Sewer Extension
Lincoln County
Dear Mr. French:
On February 24, 1999, the Division of Water Quality (Division) received a letter from J.
Patrick Warren, P.E. Mr. Warren stated that upon final inspection of the subject sewer extension,
he discovered that the required force main air -release valve shown on the plans approved by the
Division was not installed. According to Mr. Warren, a representative of the East Lincoln
County Water and Sewer District informed the contractor not to install the required air -release
valves.
Please be aware of Condition 1 of Permit No. WQ0014883, which states, "This permit
shall become voidable unless the facilities are constructed in accordance with the conditions of
this permit, the approved plans and specifications, and other supporting data."
Condition 1I b of Permit No. WQ0014883 requires an air -relief valve at all high points
along the force main.
In a March 22, 1999 telephone conversation, Mr. Warren indicated that the subject sewer
extension is already in operation. Condition 7 of Permit No. WQ0014883 states, "Upon
completion of construction and prior to operation of this permitted facility, a certification must
be received from a professional engineer certifying that the 'permitted facility has been installed
in accordance with this permit, the approved plans and specifications, and other supporting
materials..."
Please be aware that the East Lincoln County Water and Sewer District is in violation of
Permit No. WQ0014883. Condition 9 states, "Failure to abide by the conditions and limitations
contained in this permit may subject the Permittee to an enforcement action by the Division, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C." The East Lincoln
Water and Sewer District is subject to both civil and criminal penalties.
The subject sewer extension can not be certified as constructed. The East Lincoln County
Water and Sewer District may request a modification to the existing permit or install the air -
release valves as approved. Please be advised that no additional service taps shall be allowed
which are tributary to the subject sewer extension until this matter is resolved.
