A copy of the Compliance Inspection Report is enclosed for your review. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater General Permit NCG030000 under Certificate of Coverage NCG030653. Permit coverage authorizes the discharge of stormwater from the facility to receiving waters designated as UT to Marks Creek, a Class C water in the Yadkin -Pee Dee River Basin. As a result of the inspection, the facility was found to be in compliance with the conditions of the NCG030000 permit. Please refer to the enclosed Compliance Inspection Report for additional comments and observations made'during the inspection. Please be advised that violations of the NPDES Stormwater General Permit are subject to a civil penalty assessment of up to $25,000 per day, per violation. DAVIS Director On January 5, 2017, the Fayetteville Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR) received a letter dated January 4, 2017 from Ms. Karen Adams, Manager Environmental Programs, requesting regulatory relief from monthly monitoring due to exceedances of the benchmark values for copper and zinc at outfall 001. Please keep in mind that benchmark exceedances are NOT limit violations or violations of permit conditions; however, you are obligated to follow the tiered response actions outlined in your permit. The letter states that monthly monitoring commenced in January 2016 per the Tier Two conditions of General Permit NCG030000. The letter summarizes that stormwater samples were collected in April, May and June from roof downspouts to determine if the higher zinc concentrations were from the metal roofs of. the buildings. Also, that in -the interim period fabric filters were installed in the stormwater inlets to minimize metals concentrations and a stormwater pond was installed to precipitate metals prior to any discharges. According to the letter, the size of the pond'is such that stormwater discharge off the property will not occur unless there is a significant rain event. In a subsequent letter from Ms. Adams, dated January 6, 2017, the monitoring results from the stormwater samples collected from the roof downspouts in April, May and June indicate that zinc concentrations were significantly higher at the downspouts than stormwater discharge at outfall 001. Monitoring results for copper concentrations indicate higher values at the outfall than the downspouts, however this could be attributed to naturally occurring copper in the soil surrounding the facility unless the facility utilizes copper in the manufacturing process. . Based on the results of the additional sampling at the roof downspouts along with the installation of the stormwater pond to reduce, if not eliminate, stormwater discharges from the property, we are granting regulatory relief in the form of a collapsed Tier 2 - Tier 3 response. Upon receipt of this letter, CSX Transportation, Inc. may resume the permit specified semi-annual analytical monitoring at the Hamtet . Turnout Facility for the remainder of the current permit term. You may recall in late 2015 and into 2016, CSX Transportation — Hamlet Turnout yard experienced problems meeting the benchmark permit limits and started the "Pier 3 process. Monthly monitoring commenced in January 2016 due to results above the benchmark limits for two consecutive monitoring periods. Based on sampling results and industrial activity at the yard, we determined that the higher zinc concentrations were from the metal roof. in April, May, and June samples were collected from the roof downspouts. In the interim, fabric filters were installed in the stormwater inlets and this minimized metals concentration. CSXT installed a pond to precipitate the metals prior to discharge. Based on the size of the pond, we do not believe this yard will discharge unless there is a significant rainfall event. i CSXT respectfully requests that we resume semiannual sampling commencing in January 2017. CSXT will submit semiannual monitoring reports`in July and January. If there is a discharge, samples will be collected semiannually. Just to confirm, since the facility is covered under a general industrial stormwater permit (NCGo30000) and the site is not located in an area that requires post -construction stormwater control measures to meet specific design parameters, ai formal review and approval for the pond by our office is not required. However, if the land disturbance associated with the installation of the pond will exceed one acre, then an erosion control plan will need to be submitted to our office for review and approval prior to the work starting. Also, the detailed site map for the facility as required by the conditions of the general industrial stormwater permit will need to be revised along with any descriptions or narratives regarding stormwater management as contained in the facility's site -specific Stormwater Pollution Prevention Plan. As far as the preliminary design of the pond, I do have a few questions/concerns, which I've listed below. -1 have concerns about the location of the existing sanitary sewer line, which would bisect the proposed pond and cross the bypass ditch. Has the local utility department been made aware of this proposal? Are they OK with it? Response: Yes the sanitary sewer line is owned by the Town of Hamlet. We have been in discussions with Ernie Billingsly who handles the sanitary sewer collection system for the town, Mr. Billingsly indicated he did not see any issues with the proposed pond construction. Will there be procedures in place in the event there's a sewer overflow at one of the manholes or repair work is needed on the sewer line? Response: The basin has been designed to hold a 10 year storm. Given the rarity of these events, at any given time there should be extra storage capacity in the pond, so if a sewer overflow would occur from one of the two manhole covers, the basin would serve as a containment area. As I had mentioned, CSX Transportation is looking to add a pond on the south end of the facility to handle storm water. Also as discussed, I am sending you (attached) the preliminary design of the pond layout. Currently, storm water enters a ditch on the south end of the facility via one of two outfalls (Outfall #1 and #2). The current plan is to initially create a new bypass ditch on the west side of the site to handle separately offsite storm water. The pond would then be constructed to take water from Outfall #1 and 42. A future outfall would be installed on the pond south end to tie into the new bypass ditch. Water would leave the site through the existing discharge structure that passes beneath the track, which would remain unchanged. From our discussion, I understand that since the facility operates under a general storm water permit there would be no approval process from the DEQ to modify the existing permit and add the pond. We would need to modify the existing SWPPP to include the pond and an erosion control plan will be needed for land disturbance of greater than 1 acre. Can you take a look at the attached design and confirm from our discussion yesterday the NC DEQ would have no other requirements that we would need to address prior to construction? Thanks Alan J. We implemented monthly monitoring beginning in December 2015 due to results above the benchmark limits for two consecutive monitoring periods. The most recent monthly analytical results from February 2016 include results above the benchmark limits for the fourth consecutive month for total zinc. This triggered a Tier 3 response. A summary of analytical results and corrective actions implemented to date are summarized below. In June 2015, results for total copper (0.0268 mg/L), total lead (0.127 mg/L), total suspended solids (167 mg/L), and total zinc (0.611 mg/L) were above the benchmark Iimits indicated in the permit. CSXT began a review of facility operations to determine potential sources and corrective actions. Sampling completed in November 2015 noted results above the benchmark limits for total copper (0.0358 mg/L), total lead (0.181 mg/L), total suspended solids (299 mg/L), and total zinc (0.171 mg/L) again. Sampling was not completed in December 2015 due to no discharge at the facility outfall. During this time an investigation was initiated to determine what was contributing to the high metals in the water sample. During the week of December 18, 2015 the following team was on site: CSXT Environmental Field Services Manager, Environmental Field Services Coordinator, and Environmental Engineer, as an environmental consultant from Arcadis. The team walked through the process, identified potential sources, reviewed the drainage and inlet structures, and inspected the surrounding area. This facility and drainage structures were built in 2014. After the investigation, the team developed a long term and short term solution. We implemented monthly monitoring beginning in December 2015 due to results above the benchmark limits for two consecutive monitoring periods. The most recent monthly analytical results from February 2016 include results above the benchmark limits for the fourth consecutive month for total zinc. This triggered a Tier 3 response. A summary of analytical results and corrective actions implemented to date are summarized below. In June 2015, results for total copper (0.0268 mg/L), total lead (0.127 mg/L), total suspended solids (167 mg/L), and total zinc (0.611 mg/L) were above the benchmark limits indicated in the permit. CSXT began a review of facility operations to determine potential sources and corrective actions. Sampling completed in November 2015 noted results above the benchmark limits for total copper (0.0358 mg/L), total lead (0.181 mg/L), total suspended solids (299 mg/L), and total zinc (0.171 mg/L) again. Sampling was not completed in December 2015 due to no discharge at the facility outfall. During this time an investigation was initiated to determine what was contributing to the high metals in the water sample. During the week of December 18, 2015 the following team was on site: CSXT Environmental Field Services Manager, Environmental Field Services Coordinator, and Environmental Engineer, as an environmental consultant from Arcadis. The team walked through the process, identified potential sources, reviewed the drainage and inlet structures, and inspected the surrounding area. This facility and drainage structures were built in 2014. After the investigation, the team developed a long term and short term solution.
