In response to the recent notice of violation & intent to assess civil penalty. We hope that you
will take into consideration the following findings and corrective actions we have taken.
In reference to the Ammonia violation, it was indeed reported that we were in violation of our permit.
Upon the discovery of this violation we quickly started looking for the source of the ammonia and how
we were going to deal with the situation. I called Mr. Brantley by phone and made him aware that we
were having an issue and my first plan of action. Which was to put an additional aeration basin online to
help air strip the ammonia, he agreed this was the best option. We then began looking for the source
which we strongly believe is a neighboring landfill that we receive leachate from. Sampling of the
leachate showed extremely high ammonia levels. So as a way to lower the ammonia levels coming in we
asked the landfill to start diluting there Toads. We also questioned the results we were getting in the
lab, so we replaced the lab meter with a brand new meter. Since doing so ammonia has not been an
issue. We also have taken the additional aeration basin offline and there still isn't any issue. So did we
actually have an ammonia problem or were we getting bad results from a faulty meter. We are still
uncertain, but in the event that we did hopefully the dilution of the incoming leachate will help the
matter as well.
As to the BOD violation, we strongly feel this was attributed to unusually low influent flows. We had an
unusually dry spring resulting in low plant flows, combined with the BOD concentrations coming in. This
was a combination that we believe resulted in the permit violation. We're hoping that the dilution of
the leachate we receive will also help this matter as well. We're still looking for further solutions to
assist with the possibility of future BOD issues.
We hope that you will take these findings and corrective measures into consideration and dismiss this
NOV and the possibility of any civil penalties that maybe associated with. Thank you for your time and
