VAN DER VAART secretary TRACY DAVIS Director Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that this modified permit now references DEMLR as the Division responsible for issuance of the permit. The Wilmington Regional Office received a complete, modified Stormwater Management Permit Application for Rocky Point Scotchman #150 on April 5, 2016. Staff review of the modified plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding modified Permit No. SW8 010912 dated April 7, 2016, for the construction of the built -upon areas and BMP's associated with the subject project. The modifications covered by this permit include: 1. Expanding the pond to account for the additional built -upon area. 2. Modifying the permanent pool and temporary pool elevations. 3. Moving and slightly reconfiguring the pond to deal with site restraints. 4. Closing off curb cuts, and adding swales and collection piping to ensure that all runoff from the built -upon areas is captured and directed to the pond. This permit shall be effective from the date of issuance until January 9, 2020, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the conditions listed in this permit regarding the Operation and Maintenance of the BMP(s), recordation of deed restrictions, certification of the BMP's, and the procedures for changing ownership, transferring the permit, and renewing the permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system, to record deed restrictions, to certify the BMP's, to transfer the permit, or to renew the permit in a timely manner, will result in future compliance problems. If any parts, requirements, or limitations contained in -this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes. Per NCGS 143-215(e) the petition must be filed with the OAH within thirty (30) days of receipt of this permit. This permit shall be effective from the date of issuance until January 9, 2020, and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS 1. This permit'is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.6 of this permit. The stormwater control has been designed to handle the runoff from 366,695 square feet of impervious area of which 27,870 sf is offsite, and 180,000 sf is future. 3. The drainage area will be limited to the amount of built -upon area indicated in Sections 1.2 and 1.6 of this permit, and per the approved plans. 4. All stormwater collection and treatment systems must be located in either public rights -of -way, dedicated common areas or drainage easements. The final plats for the project will be recorded showing all such required rights -of -way, common areas and drainage easements, in accordance with the approved plans. 5. The runoff from all built -upon area within the permitted drainage area of this project must be directed into the permitted stormwater control system. The stormwater management system shall be entirely constructed, vegetated and operational for its permitted use within the next 180 days or prior to the construction of any additional built -upon surface, whichever occurs first. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Agreement is an enforceable part of this permit that must be followed in its entirety and maintenance must occur at the scheduled intervals. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DEQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. Decorative spray fountains will be allowed in the stormwater treatment system, subject to the following criteria: a. The permanent pool volume is >30,000 cubic feet; b. The fountain must draw its water from less than 2' below the permanent pool surface; c. Separated units, where the nozzle, pump and intake are connected by tubing, may be used only if they draw water from the surface in the deepest part of the pond; d. The falling water from the fountain must be centered in the pond, away from the shoreline; e. The maximum horsepower for a fountain in this pond is 1/6 horsepower. 6. The facilities shall be constructed, operated and maintained in accordance with the approved plans and specifications, the conditions of this permit, and other supporting data as attached to this permit and on file with the Division. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. Significant deviations may require a permit modification. 8. If the stormwater system is used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 9. Access to the stormwater facilities shall be maintained via an appropriately recorded access easement to the nearest public right-of-way. 10. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, grading, etc. b. Redesign or addition to the approved amount of built -upon area or to the BMP drainage area. C. Further subdivision, acquisition, lease or sale of all or part of the project area. d. Filling in or piping a swale, altering (changing grade, flow direction, or size) or relocating, any component of the stormwater collection and conveyance system shown on the approved plan. e. The construction of any future BUA accounted for on the application. 11. The permittee shall maintain a copy of the approved plans and specifications on file at all times. 12. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. III. GENERAL CONDITIONS 1. Any individual or entity found to be in noncompliance with the provisions of a stormwater management permit or the stormwater rules is subject to enforcement procedures as set forth in NCGS 143 Article 21. 2. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 3. In the event that the facilities fail to perform satisfactorily, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management measures. The permittee shall submit a completed and signed Name/Ownership Change Form, accompanied by the supporting documentation as listed on the form, to the Division of Energy, Mineral and Land Resources at least 60 days prior to any one or more of the following events: a. An ownership change including the sale or conveyance of the project area in whole or in part, except in the case of an individual lot sale that is made subject to the recorded deed restrictions; b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's Association, subject to the requirements of Session Law 2011-256; c. Bankruptcy; d. Foreclosure; e. Dissolution of the partnership or corporate entity; f. A name change of the current permittee; g. A name change of the project; h. A mailing address change of the permittee; 5. The permittee grants DEQ Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 7. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 8. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 9. The permittee shall submit a renewal application, supporting documentation and the renewal fee. at least 180 days prior to the expiration date of this permit. SUBMITTAL REQUIREMENTS Only complete application packages will be accepted and reviewed by the Division of Energy, Mineral and Land Resources (DEMLR). The complete application package should be submitted to the appropriate DEMLR Office. The ability to collect the runoff from the impervious areas may be hindered if these boxes are not installed. Please provide proposed top of invert elevations for the "not found" boxes if they will be installed. Response: The boxes noted as "not found" were installed, but are not accessible and serve as junction boxes. Runoff in the area of CB#5 is captured in CB#6 and CB#7. The runoff in the vicinity of CB#3 sheet flows to the curb line. Additional surveyed spot elevations have been added along the edge of pavement of the curb for verification of positive drainage to the stormwater pond. Comment: Please address the front drainage as it appears a good portion of the runoff from the gas canopy area and front pavement will collect along the edge of the curbing and bypass the pond. Where you are proposing to close those 2 curb cuts, you may need to add catch basins and pipe that runoff over to the collection system. When 1 scheduled the express review, I had assumed that ownership of the property was going with CENAMA, Inc., since tiat was the owner of the property per tax records. The Express request actually named Worsley Companies, Inc as the applicant. I can accept an application with CENAMA, Inc. as the proposed permittee because the change from Worsley Companies, Inc. to CENAMA, Inc. is simply a merger with CENAMA, Inc. as the surviving corporation. It is my understanding from Christine that we do need a signed Name/Ownership Change form to be submitted for the second ownership change, from CENAMA, Inc. to Morelag, LLC, even though the same principals are involved. Essentially, Mr. W. Cecil Worsley, III would be signing the form as the current permittee (i.e., as president of the survivor corporation CENAMA, Inc.) and as the proposed permittee (i.e., as member/manager of Morelag, LLC). I can't process the express application until the ownership change is completed. As an alternative, the permit could be issued to CENAMA, Inc.
