A review of the Scotland Neck WWTP's monitoring report for October 2004 showed the following violations:

If you have justification these violations were caused by events or circumstances beyond the town's control, you
must reply in writing to this office within ten (10) days after receipt of this notice. Your justification will be

absence of such justification, this office shall demand payment of the stipulated penalty as included in the Consent
Order.

Dear Mayor Partin:
This letter is to inform you that a review of the town's Special Order by Consent indicates a violation of the
following activity requirement:
SOC Item Activity Due Date Reported Date
2(b)(5) Complete construction of On or before January January status report states date was
WWTP upgrades -phase II 1, 2005 not met.
For violation of this activity date, the Special Order by Consent contains a stipulated penalty of $500.00 per missed
schedule date within the first seven (7) days of tardiness and $50.00 per day thereafter.
Paragraph four (4) of the Consent Order states in part that the stipulated penalty is not due if the town satisfies the
Division that noncompliance was caused by events or circumstances beyond the town's control.
If you have justification these violations were caused by events or circumstances beyond the town's control, you
must reply in writing to this office within ten (10) days after receipt of this notice. Your justification will be
reviewed and a determination will be made whether to assess stipulated penalties as outlined in the SOC. In the
absence of such justification, this office shall demand payment of the stipulated penalty as included in the Consent
Order.
