C. 28801-5006 SUBJECT: Pipe Replacement on New Alignment by Boring/Jacking Method and Stream Relocation, Main Street (Belmont), Gaston County Dear Mr. Lund: The North Carolina Deparhnent of Transportation request authorization for the replacement of a failed 140-foot pipe with a 140-foot 48"steel casing pipe bored on new alignment. The pipe placement on a new alignment will necessitate the construction/reconstruction of 100 feet of stream channel. Approximately 80 feet of the channel will be new channel and the remaining 20 feet will be reconstruction of the existing channel after the removal of a 77-foot temporary pipe. The temporary pipe was installed in the existing stream channel to provide an access and staging area for the boring/jacking procedure. The new channel dimensions are based upon a reference cross-section surveyed ~43 feet downstream of the site. The streambanks will be stabilized with coir fiber matting prior to turning water into the new channel. Temporary cofferdams and bypass pumping will be utilized to manage the stream during temporary pipe removal and stream channel reconstruction. Upon project completion, the channel disturbed by the staging area and temporary cofferdams will be restored to pre-project contours and all disturbed areas seeded and stabilized. The total scope of the work will result in 100 feet of stream relocation/restoration to an unnamed tributary to the Catawba River, which is classified as a WS-N & B watershed by the Division of Water Quality. The project site is located on an urban arterial; however, it is located > %i mile from the critical watershed area. Hazardous spill basins are not required. Enclosed is the hazardous spill basin checklist. This office has conducted a GIS and field survey for the project for historical sites and threatened/endangered species sites. No sites listed on the National Register of Historic Places are located in the vicinity of the project nor did there appear to be any eligible structures. The federally listed species for Gaston County (USFWS listed dated April 27, 2006) include Bald eagle (Haliaeetus leucocephalus), Schweinitz's sunflower (Helianthus schweinitzii), and Bog turtle (Glyptemys muhlenbergii). Natural Heritage Program records document the nearest Bald eagle location approximately 6.5 miles south of the proposed project area, on Lake Wylie at the North Carolina/South Carolina line. Bald eagles typically nest in tall, living trees near open water. The proposed project is located approximately 2.0 miles west of the upper portion of Lake Wylie. The project site is located in downtown Main Street, Belmont Page 2 June 29, 2007 Belmont. There is no suitable habitat in the surrounding area and no bald eagles were observed during the site visit; therefore, no impact on the species is anticipated. Natural Heritage Program records document the nearest Schweinitz's sunflower location approximately 4.7 miles northeast of the proposed project area (in Mecklenburg County). The sunflower is usually found in upland open areas protected from shade or excessive competition. Due to the site location in downtown Belmont, there is no potential habitat within the proposed project area and no species were observed during the site visit. No impact on the species is anticipated. Natural Heritage Program records document the nearest bog turtle location approximately 9.5 miles northwest of the proposed project area. Bog turtles are typically found in bogs, marshes, and wet pastures. There is no suitable habitat located within the project footprint. T/SA species are not subject to Section 7 consultation; however, no impact on this species is anticipated. NCDOT is recommending a finding of "no effect" for T&E species and historical structures. I have enclosed apre-construction notification for a NW#33 and NW#27, sketches of planned activities, and location maps relative to the project. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Provide photocopies of previously issued permits, certifications or other useful information. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USAGE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USAGE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o. enr.state.nc.us/ncwetlands/strmgide.html. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attacch directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. MITIGATION NOT ANTICIPATED 2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement Program (NCEEP). Sewage Disposal (required by DWQ) Clearly detail the ultimate treatment methods and disposition (non-discharge or discharge) of wastewater generated from the proposed project, or available capacity of the subject facility. No wastewater is generated from the project. XIII. Violations (required by DWQ) Is this site in violation of DWQ Wetland Rules (15A NCAC 2H .0500) or any Buffer Rules?
