I should note that I believe the name and ownership change form has been filled out by the N. C. Housing Foundation and returned to your office under separate cover. The Compliance Inspection Report required that we complete three actions: a) Mow the perimeter and slopes to a height not to exceed 6 inches: This has been done. In addition, we have entered into a contract with T &. J Landscaping to provide monthly maintenance. They will plant new grass around the pond as soon as weather permits. This is projected to be no later than October. b) Check the depth of the pond: This has been done and will be included in the continuing preventive maintenance program. c) Clean out the draw -down orifice and verify its diameter: This was done during the month of June by Roto Rooter. They verified that the draw -down orifice was clear and drainage effective. I am enclosing a memorandum from Kevin Hart to me, dated September 4ch, 2001, which presents more detail on each of the above items. I am. also enclosing some pictures he took of the work in progress in clearing out the banks of the pond. If you need anything further, please do not hesitate to contact me. This has reached growth in average of 3 feet in height and the backs around the pond were assessed. AA 1 a T & J Landscaping were contacted and a monthly Preventative maintenance plan was implemented to keep the banks at 6 inches in height until grass seed could be planted around Detention Pond. According to the landscaping company, the month of August is not the time to plant grass seed. During the month of June, the draw down orifice was checked by RotoRooter to demonstrate to the DFS construction survey team that the drain was functional. This was proven to be compliant and the drainage was effective. The trash guard will be cleaned and the debris removed on a regular basis by the landscaping company. While in Newport last week, I used a weed eater to trim the high growth so that the landscaper could actually get inside the fence to work. I looked up the compliance rules regarding this and found quite a bit of information. I thought you might like to read the highlighted areas - just in case you want to go into the pond business - or worse - speak the pond language. I took a number of pictures of the pond so that you could see what you are missing in person - everyone needs his or her own pond detention project. These pictures better illustrate the size and slope problems with getting a bush hog into the parameters, however, it can be done with a hand pushed hog and I feel sure that the landscapers will use one. The form was originally sent to Americare of Eastern Carolina, Inc., since they were the permit holders. We were notified by Mr. William Benton of Diversified Senior Services on March 7, 2001, that there was a new owner, and he provided your name and address. Project Name: Americare Retirement Facility (now Somerset Court of Newport) Project Number: SW8 930405 Control Measure: A Wet Detention Pond Water Body: Deep Creek Classification: C Directions to site, address: Off Market Street near the intersection with Church Street, in Newport, NC. 2. Inspection Date: December 12, 2000 Weather Conditions: Clear and Cool 3. Compliance Issues: a. The vegetation has grown up around the pond and trash and debris has not been picked up in quite a while. b. There are some areas around the pond where the slopes have sloughed into the pond. The sediment from these areas is causing the pond to fill in. The outlet structure is clogged with trash and debris. 4. Required Actions: a. Mow the perimeter and slopes of the pond and maintain a dense cover of grassed vegetation on the slopes that does not exceed 6 inches in height. Maintenance should be performed on a regular basis and trash and debris should be picked up and disposed of properly. b. Check the depth of the pond. If the average depth throughout the pond is 3.0' or less, please excavate to at least the design depth of 3.5 feet. Due to the age of the development and lack of maintenance, it is very likely that the pond will need excavation. The eroded areas along the slopes of the pond will need to be repaired and re -seeded or sodded. C. Please clean out the draw down orifice and verify that it is still has a diameter of 1-5/8 inch. Make sure the trash guard/rack is secure and kept clear from trash on a regular maintenance schedule. 5. Please complete a name/ownership change form and sign the enclosed operation and maintenance plan so that the permit can be transferred to the new owner. These eroded areas will only increase in size over time. C. The outlet structure is clogged with trash and debris. 4. Required Actions: a. Mow the perimeter and slopes of the pond and maintain a dense cover of grassed vegetation on the slopes that does not exceed 6 inches in height. Maintenance should be performed on a regular basis and trash and debris should be picked up and disposed of properly. b. Check the depth of the pond so that the measuring device does not readily penetrate the soft sediment laden bottom of the pond. If the average depth throughout the pond is 3.0 or less than the pond will need to be dredged out back to at least the design depth of 3.5 feet. Due to the age of the development and lack of maintenance on the pond it is very likely that the pond will need excavation. The eroded areas along the slopes of the pond will need to be repaired by packing fill material, soil, back in those areas and re -seeding or sodding. C. Please clean out the draw down orifice of debris and verify that it is still has a diameter of 1 5/8 inch. Make sure the trash guard/rack is secure and kept clear from trash on a regular maintenance schedule. 5. If you are no longer responsible for the maintenance of this project please respond in writing as to who now owns the property and please forward this letter to them so that they can come into compliance with the permit. The new owners along with you will have to fill out the enclosed permit ownership transfer form. The new owners will also have to sign a maintenance agreement so that they are fully aware of all the maintenance requirements that they will be expected to adhere to. The slopes are sloughing into the pond and are in need of stabilization. b. The outlet structure looks rickety. 4. PE Certification Received? 3/20/96 Deed Restrictions Received? N/A 5. Required Action: a. Regrade the slopes to 3:1 and stabilize with permanent grass cover. b. Please have the outlet structure repaired to the design specifications.
