_
Prior to the construction of any built -upon area associated with this permit, Eagle
Investments shall have constructed, operated, maintained, and certified the offsite
stormwater management system in compliance with SW8 990462.
2. The permittee shall construct and maintain the proposed stormwater runoff conveyance and
collection system and the built -upon areas to the dimensions, elevations and grades as
shown on the approved plans.
3. This lot is limited to the amount of built -upon area specified in Section 1.2 of this permit, and
as reported on the application, the supporting calculations and as shown on the approved
plans. This maximum built -upon area was assigned to this lot(s) per the terms and
conditions of Stormwater Permit No. SW8 990462. If more than the maximum allowed
amount is proposed, a modification must be submitted and approved prior to construction.
4. During construction, erosion shall be kept to a minimum and any eroded areas of the system
will be repaired immediately. After construction the permittee shall maintain the grassed
areas, slopes and vegetated runoff conveyances on the lot in a densely vegetated state.
5. The permittee is responsible for keeping the stormwater collection system within the lot
property boundaries clear of trash, debris and sediment, and must control the sediment on
the lot in accordance with the requirements of the NC Erosion and Sediment Control Design
Manual. The permittee shall follow the minimum maintenance procedures and intervals for
the lot's built -upon areas and its stormwater collection / conveyance system as indicated in
the Operation and Maintenance agreement.
6. The permittee shall maintain and repair or replace any of the components of the lot's
stormwater collection and conveyance system such that the lot's runoff is captured and
adequately conveyed to the permitted BMP.
7. Upon completion of the permitted construction on this lot, and prior to occupancy of the
facility, the permittee shall submit to the Division the completed Designer's Certification
accompanied by an as -built survey of the project's built -upon areas and stormwater
collection / conveyance system.
8. No person or entity, including the permittee, shall alter any component of the approved
stormwater system shown on approved plans unless and until the Division has approved of
the revised plan.
9. The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, for any modification to the
approved plans, including, but not limited to, those listed below:
a. Any revision to the approved plans, regardless of size.
b. Project name change or transfer of ownership.
C. Redesign of or addition to the maximum approved amount of built -upon area.
d. Further development, subdivision, acquisition or sale of any, all or part of the project
area covered by this permit.
e. The construction of built -upon area within any future development area noted on the
approved plan.
f. Filing in, altering, or piping of any vegetative conveyance shown on approved plans.

10. The Director may determine that other revisions to the project should require a modification
to the permit.
11. The facilities shall be constructed, operated and maintained in accordance with the
provisions of this permit, the approved plans and specifications, and the supporting
documents attached to this permit and on file with the Division.
12_ The Director may notify the permittee when the permitted site does not meet one or more of
the minimum requirements of the permit. Within the time frame specified in the notice, the
permittee shall submit a written time schedule to the Director for modifying the site to meet
minimum requirements_ The permittee shall provide copies of revised plans and certification
in writing to the Director that the changes have been made.
III. GENERAL CONDITIONS
This permit is effective only with respect to the nature and volume of stormwater described in
the application, supplement, and other supporting data. Any other activities undertaken at
this site prior to receipt of the necessary permits or approvals to do so from any local, state
or federal government agency having jurisdiction, are considered violations of NCGS 143-
215.1, and subject to the enforcement procedures pursuant to NCGS 143-215.6.
2. Any individual or entity found to be in noncompliance with the provisions of this stormwater
management permit or the requirements of the Stormwater rules is subject to enforcement
procedures as set forth in NCGS 143 Article 21.
3. Current Permittee Name or Address Changes: The permittee shall submit a completed
"Permit Information Update Application Form" (available on the Division website) to the
Division within 30 days to making any one or more of the following changes:
a. A name change of the current permittee;
b. A name change of the project;
c. A mailing address change of the permittee;
4. Permit Transfer: This permit is not transferable to any person or entity except after notice to
and approval by the Director. The permittee shall submit a completed and signed "Permit
Transfer Application Form" (available on the Division website) accompanied by the required
fee and supporting documentation as listed on the form, to the Division at least 60 days prior
to any one or more of the following events:
a. The sale or conveyance of the project area in whole or in part, except in the case of an
individual lot sale that is made subject to the recorded deed restrictions and protective
covenants-
b. Dissolution of the partnership, corporate, or LLC entity, subject to NCGS 55-14-05 or
NCGS 57D-6-07 and 08;
c. Bankruptcy;
d. Foreclosure, subject to the requirements of Session Law 2013-121,
5. The approval of a permit transfer request will be considered on its merits and may or may
not be approved.
6. The permitteP is responsible for compliance with all permit conditions until such time as the
Division approves the transfer request. Neither the sale of the project, in whole or in part, nor
the conveyance of common area to a third party constitutes an approved transfer of the
stormwater permit.
7. Any person or entity found to be in noncompliance with the terms and conditions of this
stormwater management permit or the stormwater rules is subject to enforcement
procedures in accordance with North Carolina General Statute 143 Article 21.

8. The permittee grants permission for DEQ Staff to enter the property for the purpose of
inspecting all components of the permitted stormwater management facility.
9. The permit issued shall continue in force and effect until the permittee files a request with the
Division for a permit modification, transfer, renewal, or rescission; however, these actions do
not stay any permit conditions.
10_ Approved plans, application, supplement forms, calculations and specifications for this
project are incorporated by reference and are enforceable parts of the permit. A copy of this
permit, the approved plans and supporting documents shall be maintained on file by the
Permittee for the life of the project.
11. None of the development activities associated with the construction of this project shall
cause a wetland standard violation, a stream standard violation, or other water quality
violation. These violations are subject to civil penalties of up to $25,000.00 per violation per
day pursuant NCGS 143-215.6.

State Stormwater Management Permit #SW8 990462 for the subject project was last revised on June 10, 2013,
and the expiration date was extended to July 11, 2017, hence this permit expired on July 12, 2017. Per 15A
NCAC 2H.1045(3) (the stormwater rules), applications for permit renewals shall be submitted 180 days prior
to the expiration of a permit and must be accompanied by a processing fee, which is currently set at $505.00.
As this is still an active project, please complete and submit a renewal application immediately. The
renewal application can be found at the following website under the Applications Forms section:

I, the undersigned individual, do hereby make and acknowledge these Articles
of Incorporation for the purpose of forming a business corporation under the
laws of the State of North Carolina, as contained in Chapter 55 of the General
Statute of North Carolina, entitled "North Carolina Business Corporation Act",
and several amendments thereto, and to that end do hereby set forth:

NAME
The name of the Corporation is EAGLE INVESTMENTS OF FENDER,
II. PERIOD OF DURATION
The period of duration of the Corporation is perpetual.
III. CAPITAL STOCK
The Corporation shall have the authority to issue One Thousand (i,000) shares
of corporate stock without stated par value.
IV. MINIMUM CAPITAL
The minimum amount of consideration to be received by the Corporation for
its shares before it commences business is One Hundred Dollars ($ioo.00) in
cash or property of equivalent value.
INITIAL BOARD OF DIRECTORS
The number of Directors of the Corporation may be fixed by the By-laws but
shall not be less than two, except that so long as all shares of the Corporation are
owned by either one or two shareholders, the number may be fewer than two but

On August 5, 2009, the Governor signed Session Law 2009-406. This law impacts any
development approval issued by the Division of Water Quality under Article 21 of Chapter 143 of
the General Statutes, which is current and valid at any point between January 1, 2008, and
December 31, 2010. The law extends the effective period of any stormwater permit that was set
to expire during this time frame up to three (3) years from its current expiration date. On August
2, 2010, the Governor signed Session Law 2010-177, which granted an extra year for a total
extension of up to four (4) years.
The Division is hereby notifying you that the expiration date of permit number SW8 990462 has
been extended to July 11, 2017, which includes all the extensions. The remaining terms and
conditions of the permit issued on December 2, 2005 remain in full force and effect. Please
attach this cover letter to the previously issued permit. Please note that a permit renewal
application and fee must be submitted to the Division at least 180 days prior to the expiration
date of this permit.
