Dear Mr. Vinson:
Aqua North Carolina, Inc. (Aqua) offers the following response to the above -referenced Notice of Violation
and Intent to Assess Civil Penalty, which was issued for Solids, Total Suspended - Concentration exceeding
the daily maximum and monthly average found in April 2021 Discharge Monitoring Report.
The wastewater treatment plant was operating well during this time period. However, in the post-
treatment pond, natural influences such as algae growth and temperature variances have caused this
elevated TSS excursion. Aqua will apply for a permit modification to have the polishing pond removed
from the permit
