confirmed on the phone with Josh Spiegel that the Swale and box are located within the drainage easement
as shown on the plans.
I will need two hard copies of the (2) signed, sealed plan sheets and a signed application for a minor
modification to the permit. I will work on this along with processing the transfer of the permit. However,
need the minor mod delivered by Friday, Aug. 13. Will that be possible for you?

All,
It appears that since the swale, inlet and pipe rear of lots 6-9 in Pond 2 on Boykin Spaniel Way was an addition that one
of the regulatory agencies asked to be installed.
We are going to draw it on the plan instead of require it to be added formally to the plans.
If NCDENR will accept this, a revised plan will not be required.
We are going to insist ALL the silt fence on the site be removed when everything's been stabilized, the erosion on the
pond slope be repaired and stabilized and any bare areas onsite gets stabilized.

If possible we also need velocity calculators for the roadway culvert coming into the site. As it was previously a pipe. We
asked the engineer for this a LONG time ago, when you were actually onsite with us, but haven't received anything.
And the outlet pipe in pond 3 is different than our plan. See 6/17/21 report where we requested revised plans and
email from 6/17/21 that states the engineer is not aware of the changes we requested. I realize this isn't your job and
that you may not be able to do all this!

We want plans that show where everything is on the project.

In the event we or the HOA needs to locate something underground later. Or even a pipe size.
It's been difficult to get them from this designer.
We have asked before for the culvert change at the entrance (which was a pipe) and still haven't gotten anything.
No, we don't get certifications for erosion control.
If you could help get the silt fences removed we would appreciate it.

Concerning the plan revision, is it a requirement of your ordinance and general statutes that the drainage
features must match the approved plans? Do you check for an engineer's certification?
It is a requirement for DEQ that it is built in accordance with the plans. However, the engineer can certify the
project with notes that a certain area has been altered to improve drainage, or that the Swale is located
differently, etc. If the change is substantial, we will require a plan revision.
Concerning your question about getting the silt fence removed. Our Manual says the following:
"All temporary structures should be removed after the area above has been properly stabilized."

I have attached our last report. I am not aware we have done another inspection.
Beth Furr will be able to tell you when she plans to go back out. She may be waiting to hear the repairs have been made.
And it does not appear we have received any new plans. We have requested them but haven't gotten anything that I am
aware of. If you have revised plans please forward them to us.
Please also let us know if you have been able to get all the silt fence removed. If you can consider it trash on the site.
As our ordinance and general statutes do not require removal of erosion control measures, as far as I am aware. But I
believe NPDES does.

should have sent you a copy.
They are looking for a revised plan so I guess that's the best way to go. They don't check for engineer
certifications.

In any event here it is.
The developer did mentioned some of the property owners have done some work in the rear of their property adjacent
to the pond on Boykin Spaniel Way. I will forward email correspondence from him too.
ALL,
called Mr. Bagley. He lives at 7336 Brittnay Pointer Court. He said there were some bare areas with weeds adjacent to
his cul-de-sac that need to be stabilized. He mentioned he would forward pictures of other areas too. He says the silt
fence is considered trash and definitely has to be removed, according to the Sediment Pollution Control Act. Because its
contaminating the wetlands.
We have told the developer to remove it.
We may not be able to enforce it. Unless there is a General Statute requiring it. That I am not aware of.
Brian can you consider it trash according to NCG01 and get it removed?
Beth please look into the bare areas he's mentioned.

repaired areas. Have they installed a pipe and dug through ali of the stabilization at the back of some lots?

Thank you for informing this office of the problems with the neighborhood. We will try to fix issues that are in our
control as best we can.
As discussed, there are at least three permits that can be applied to the issues in the subdivision.
There is an erosion & sediment control permit issued by New Hanover County. The county is represented by Beth
Wetherill and Beth Furr, attached. They will contact you as soon as possible. There must be permanent groundcover
established. The rules are unclear on removal of measures.
In conjunction with the E&SC permit is the NPDES NCGO10000 Construction Stormwater Permit. This deals with the
E&SC but also potential pollutants. If fencing is left behind, it may be considered a pollutant, but the permit is not
typically applied in that manner, but we can try.
The third permit is the State Stormwater Permit, SW8160216. The transfer application just came in and has been
assigned to Steve Pusey. This permit will check the permanent Stormwater measures in the subdivision, including
swales, ponds, pipes. The review will ensure that the measures are installed per permit and are in compliance before
transfer to the HOA.
I will call Mr. Sears and hopefully get the fencing removed and GC established.

LGI Builders just recently completed developing every house in the neighborhood a few months ago. They have
left an orang silt fence all around and in the wetlands that encompass our neighborhood. The common areas
were never permanently covered with sod, leaving the soil to wash into our streets and drains. Weeds have
begun to grow in those areas. I have read the Pollution Control Act of 1973 which states these matters should
have been addressed.
I understand this is the enforcement agency and would like the developers to pick up their leftover garbage as
they are refusing to give it any attention and pointing the finger elsewhere. This is our home and our land now,
we want it taken care of.
The neighborhood is Cameron Trace off Murrayville rd, my number is 910-742-8929. Keith Sears is the project
manager for LGI, his number is 919-795-3922.
I believe LGI will be turning over the HOA ownership here on the 15th and would like this matter documented
as they should be the ones responsible for this trash cleanup on our lands.

Bit of a revision to the plan after some discussions.
Our plan now is to connect the existing pipe with a 2'x2' concrete knockout box and grate. Attached are the cut
sheets. The contractor will install the grate horizontally, and match the invert of the swale.

In response to your inquiry on the pipe and installing a grate, my recommendation would be to attach an ADS inline
drain to the 12" HDPE with a 24"x24" grate, similar to that attached, and then raise the depression about 18" or so to
assist in the prevention of clogging.

On wet pond #2, the new swale that was graded in the back yards drains to a low place with a pipe. For
function and safety, this low place should have a yard inlet box with grate on top. This will prevent it from
becoming clogged. See pic 6344 attached.
This low area and pipe was basically installed as a temporary control measure and is now becoming a
permanent measure, so it needs some fine tuning. There are many issues with this hole, the biggest being
that it is so steep and it will trap sediment. I think it needs a more permanent structure made of concrete or
HDPE. Not sure if Nyoplast will work. I defer to Joe Boyd for the design of this structure. I should require a
plan revision but I'm going to let that slide.
Joe, can you provide some details for me to review, such as a cut sheet, dimension drawing, etc.?

be done.
Please reference the items below:
1. There was still some erosion on the western side of storage pond #3, especially on side with houses
where the emergency spillway is located. It eroded during the last storm we had. Some sediment has
made it into the pond. Therefore, this will need to be re -graded again and I recommend putting some
sturdy geotextile fabric down for erosion control. See pics 63354, 6336, and 6337 attached.

2. On wet pond #1, the outlet structure orifice pipe did not have a turn -down section /orifice assembly. It
looks like it was knocked off with a rock. See pic 6327 attached. Understood and will address.
3. On wet pond #2, the new swale that was graded in the back yards drains to a low place with a
pipe. For function and safety, this low place should have a yard inlet box with grate on top. This will
prevent it from becoming clogged. See pic 6344 attached. I don't understand this, as this was never
discussed as an option for repair. This particular section of pipe has been functioning with no incident
since it was installed by the former developer. Are we simply talking about a nyloplast basin with
landscape grate? It's also possible to grate the end of the pipe so that we minimize the impact to the
surrounding area that is currently establishing?
Let me know so we can fix asap. We need to be able to review these repairs in a timely manner after work is
completed.

Dear Mr. Pusey:
We received your request for more information for the above referenced project on February 25, 2021 and
have addressed your comments. Thank you again for granting an extension to full address your comments
and concerns. Please see below for our responses to your comments. For clarity, your comments area
stated first and followed by our responses in bold.
The pond skimmer is still attached to the eastern side, bypass storage, pond outlet structure #3. Is
this pond still under construction? It appears that there is erosion and some sloughing off of side
slopes on this pond, which will need to be repaired and stabilized. Trash needs to be cleaned
around and on top of the outlet structure grate.
► The pond is not under construction and the skimmer has now been removed. The side slopes have
been repaired and stabilized, and the trash has been removed.
2. There was extreme erosion on the western side storage pond, especially on side with houses. The
sediment will need to be removed from the pond and side slopes need to be restored and stabilized.
The sediment has been removed from the pond, the banks have been regraded and stabilized.
3. Sediment needs to be removed from the drainage easement near Road C. This easement runs
between Flushing Drive and Road D on the plans. Side slopes in this easement need more
stabilization on both sides of Road C.
The sediment has been removed, the side slopes on the easements have been regraded and
stabilized.
4. On wet detention pond #1, the following is required:
a. additional grass needs to be planted in area of emergency overflow and adjacent the outlet
structure.
Additional grass has been planted as requested.
b. Grass / earth on the outlet ditch side of pond berm extended up about 2' higher than the
top of the berm. This grading will need to be smoothed out and it will need to be re -
stabilized.
The area has been smoothed out and stabilized.

6. There are two (2) long, closed -end ditches, filled with water, running adjacent the offsite flow bypass

these ditches, and they may become a mosquito hazard. Please advise if these will be filled in.
These ditches are not proposed to be filled, the design of the subdivision called for them to be left
open, as at the time they were considered jurisdictional by the Army Corp.

Yep. I got your email. I just wanted to finish up on your other project, Southwater Village, first.
Basically, I am in agreement with your resolution for the drainage pipes in back yard near Pond 2, with one
pipe going to the forebay.
discussed the ditches in the project with the Stormwater Supervisor and we are okay with you leaving them
in place. In the future, if we start getting questions and concerns about the wetland ditches, then we will
direct those individuals to discuss the situation with DWR / the Army Corps for their options and a possible
solution, and/or we will direct them to the county who could handle it as a drainage or flooding project if
needed.

Good morning Steven. I spoke to TCC and they feel we can do away with the drainage pipe that does not go to the
forebay. The water can be shifted towards the forebay pipe which will drain the area adequately. The last item is
confirmation that we are leaving the open ditches per the plans as they are not covered by the wetlands permit and
were installed, noted on the plans and approved as intended. We need to start the repair work asap so please confirm.

and proposed permittees have requested to transfer the permit in accordance with 15A NCAC 02H.1045(1)(a). A
preliminary in-depth review of the documentation submitted with the transfer request has determined that the
application is incomplete and additional information is needed.
Since the transfer was submitted under NCAC 02H.I045(1)(a) and the proposed permittee did not select the
option in Section F of the application form where they agree to be the entity responsible for addressing any
compliance issues, the project must be found in compliance with the permit prior to approving the transfer.
Alternately, you may select the option in Section F of the application form where the proposed permittee agrees to
be the entity responsible for addressing any compliance issues. To continue the review and processing of this
transfer request, please provide the following documentation in a single, hard copy submittal package to
complete the application and demonstrate compliance with the permit:
Compliance with the Permit
On February 24, 2021, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources
(DEMLR) inspected the subject project to determine the status of compliance with this permit, last issued on
March 10, 2016. DEMLR file review and site inspection revealed that the site is NOT in compliance with the
terms and conditions of this permit. A copy of the completed form entitled "Compliance Inspection Report"
summarizing the findings of the recent inspection is attached to this letter. Please either address the following
items to demonstrate compliance with the permit or submit a plan of action that provides a timeline in which the
following compliance issues will be resolved. If the proposed permittee would like to accept responsibility for
resolving these items, please submit a new Section F of the application with that option selected.

As indicated in the attached inspection report, the following deficiencies must be resolved:
1. The pond skimmer is still attached to the eastern side, bypass storage, pond outlet structure #3. Is this
pond still under construction? It appears that there is erosion and some sloughing off of side slopes on this
pond, which will need to be repaired and stabilized. Trash needs to be cleaned around and on top of the
outlet structure grate.
2. There was extreme erosion on the western side storage pond, especially on side with houses. The
sediment will need to be removed from the pond and side slopes need to be restored and stabilized.
3. Sediment needs to be removed from the drainage easement near Road C. This easement runs between
Flushing Drive and Road D on the plans. Side slopes in this easement need more stabilization on both
sides of Road C.
4. On wet detention pond #1, the following is required:
a) additional grass needs to be planted in area of emergency overflow and adjacent the outlet structure.
b) Grass / earth on the outlet ditch side of pond berm extended up about 2' higher than the top of the berm.
This grading will need to be smoothed out and it will need to be re -stabilized.
c) The outlet structure orifice pipe did not have a turn -down section or orifice assembly.
d) Additional grass needs to be established on the western side of the pond.
e) Erosion needs repair and additional grass established on the southeast corner of the forebay.
On Wet Detention Pond #2, the following is required:
a) Erosion needs to be repaired and re -seeded at the northeast corner of the forebay.
b) There were two (2) outlet structures with erosion control protection in the back yards adjacent the
pond. These outlets are not shown on the plans, so I assume they are temporary measures that need to be
removed. Please advise.
c) The outlet structure orifice pipe did not have a tum-down section or orifice assembly.
6. There are two (2) long, closed -end ditches, filled with water, running adjacent the offsite flow bypass line
from Road B, all the way to the storage basin. There does not appear to be any function for these ditches,
and they may become a mosquito hazard. Please advise if these will be filled in.
All of the requested information listed above should be received in this Office by March 25, 2021, or the
application will be returned as incomplete. If additional time is needed to submit the requested information,
please email your extension request prior to this due date to the email address provided below with a justification
and a date of when the requested information will be submitted, which shall be no later than 15 days past the
original due date. Please note that only two letters requesting additional information is allowed in the State
Stormwater Program for a total of 30 days to submit the requested additional information. The Division is
allowed 90 days from the receipt of a complete application to transfer the permit. If the information is not
satisfactorily provided after either the second request or 30 days, the project will be returned. If the project is
returned and you wish to re -submit later, you will need to resubmit all required items at that time, including the
application fee.
Please note that if, upon review of the submitted information or upon a deficient compliance inspection of the
project, it is determined that a mmaior modification to the permit is required to resolve the compliance issues, the
transfer application will be returned as incomplete. Upon the issuance of the modified permit, and the successful
completion of any work required by the modified permit and/or the restoration of the site to design condition, the
applicant will need to submit an updated transfer application and a new fee to the Division to start the transfer
process over again.

Please remember that the permittee is responsible for complying with the terms and conditions of the permit and
the approved plans and specifications until the Division approves the transfer request.
Failure to provide the requested information, or to respond to this letter with a plan of action, including a timeline
to resolve the identified deficiencies, by March 25, 2021, are considered violations of the permit. if the requested
information is not submitted to this office by the due date, then DEMLR staff will re -inspect the site and may
issue a Notice of Violation. Please also note that any individual or entity found to be in noncompliance with the
provisions of a stormwater management permit or the stormwater rules is subject to enforcement action as set
forth in NCGS 143 Article 21, including the assessment of civil penalties of up to $25,000 per day.

After this application is accepted, DEMLR will conduct a compliance inspection and report any deficiencies to the
current permittee and/or the proposed permittee. Per the state stormwater rules and the state stormwater permit
conditions, the permit shall not be transferred until:
1. the current permittee resolves all non-compliance issues identified in the inspection report,
2. the current permittee negotiates a resolution with the proposed permittee (in writing and signed by both
entities. The negotiated resolution must identify the necessary actions, the responsible party(ies), and the
timelines to correct the deficiencies. The site must either be found in compliance or a copy of the
negotiated resolution must be submitted prior to the transfer of the permit.); or
3. in the case where a transfer falls under G. S. 143-214.7fc2) (see also SL 2011-256), the proposed
permittee resolves all non-compliance issues upon acquiring the permit.
Signature requirements for the named signing official (for current and proposed permittee) must meet the following:
• Corporation - a principal executive officer of at least the level of vice-president;
• Limited Liability Company (LLC) - the designated manager, (Documentation from the NC Secretary of
State or other official documentation must be provided that states the titles and positions held by the
person who signed the application (pursuant to 02H.1040) that shows they have legal authority to sign for
the LLC)
• Municipality -a ranking official or duly authorized employee,
• Partnership or limited partnership - the general partner,
• Sole proprietor;
• The signature of the consultant or other agent shall be accepted on this permit transfer application only if
accompanied by a letter of authorization signed by one of the signatories noted in a-e above, as

Dear Ms. Hall:
Please see attached for the documents to transfer the existing stormwater permit to new
ownership for the above -mentioned project. There are no changes proposed to the plan and the
new permittee intends to follow the previously approved plans
As a part of the permit transfer we performed an inspection of the permitted BMP's and
attached is the report from that inspection. The deficiencies noted in the report have been
corrected from a recent inspection and therefore we are providing an updated stormwater
certification for the project.
Do note that permittee that this permit is being transferred to is the Homeowners Association
for the project, and that some of the homes within the project are still being constructed. Due to
that, the home builder (LGI Homes - NC, LLC) has signed the deed restrictions form for the
project. We have also attached a typical plot plan for the project to show that the 4,000 sf BUA
maximum is not being violated.
With this letter, please see attached for the stormwater permit ownership transfer form (1
original & 1 copy), new signed Operation and Maintenance Agreement & Deed Restrictions (1
original & 1 copy), a $505 review fees, current recorded deed, BMP Inspection Report &
Certification, and CD with all files in pdf format.

CONSTRUCTION NOTES/OBSERVATIONS
Wet Detention Pond #1(WP #11 Observations:
• NOTE: All depth measurements for WP #1 have taken into account the 3.5" above normal pool.
• Per the plans the outlet pipes should be set with the same invert elevation as the normal pool orifice; however, they appear to be set -6.5" higher
o This being the case, the inverts of the discharge pipes are what control the normal pool.
• At the time of WRs site visit the water level was -3.5 inches above the outlet pipe invert and -6.5" above the normal pool orifice invert
• At the time of WRs inspection water level was approximately 6.5" above the normal pool control.
• The banks of the device are approximately 70% stabilized.
o Minor areas of erosion can be found throughout the interior slopes of the device.
o Several areas of more severe erosion were also noted on the eastern bank. (See Frame No. 4)
• The inflow point was not observable due to water level; however, via probing, WR was able to determine that the
riprap dissipator is present and in
general accordance with the plans.
• The average forebay depth was found to be -7' 6.5".
• The forebay dam appeared to be in good condition and observed to be covered in riprap.
o The northwestern portion of the forebay dam was observed to be -3.7" deep.

o The southeastern portion of the forebay dam was above the current water level.

• At the time of WRs site visit the water level was -1.75" above the riser crest, -12" above the invert of the outlet pipes, and -13" above the invert of
the normal pool orifice.
• WR was unable to locate the inflow point due to water level.
o During probing, no riprap or evidence of the inflow point was detected.
• The banks appeared to be -85% stabilized.
• One area of erosion was noted.
There is a swale which enters the pond from the northeast carrying drainage from the adjacent building lots.
It appears that sediment from the building lots is entering the pond in this area.
■ Currently there are no erosion control measures in place stopping sediment from the adjacent building lots from flowing into the
device.
o Additionally, the bank in this area is eroding.
• Average depth of the forebay was -7'.
• The forebay dam appeared to be in good condition and was observed to be covered in riprap.
o Average depth was found to be -6.25" deep
• The average depth of the main pool was observed to be -8'
• The outlet structure was submerged.
o Discharge pipes appeared to be in good condition.
• The riprap discharge dissipator was overgrown with aquatic plants and cattails which are restricting flow.
• The littoral shelf appeared to be in fair condition.
• The emergency spillway was in good condition.
• Skimmer is attached.
o Vegetation growing out of skimmer.
