I'd just have him check non -compliant and put an explanation of why on the DMR if it occurs. The 85% removal efficiency is a federal requirement so we cannot adjust it in the permit (except through the variance process). Those TSS values are low - and that's usually indicative of I/I problems (typical influent TSS values are similar to influent BOD5 - 200 to 220 mg/1). That would put him around 11 mg/1. Which he might not be able to obtain. I can imagine with industry leaving NC and particularly textiles we might see more of this concern arising. His question is whether he should report a DMR as noncompliant if they don't achieve 85% removal even if they meet final limits. What should I tell him?
