Yes, a decrease in BUA would qualify as a minor modification. This would allow the minor modification form to be use
along with a narrative or table describing the changes to the numbers. Some prefer the full application as it already
provides the table summarizing the changes. The choice is yours.
I'm not sure what you mean by "since there was no original application". This permit was modified in 2012 and an
application should have been provided at that time. Additionally, this permit, SW8890306, expired on March 2, 2018. 1
have attached a copy of the latest permit as well as a copy of the renewal request that was recently sent out. Before
any modification can be submitted, the permit will need to be renewed and brought back to an active status.

Since the BUA area is decreasing, would we submit as a Minor Modification?
Since there was no origin] application form, would we need to fill out the standard Application Form, or just
fill out the Minor Modification Application Form, and explain that the BUA will be less?
It is such an old plan and permit (1989), I'm not quite sure exactly what needs to be done, or how it will be
permitted.

We have designed a Starbucks at Piney Green Shopping Center. The proposed building and
parking will be in an area that is a paved parking lot. See attached original Grading Plan. The
original parking lot and K-Mart was designed and permitted in 1989, Stormwater Permit No.
890306. Our Company designed and permitted the project. I think it was the first Stormwater
Pond that I designed. I could not find an application form in our files, (I guess there wasn't an
application form in the beginning), but I did find the Calculations and the Permit. (See attached).
We submitted Starbucks Plans to City of Jacksonville for Site Plan Approval and they say that
we need to modify the Stormwater Permit. We explained to them that the impervious area will
be less than the permitted, because we are adding a lot of landscaped islands, so it will be okay.
From the attached Pond Calculations, the pond was sized for 1 " of runoff from 8.66 acres. From
the attached Proposed Built -Upon Area Map, that we created using multiple sources, there is
only about 353,971 SF (8.13 Ac.) of impervious area that will flow to the pond once Starbucks is
built.
Please let us know if we have to modify the permit or if we can just provide a map showing that
the proposed Built -Upon Area is less than the permitted Built Upon Area.

I was wrong — the new MDC for wet ponds below still require a shelf, but it's only 6 feet wide and has a 6:1
slope vs. the 2008 requirement to be 10 feet wide with a 10:1 slope.
Also, that old pond at Piney Green probably doesn't have a forebay, either. If you expand the pond, you'll need
to add a forebay at each pipe entrance.
Also, these rules are not yet published to our website, but they should be available after the new year. If you

15A NCAC 2H .1053 MDC FOR WET PONDS
The purpose of this Rule is to set forth the design requirements for wet ponds that are constructed to meet the
requirements of this Section.
(1) MAIN POOL SURFACE AREA AND VOLUME. The main pool of the wet pond shall be sized
using either:
(a) the Hydraulic Retention Time (HRT) Method; or
(b) the SA/DA and Average Depth Method.
(2) MAIN POOL DEPTH. The average depth of the main pool shall be three to eight feet below the
permanent pool elevation. The applicant shall have the option of excluding the submerged
portion of the vegetated shelf from the calculation of average depth.
(3) SEDIMENT STORAGE. The forebay and main pool shall have a minimum sediment storage depth
of six inches.
(4) LOCATION OF INLET(S) AND OUTLET. The inlet(s) and outlet shall be located in a manner
that avoids short circuiting.
(5) FOREBAY. A forebay that meets the following specifications shall be included;
(a) Forebay volume shall be 15 to 20 percent of the volume in the main pool;
(b) The forebay entrance shall be deeper than the forebay exit;
(c) The water flowing over or through the structure that separates the forebay from the main
pool shall flow at a nonerosive velocity; and
(d) If sediment accumulates in the forebay in a manner that reduces its depth to less
than 75 percent of its design depth, then the forebay shall be cleaned out and returned to
its design state.
(6) VEGETATED SHELF. The math pool shall be egWpped with a vegetative shelf am nd its
perimeter. The minimum width of the vegetvWdsheff sha1l be six feet and the skTo shall be no
steeperthan.61 (horizont6l to v eal).
(7) DRAWDOWN TIME. The design volume shall draw down to the permanent pool level
between two and five days.
(8) PROTECTION OF THE RECEIVING STREAM. The wet pond shall discharge the runoff from
the one-year, 24-hour storm in a manner that minimizes hydrologic impacts to the receiving channel.
(9) FOUNTAINS. If fountains are proposed, then documentation shall be provided that they will not cause
a resuspension of sediment within the pond, or cause erosion on the side slopes of the pond.
(10) TRASH RACK. A trash rack or other device shall be provided to prevent large debris from entering
the outlet system.
(11) VEGETATION. The following criteria apply to vegetation in and around the wet pond:
(a) The dam structure, including front and back embankment slopes of the pond shall be vegetated with
non -clumping turf grass: trees and woody shrubs shall not be allowed: and
(b) The vegetated sheN shall be planted with'a minimum of three diverse species of herbaceous, native
vegetation, at a mimmum density of 50 plants per 200 square feet of shelf area.

Request for Scoping Meeting Narrative
The purpose of the requested scoping meeting is to verify the manner in which
stormwater management needs to be designed for the proposed new "Piney Green
Development" project.
This project will consist of commercial retail development plus light industrial storage
buildings on a 5.88 Acre tract of land which lies in the northwest quadrant of the
intersection of Piney Green Road and Evergreen Ave. in Jacksonville, N.C.( the address of
this proposed development is 2774 Piney Green Road). The project will be designed such
that it does not exceed 85% impervious percentage ( therefore there will be 5 Acres of
impervious area on the 5.88 Acre tract).
The proposed 5.88 Acre tract adjoins the existing wet pond for Piney Green Shopping
Center ( Permit # SW8 890306) on its western property line ( see attached preliminary
site plan plus a current survey of the 5.88 Acre tract).
The developer wishes t0 add this new drainage area to the existing Piney Green pond in
the same manner as the Glade Lane Development was added with a permit modification
which was approved on June 18, 2012. The Glade lane development area was added by
assuring that adequate storage existed in the pond to accommodate an additional
volume of 1.5 inches for temporary storage and the surface area was checked using the
same rules as were used to originally approve the pond. The developer wishes to modify

the pond again to add the proposed 5.88 Acre tract while using the same procedure as
was followed in the Glade Lane modification.
We have attached a preliminary design for the pond modification that the developer
desires to provide to provide additional treatment and temporary volume storage for the
new development.
The new Piney Green Development will be in the White Oak River basin with tributary to
Mott Creek/Wol;02 19-15-3 ( class "CNSW").
Please verify when we might meet with you to discuss the particulars as to how and if this
approach to expanding and modifying the existing pond Wil be acceptable.

Chris Bailey and I would like to have a scoping meeting with Linda Lewis concerning the modification of Piney Green
Shopping Center Stormwater Pond by increasing the amount of drainage area and BUA flowing to the pond. The existing
pond Permit number is SW8 890306. 1 am attaching a current copy of the survey of the 5.88AC area that is being
proposed to add to the pond. Also I am attaching a preliminary site plan for the proposed new development on the
5.88AC tract. We would like to connect the new pond area for the new development to the existing Piney Green pond in
order to have only one outlet location. We would like to get clear on how this concept would be viewed by Linda and
