Dear Mr. and Ms. Rohde:
You have our approval, in accordance with the attached conditions, to place fill material in 2,536 square
feet of wetlands or waters for the purpose of installing riprap at 132 Edgewater Drive, as you described in your
application dated March 1997. After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Number 3112.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the
conditions listed in the attached certification. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Coastal Stormwater, Non - Discharge and Water Supply Watershed regulations. Also this approval will expire
when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

Site Description
The applicant owns a .46 acre lot in the Camden Point Shores Subdivision, Camden
County. The lot is located on Edgewater Drive (private) off Sailboat Road, SR 1163 and on
the Albemarle Sound. The lot is developed with a single family house and the lot elevation
varies from 3 feet to 0 at NWL. Soil types include sandy loam, coarse sand, and organic soils
which have a one inch silt sand layer. In April, 1994 the USA COE delineated 7,371 square
feet of the lot adjacent to the Albemarle Sound as 404 wetlands and the applicant was issued a.
NWP 18 to 611.4,356 square feet. The applicant filled 2,820 square feet of the wetland area
adjacent to the high ground area and constructed his house. The high ground area is 10,449
square feet in size and is vegetated with yard grasses.
A portion of the wetland area, adjacent to the Albemarle Sound, was covered with a
layer of coarse sand by the summer (`96) hurricanes. This layer is approximately 2 feet deep
and covers a triangular shaped area of approximately 1,600 square feet. * The remaining
wetland area is covered with a one inch layer of fine sand. Wetland vegetation includes bald
cypress (Taxodium distichum), sweet gum (Liquidambar sMaciflual and red maple (Ater
ru r m). There is no undergrowth. The applicant indicates this area was flooded during
both hurricanes and the shoreline was severely eroded. Several toppled trees line the shore.
The applicant indicates flood waters approached within 15 feet of his dwelling during both
hurricanes. Adjacent lots are undeveloped and appear to have similar natural characteristics.
Examination of rack lines on the adjacent lots verifies the applicant's assertion of flooding.
The Division of Environmental Management classified the waters of the Albemarle Sound in
the area as SB.
t Development Proposal
In order to stabilize his shoreline and protect his property, the applicant proposes to
construct a 5' x 160' rip rap system along his shoreline an average distance of 5 feet
waterward of NWL and a 5' x 40' rip rap system along his eastern property line starting at
NWL. A total of 200 feet of rip rap is proposed. The applicant proposes to fill 1,536 square
feet of 404 wetlands adjacent to the high ground area.
Anticipated Impacts
The proposed rip rap placement will result in the loss of 800 square feet of Public Trust
and Estuarine Waters and the filling of 200 square feet of 404 wetlands in the Estuarine
Shoreline Area of Environmental Concern. The proposed wetland fill will result in the loss of
1,536 square feet of 404 wetlands. Turbidity increases are to be expected during construction.
The project will stabilize the applicant's shoreline and help minimize the effects of flooding.

We are considering authorizing the proposed activity pursuant to
Section 404 of the Clean Water Act, and we have determined that a water
quality certification is required under the provisions of Section 401 of
the same law. A Department of the Army permit will not be granted until
the certification has been obtained or waived.
According to our administrative regulations, 60 days is reasonable
for State action. Therefore, if you have not acted on the request, or asked
for an extension of time, by April 26, 1997, the District Engineer will deem
that waiver has occurred.
