I misinterpreted the site remediation (grading and removing of impervious surfaces) as a potential activity that would
align with the NWP 38 however the proposed wetland impact (W1) to Wetland B is for upfront site grading to remove
historic floodplain fill to facilitate the re-establishment of a stream and wetland complex so I think it makes sense to
consider W1 for wetland re-establishment/relocation. Let me know if you need any further information. I'm in the field
today but will be checking emails periodically. I can plan to update the impact sheet with the NWP sought revision for
W1 and restate the impact acreage of W3 as <0.001 tomorrow if these updates work for everyone.

Thank you for the overall plan sheet for the subject project. Could you please provide more information regarding the
purpose and need for the proposed impacts to Wetland B, impact W1? The application states that the soil does not pose
a risk to human health or the environment, and the compounds found are commonly found in urban areas of North
Carolina. It seems as though this proposed activity involves grading and does not seem to meet the terms and conditions
of Nationwide Permit 38. The proposed activity may qualify for NWP 18, if the impacts are reduced and do not exceed
the 0.10-acre threshold. Additionally, compensatory mitigation would be required for impacts exceeding 0.10-acre (this
would not include impacts listed under NWP 27).
However, NWP 27 allows the relocation of non -tidal wetlands and streams on the project site provided there are net
increases in aquatic resource functions and services. Would you consider the proposed impacts at Wetland B a result of
wetland relocation?

Attached is an overall site plant sheet with itemized stream and wetland impacts. A table on the upper left of the sheet
summarizes each individual impact and the corresponding Nationwide (NWP) permit sought. Initially a NWP 3 was
requested for stream impact S1 (culvert extension) however it has been revised to a NWP 14. Currently NWP's 14, 27, &
38 are requested. The plan sheet addresses requested items 1 and 2.
For requested item 3, wetland impact (W3) is reported as less than 0.000 acres because it's below the 0.000 AC
reporting threshold.
Please let me know if you need any other information.

Thank you for your PCN and attached information, dated July 1, 2021, for the above referenced project. I have reviewed
the information and need clarification before proceeding with verifying the use of Nationwide Permits (NWPs) 38, 27,
14, and 3. Please submit the requested information below (via e-mail is fine) within 30 days of receipt of this
Notification, otherwise we may deny verification of the use of the Nationwide Permit or consider your application
withdrawn and close the file:
1) Please itemize stream and wetland impacts on the plan sheets; for example, S1 - permanent impacts due to culvert
installation. All proposed permanent and temporary impacts should be labeled on the plan sheets. Please ensure that
the labeling on the PCN matches the labeling on the plan sheets.
2) Please indicate which NWP you are requesting for each stream and wetland impact. For example, NWP 14 for impact
S1 — culvert extension.
3) Wetland Impact at Site W3 does not list an impact area in acres. Please list a valid acreage.
Please note that responses to the questions above may prompt additional information requests to allow full evaluation
of the proposed project.
