Failure to submit all required items will necessitate additional processing and review time. For more information, visit the System -wide Collection System Permittingwebsite: General — When submitting an application to the Pretreatment, Emergency Response, & Collection Systems (PERCS) Unit, please use the following instructions as a checklist in order to ensure all required items are submitted. Adherence to these instructions and checking the provided boxes will help produce a quicker review time and reduce the amount of requested additional information. The Applicant shall submit one original and one copy of the application and supporting documentation. A. Cover Letter ® Submit a cover letter listing all items and attachments included in the permit application package B. No Application Fee Required ➢ No application fee is necessary. The permittee will be billed an annual fee upon issuance of the permit ➢ The appropriate annual fee for systemwide wastewater collection system permits may be found at: ➢ Annual Non -Discharge Fees C. System -Wide Wastewater Collection System (FORM: CSA 04-16) Application: ® Submit the completed and appropriately executed System -wide Wastewater Collection System (FORM: CSA 04- 16) application. Any unauthorized content changes to this form shall result in the application package being returned. If necessary for clarity or due to space restrictions, attachments to the application may be made, as long as the attachments are numbered to correspond to the section and item to which they refer. ❑ If the Applicant Type in Section 1.3 is a Privately -Owned Public Utility, provide the Certificate of Public Convenience and Necessity (CPCN) from the North Carolina Utilities Commission demonstrating the Applicant is authorized to hold the utility franchise for the area to be served by the wastewater collection system, or ❑ Provide a letter from the North Carolina Utilities Commission's Water and Sewer Division Public Staff stating an application for a franchise has been received and that the service area is contiguous to an existing franchised area or that franchise approval is expected. ❑ If the Applicant Type in Section 1.3 is a corporation or company, provide documentation if it is registered for business with the North Carolina Secretary of State. SECTION IV. COMPENSATION AND BENEFITS Employees shall receive a one-half percent (1/2%) merit increase in pay on each two year anniversary they have been in the same position. The actual percentage increase will be determined based on the number of years the employee is in their position and effective on each employee's anniversary date. Employees must have received a positive performance review on the County's established evaluation form with no formal disciplinary action during the performance period to be eligible for the increase. If at any time during the year, the Burke County Manager finds any person to be delinquent in any financial obligation to Burke County and who is also employed by a County Department, the County Manager shall have the authority to suspend that employee from the Burke County merit pay plan for a period of two consecutive years from the date of discovery. The County may pay a holiday bonus of $100 to all permanent full-time employees and a prorated amount to all regularly scheduled permanent part-time employees. Depending on the economy, the bonus may be paid in December in a separate payroll. Indiividuals must be continuously employed by the County in a full time or regularly scheduled permanent part time status from July 1, 2020 through Friday of the week prior to the payment date in order to receive the bonus. The Board of Commissioners hereby adopts the following measures for budget administration and review: 1. In accordance with North Carolina General Statute 115C-429(b) the Board of County Commissioners allocates current expense and capital outlay appropriations in lump sum for use by the Board of Education in accordance with the School Budget and Fiscal Control Act, except for an appropriation by function for school nurses. Furthermore, pursuant to North Carolina General Statute 115C-433(b), the Board of Education must obtain the approval of the Board of County Commissioners for an amendment to the budget that increases or decreases the amount of the County appropriation allocated to a function by twenty-five percent (25%) or more from the amount contained in this budget ordinance adopted by the Burke County Board of Commissioners. 2. Further, budget requests are to be accompanied by the school system's State and Federal budgets as required by General Statue 115C-429(c) which states, the school board shall submit its entire budget to the County Commissioners, not just the part for which county support is requested. 3. The Board of Education shall make quarterly financial reports to the Board of Commissioners as to the disbursement and use of local monies granted to the Board of Education by the Board of Commissioners. SECTION VIII, MANAGERIAL AUTHORITY The County Manager shall have management authority for the budget in accordance with the February 21, 1995 action of the County Commissioners as follows: Approve budget amendments to receive and expend State, Federal and other non -tax revenues so long as the action does not commit additional property tax dollars, create additional positions, or initiate a new county function. Approve budget adjustments for actual pass through of fire tax revenues received for respective fire departments. Permit transfer of funds within and between departments so long as the action does not commit additional local tax dollars, create additional positions, or initiate a new county function. Additionally, the County Manager is authorized as follows: To impose a hiring freeze, a freeze on capital expenditures, a freeze on travel, and operating reductions up to ten percent (10%) as deemed necessary by Burke County management. The Burke County Board of Commissioners will serve as the Appellate Board for decisions made by the County Manager. All appeals will follow the usual and customary agenda process. To require the pre -approval of all out of county travel to attend training classes, workshops, and/or conferences by the Department Head and County Manager prior to the training using the Travel Authorization form. Travel costs incurred without proper authorization may not be paid or be eligible for reimbursement. To negotiate and approve change order increases up to $25,000 and all change order reducing the total contract so long as such change orders do not significantly alter the scope or definition of the project or exceed budgeted funds. BUDGET ORDINANCE FISCAL YEAR 2020-2021 To approve grants without a local match. To accept both monetary and property donations up to $25,000 and authorize the appropriate accounting entries. To approve and execute contracts for budgeted expenditures up to $90,000 where such contracts are not required to be bid or which G.S. 143-131 allows contracts to be executed on informal bids. The exception to this shall be procurement decisions in which Board action is mandated by a State or Federal requirement. To execute contracts with outside agencies to properly document budgeted appropriations to such agencies where G.S. 153 A-248 (b), 259, 449 and any similar statutes require such contracts. To increase the starting salary for candidates for vacant positions up to the mid point of the salary range, as needed. To review departmental appropriations quarterly and may transfer any anticipated excess funds to a budget account in order to preserve Fund Balance. To exempt county projects from procurement requirements of Article 3D - Procurement of Architectural, Engineering, and Surveying Services, as permitted by G.S. 143-64.32. This authority may be delegated to the Deputy County Manager/Finance Director. SECTION IX. UTILIZATION OF BUDGET AND BUDGET ORDINANCE This Ordinance shall be the basis of the financial plan for Burke County government during the 2020-2021 fiscal year. The County Manager shall administer the budget and he shall ensure that operating officials are provided guidance and sufficient details to implement their appropriate portion of the budget. The Deputy County Manager/Finance Director shall establish and maintain records consistent with this ordinance and the appropriate statutes of the State of North Carolina. Highlights of the presentation are as follows: • State -of -the art manufacturing facility with $38.9 billion in sales in 2012. • Employs approximately 177,000 employees in 46 countries with 600 people employed at their two (2) assembly facilities in Morganton. • Manufactures electronic braking systems (stability control) and electronic air suspensions for vehicles. • Will manufacture approximately 6,2 million units this year for the Jeep Grand Cherokee, Dodge Ram pick-up truck and the Tesla electronic vehicle. • Sales between the two (2) Morganton plants are approximately $1 billion dollars. • Reviewed amount of property taxes and utilities paid to Burke County and City of Morganton in 2014. • Manufacturing and assembly processes are high-tech and robotics driven in a clean room environment. • Continental was the first to pass General Motors` stringent quality audits. • Continental is looking to hire technically savvy people. • Continental has reached out to community colleges, high schools and even middle schools to let the community know there are great hi -tech career opportunities in Morganton. • Continental partners with the community college to provide scholarships and sponsors science fairs in the school system. Vice Chairman Abele opened the floor for questions from the Board. Mr. Jones responded to several questions. County Manager Steen stated Continental is a wonderful company and he is glad they are here. Further, he wanted Continental to stay here and grow. He also mentioned a $750,000 Golden LEAF grant awarded for the mechatronics expansion program to help meet local employment needs, Lastly, he mentioned the financial benefit associated with a 2-year mechatronics degree. RESULT: NO ACTION TAKEN SCHEDULED PUBLIC HEARINGS GENERAL SERVICES - CDBG-I GRANT APPLICATION FOR RHONEY ROAD & HWY 18 SOUTH - PUBLIC HEARING Director of General Services/County Engineer, Chris Hollifield and Leah Martin, Sr. Planner of the Western Piedmont Council of Governments, were present to discuss the purpose of the public hearing for the County's CDBG-I funding application. Mr. Hollifield briefly reviewed the project area. The project area is on Highway 18 South, on Shoupe's Way heading South just past River Road and a small portion off Highway 18 on Rhoney Road which would pick up where the convenience site is located to Parker Industries near the George Hildebran Fire Department is located. Ms. Martin stated the public hearing was to obtain citizen's views, respond to funding proposals and answer any questions posed. She stated the meeting must cover the County's community development needs, development of the proposed activities, and a review of program compliance before the submission of the County's CDBG-I funding application to the State of the North Carolina. She presented the following purpose, the funding availability and eligible activities for the year for the CDBG-I grant program as: To improve the quality of life for low to moderate -income people by providing a safe, clean environment and clean drinking water through water and sewer infrastructure improvements and extensions of service. • To benefit a residential area where at least 51% of the beneficiaries are low to moderate income as defined by the United States Department of Housing and Urban Development. • To perform eligible activities. • To minimize displacement. • Provide displacement assistance as necessary. In a typical year, she said NC receives from the US Department of Housing and Urban Development (HUD) $44 million with $26 million to the CDBG-I at DENR. For FY15, the CDBG-I funds were split into two rounds and $13 million is expected to be available for award in January 2016, For FY 2016, there is a similar distribution expected and discussion of only one CDBG-I grant round due in September 2016. The maximum available grant is $2.0 million over a 3-year period and applications for remaining FY15 funding must be received by September 30, 2015. The CDBG program is able to fund a wide variety of community development activities. The State of North Carolina has chosen to fund two activities: water and sewer infrastructure, and Page 3 573 September 15, 2015 (Regular) economic development projects that ►ead to job creation or retention. The infrastructure program, or CDBG-I program can fund a range of water and sewer infrastructure activities, including, but not limited to the following: Water: • Projects that resolve water loss in distribution systems. • Projects that extend public water to areas with contaminated wells. • Projects that extend water lines to areas with dry wells. • Projects that assist with low water pressure in public water systems. • Projects that regionalize two or more water systems. • Projects that rehabilitate or replace a water treatment plant. Wastewater: • Projects that resolve inflow and infiltration to collection systems and surcharges from pumps stations and manholes. • Projects that extend public sewer to areas with failed septic tanks. • Projects that rehabilitate a wastewater treatment plant to allow for greater efficiency/compliance with regulations. The proposed Burke County CDBG-I Hwy 18 $ and Rhoney Road Project is a grant application for $2 million in CDBG-I funds to address critically needed public water extension to address system deficiencies and due to private wells with critical and acute public water needs. The proposed project is 11,230 linear feet of public water on NC 18 South connecting the dead end lines currently on NC 18 South between 4824 NC 18 South and the John Abee Street intersection on NC 18 South and 13,000 linear feet of water on Rhoney Road to Old NC 18 South. The proposed activities and estimated budget are water improvements - $1,800,000 and grant administration - $200,000, which includes easements and the environmental review. A total of 100 percent of the CDBG- I funding will be used to benefit Low to Moderate Income (LMI) people. The project areas have been determined by a door-to-door survey to have a 76.3 % LMI. She advised that number could increase slightly as a couple of homes have not been surveyed. The project proposed by the County is identified in its Capital Improvement Plan. Door-to-door meetings were held in the project area to inform citizens of the potential project, and get feedback from the residents. The range of activities covered by the Burke County CDBG-I Hwy 18 S and Rhoney Road Project includes: • Water Construction • Environmental Review • Engineering Design • Construction Administration and Observation Page 4 September 15, 2015 (Regular) • Legal Activities • Surveying • Grant Administration If the County of Burke is awarded a CDBG-I grant, the County is required to adhere to federal procurement requirements and other federal regulations, which include: • American with Disabilities Act/Section 504 Survey • Davis -Bacon & Related Labor Acts • Adoption/Submittal of a Citizen's Participation Plan • Adoption/Submittal of an Equal Opportunity Plan • Adoption/Submittal of a Fair Housing Plan • Adoption/Submittal of a Language Access Plan • Adoption/Submittal of a Relocation Assistance Plan • Adoption/Submittal of a Section 3 Plan • Excess Force Provision Ms. Martin further advised that these plans are already in place since the County has an open CDBG project (Annas Street). In addition, she said the State of North Carolina requires that if the County of Burke receives CDBG grant funding, the County will certify that it will comply with the requirements of the general displacement and relocation policy for CDBG grant funding. This policy assists low to moderate income people with costs associated with relocation or displacement, should such relocation become necessary due to the project activities. It was confirmed during the public hearing that no displacement and relocation will occur as a result of the proposed CDBG-I grant activity. Carswell COUNTY MANAGER - BDI REQUEST TO USE FHEC TO STORE EQUIPMENT Burke Development, in partnership with the Manufacturing Solutions Center and the Carolina Textile District, applied for a $200,000 equipment grant from the Appalachian Regional Commission (ARC) in 2014. The project requested equipment that would be placed at the Manufacturing Solutions Center in Catawba County. The grant was approved by the North Carolina ARC office; however, the federal ARC office would not approve the location as Catawba is not an ARC county. The ARC -NC office, along with the Western Piedmont Council of Governments, appealed the decision and provided supporting documentation for why placing the equipment at MSC was appropriate; however, the appeal was denied. Therefore, BDI has a $200,000 grant and need to find a new location for the equipment. The location will be Page 10 September 15, 2015 (Regular) temporary as this equipment will be moved to the Millennial Manufacturing campus to be built at the Burke Business Park. BDI would like to ask the County to allow us to use a room at FHEC for a period of two years to temporarily house the equipment. The room is near the recreation department offices, is currently a lounge area and, according to Keith Farris, is only used once a year. There will be no cost to the County other than the in -kind use of the room itself. Use of the equipment will be managed by the Manufacturing Solutions Center. Several Burke County companies, specifically furniture and textile, were supportive of this grant application and would benefit greatly from this equipment being in Burke County. They will have the opportunity to use the equipment for production and they will also benefit from training conducted on the equipment, which will provide them with skilled employees. If this issue for a new location is not resolved by Friday, Sept. 4, BDI will be forced to give the grant monies back. The proposed increase will cover unauthorized use, eliminate abuse and cover repair costs. The "Rules and Regulations" was also updated. Subject to County's approval, Lessee shall be permitted to utilize available advertising spaces at the rates as may be agreed upon. The County/FHEC is at all times in control of said spaces. 6. Signs or other materials may not be attached to ceilings or walls. • Lessee agrees that nothing will be affixed to any FHEC surface by tape, glue, nail, screw, etc. • No self -adhering decorations are permitted on any surface. • Lessee may decorate only in those rooms Lessee is renting, not lobbies, hallways, restrooms or any other non -teased area. • Any type of tape to be applied to the floor (including any brand of double-faced carpet tape) by Lessee, exhibitors or third party vendors must be approved in advance by Burke County. The cost for cleanup is substantial and will be the responsibility of Lessee. • No confetti or glitter is allowed, • Lessee shall be responsible for removing all decorations and floor tape following the close of the event. Should this function not be performed, Lessee will incur labor, material and equipment cleanup charges that will affect reimbursement of damage fees. 7. Animals: Other than certified guide or service animals, animals including fish are not permitted inside FHEC. Approval must be set forth in writing by Burke County. 8. Lessee agrees to begin function promptly on scheduled time and agrees to vacate the building at closing time indicated on agreement. 9. Lessee agrees to remove any food, displays, items on tables, etc. and deposit trash in designated areas immediately following the event. Failure to do so may affect reimbursement of damage deposit. 10. If use of the facility involves bringing in items for shows or sales, the Lessee must obtain a fire permit from public safety. No later than ten days prior to the event date, Lessee is required to provide a certificate of insurance to use facilities for special events. 12. Carswell 584 FIRE MARSHAL- DELEGATE THE ANNUAL FIREFIGHTERS RELIEF FUND BOARD OF DIRECTORS REPORT TO THE LOCAL FIRE CHIEFS The Department of insurance - Office of the State Fire Marshal has moved to a new database that will allow fire departments to complete and submit the annual Firefighters Relief Fund Board of Trustees Report directly to their office. This report was formally known as the "Report of Fire Conditions". Each year the Report of Fire Conditions has to be submitted on or before October 3111 by the clerk or finance officer of each city or county that has a local board of trustees under G.S. 58-84-46, or a fire chief if authorized by such a city or county to file the certificate. The certificate of eligibility shall be filed with the Commissioner. For the past several years the Report of Fire Condition was submitted by the Fire Marshal's Office on behalf of the Finance Officer as permitted by previous Board action. The Fire Marshal requests the Commissioners approve the delegation of the submission of the Firefighters Relief Fund Board of Trustees report to the local fire chiefs. If approved, the Fire Marshal will be required to notify the Office of the State Fire Marshal's Office, list the fire departments that the County has delegated this authority to, and notify each Fire Chief that the County has delegated this authority to them. EMPLOYEE BENEFITS POLICY ADDITION In anticipation of the opening of the Employee Health and Wellness Clinic (Clinic), a new policy addition is being recommended to establish policy guidelines for the eligibility and use of the Clinic as well as clarifying maintenance of medical records and related administrative matters as presented in the below proposed draft. The new section under Article VI., Employee Benefits is highlighted in red. Article VI. EMPLOYEE BENEFITS Section 6.14 Employee Health and Wellness Clinic Use The Employee Health and Wellness Clinic is available to employees as part of the County's Health Insurance and Wellness Initiatives. Employees and retirees must show a current health benefit insurance card and picture identification at the time of appointment. Dependents must be listed on the employees' health benefit insurance card to be seen at the Clinic. These identifications will be checked at each visit to the Clinic. Hours of operation are posted on the HR website as well as scheduling information. Page 17 September 15, 2015 (Regular) Eligibility - Employees who are enrolled in the County's health plan are eligible. Employees' dependents covered by the health plan will be eligible to use the Clinic who are six (6) months and older. Burke County retirees participating in the County's health insurance plan are also eligible. Medical Records - All personal medical services will he confidential. The medical records will be maintained by the medical provider contracted to operate the Clinic and are not considered county records or part of an employee's personnel file. Use of Sick Time - In order to avoid being charged for sick leave, an employee's intention must be to work on the day of the medical visit. If an employee is at work but visits the Clinic and then returns to work immediately following the medical visit, sick leave will not be charged. Health Coaching/Biometric Screening - No leave is charged to employees who have a health coaching or biometric screening appointment with the medical provider at the Clinic. Leave time must be used if an employee is accompanying a dependent to the Clinic for a medical visit. Motion: To approve the update to Article VI. REPORTS AND COMMENTS TOURISM AUTHORITY - 2015 TOURISM UPDATE Ed Phillips, Executive Director of the Tourism Development Authority, provided an update on tourism activities and responded to questions from the Board. Highlights of the presentation are as follows: • Burke County's tourism economy surpasses $90 million for the first time in 2014. • Travel and tourism industry directly employs more than 680 persons in Burke County Page 25 595 September 15, 2015 (Regular) for 2014. Total payroll generated by tourism in Burke County is $13.01 million. • State tax revenue generated in Burke County for 2014 totaled $4.87 million. • Burke County Visitors Center has had a record number of visitors during the summer with increases of forty percent (40%) and forty-five percent (45%) in June and July (2015) and August (2015) was up significantly with nearly 600 visitors to the Visitor Center. Visitation is expected to further increase by the end of the third (3rd) quarter 2015, surpassing all of 2014. • For August 2015: Visitor Center Traffic — 495; Website traffic — 8,337; Lake James State Park visitors — 61,476; and South Mountain State Park visitors — 27,567, • In June 2015, Burke County hosted a group of "travel writers", which generated several magazine articles. • New Ridgeline Trolley is ahead of its revenue budget for the first few months of operation. Twenty chartered events are scheduled now through the end of the year. • "Fun Updated Daily" campaign on Facebook: The campaign reached over 300,000 people and drove website traffic up over 70 percent from last year. • "Fall Color Reports Updated Daily" media campaign will begin again in October, which will reach out to newspapers, radio and television stations across the Southeast highlighting the fall colors in Burke County, • Historic Morganton Festival hired the Ridgeline Trolley (24 hours at an hourly rate) to provide shuttle service during the Festival. • Revenue for the trolley for the first three (3) months of ownership is up over three hundred percent (300%) of what was projected. Carswell COUNTY ATTORNEY - MATTHEWS CONSTRUCTION MEMORANDUM OF MEDIATED SETTLEMENT County Attorney Simpson provided a brief report on the Memorandum of Mediated Settlement agreement with Matthews Construction Company, Inc., the general contractor for the Burke County Emergency Communication Center (Consolidated 911 Center) construction project. Matthews Construction Company, Inc. received a $3.35 million contract from the County to build the facility. However, the County had several problems with the contractor related to delays in the project. When the contractor presented the final bill to the County of approximately $94,000 in November of 2014, he said the County notified Matthews of the County's intent to avail itself of the $500 per day penalty clause contained within the contract, based on the number of days the project was late due to contractor delays. The County claimed 64 days at $500 per day or a $32,000 offset. Matthews Construction did not agree with Page 26 596 September 15, 2015 (Regular) the offset. With the parties being unable to agree, he further reported Matthews Construction filed a lawsuit in late January of 2015. Pursuant to Superior Court rules, a mediation was held. Matthews Construction asked for approximately $100,000 while the County demanded the offsets of $32,000. A settlement was reached in mediation for the County to pay Matthews Construction $62,986. The parties entered into a Memorandum of Mediated Settlement on September 2, 2015, subject to the approval by the Board of Commissioners in open session. County Attorney Simpson also responded to questions from the Board. Abele, Sr., Chairman Page 28 597 Sec,-Kon v , Burke County Sewer Station Emergency Response Plan Revised 01/29/2021 BURKE COUNTY SSO CONTINGENCY PLAN PURPOSE Burke County owns and operates a diverse collection system that consists of pump stations, gravity flow sewer mains and force mains. These facilities are well maintained and normally should not result in any sewage overflows or spills. However, the possibility exits that unforeseen accidents, equipment failure or other events not controllable by Burke County could result in a sewer overflow or spill. This plan, when enacted in response to a SSO event will reduce or eliminate public health hazards, prevent unnecessary property damage, and minimize service interruption. GENERAL Normal and routine maintenance of the collection system allows operation at maximum designed capacity. In the event of an SSO this response plan will help facilitate a timely and technically correct response. In order for county staff to accurately assess the level of response, the potential liability claims for property damage, and to accurately report overflows/spills to regulatory agencies the following definitions shall apply: SSO Categories 1. Category 1 — All discharges of sewage resulting from a failure of sewer system that result that: A. Equal or exceed 100 gallons B. Result in a discharge to a drainage channel and/or surface water C. Discharge to a storm drainpipe that was not fully captured and returned to the sanitary sewer system 2. Category 2 — All other discharges of sewage resulting from failure of sewer system 3. Category 3 — Private Lateral Sewage Discharges — Sewage discharges that are caused by blockages or other problems within a privately owned lateral. STANDBY Standby duty is defined as that period of time assigned in addition to the employee's normal work week during which time the employee must be available by phone to respond to sanitary sewer emergencies. SAFETY When county staff responds to an SSO, they may encounter an emergency situation that requires immediate action. The most critical aspect of resolving an incident of this nature is to safely and competently perform the actions necessary to return service as soon as possible and to keep health and environment impacts toa minimum. SAFETY ALWAYS TAKES PRECEDENT OVER EXPEDIENCY OR COST SAVING SHORTCUTS. Depending on nature or cause of SSO, staff may be performing repairs at the pump station, removing a mainline blockage, or repairing a damaged section of line. All essential safety procedures are to be followed so that the response does not escalate the situation. Responses may require staff to implement the following types of safety procedures: • Lockout/Tagout of equipment for repair • Confined space entry procedures • Traffic control procedures at site • Trench and shoring procedures • Equipment and/or vehicle operation • Use of personnel protective equipment Communication is critical when responding to an overflow/spill. Communication is maintained via 2-way radio or cell phone. Staff may need to call for additional personnel as the situation may warrant, notify a supervisor of the situation, and/or report overflow/spill to the proper authorities. PROCEDURES When standby received notification of a possible sanitary sewer overflow/spill, he or she will take immediate action and gather as much information as possible to determine the staffing and equipment needed for the response. This section will provide step-by-step procedures explaining the actions to be taken in response to an overflow/spill. The procedure will be based upon the type of overflow/spill including mainline blockage, force main failure, pump station failure, and private line/lateral failure. TRAFFIC AND CROWD CONTROL When responding to an overflow/spill location, staff will need to assess extent of area affected. Staff will determine type of traffic or crowd control to secure area from public contact. Below are methods used: 1. Use of traffic cones, barricades, or warning tape to detour vehicle and pedestrian traffic safely around area. 2. Use of reflectorized clothing when working at night. 3. Use of proper traffic control patterns and advance warning signs as outlined by Burke County standards when working in the roadway. MAINLINE BLOCKAGE 1. Contact property owner or person reporting the overflow/spill and obtain information on location to determine if the spill is within the county's service area. 2. Upon arrival at the overflow/spill location, make a determination as to the source of the overflow/spill. 3. Secure area by placing cones or barricades around the affected area. 4. All reasonable methods to contain overflow/spill shall be used as soon as possible to prevent overflow/spill from expanding. Examples of reasonable containment methods are: A. Vacuuming with combination vehicle B. Building a dike/berm C. Sandbagging/Geo Logs D. Bypass Pumping 5. Inspect flow condition in structure/manholes up and downstream from the overflowing structure/manhole to determine the location of the blockage. 6. Use hydraulic (combination cleaner) or mechanical (rodding machine) equipment to relieve the blockage as soon as possible. 7. Once the blockage has been removed or problem is corrected and overflow has ceased, use a vac truck or other similar methods available to clean up the spill debris. Call additional personnel if needed to recover spill and begin the decontamination process. 8. If property damage has occurred, notify a Wastewater Supervisor immediately so photographs of the damaged area can be taken for risk management records. 9. Provide proper cleanup, removing any debris, and disinfect affected area to minimize health hazards and/or environmental impacts. 10. Do not volunteer information on liability. Only neutral comments shall be used by staff indicating that the liability issue cannot be determined until all relevant information has been evaluated. Be polite and sympathetic to the property owner's concerns. Assure them that regardless who is at fault, you are there to assist them in expediting the cleanup. A. If Overflow/Spill is Inside Structure i. Assist the owner of the structure in calling a professional cleaning service for proper cleanup. ii. Draw a diagram of the area affected by overflow. Note any water damage to private property. Take photographs of damaged area to assist Risk Management in settling potential claims. B. If Overflow/Spill is Outside the Structure i. When possible, recover spill by vacuuming using combination machine ii. If area is inaccessible, remove debris by means of rake and shovel and disposed of properly. iii. Wash are down and disinfect area. 11. Advise the property owner/occupant of procedure for filing a claim for damages with Risk Management. 12. Make certain that the mainline is functioning properly before leaving the area. 13. Complete all required reports with pertinent details including estimate of spill volume. Turn in all reports to a Wastewater Supervisor at the start of the next workday. FORCE MAIN FAILURE In the event that a spill occurs due to a leak from a force amin, the following actions will be taken: 1. The leaking force main will be isolated and if necessary, bypassed if the pump station retention area does not offer enough time to make the emergency repairs to the pipeline. A temporary pipeline may be installed so that sewage can be pumped around the affected area. 2. Any personnel or an approved contractor, depending on the damage, locations, volume of overflow, and depth of pipe, may complete repairs to the force main. 3. If any overflow from the force main leakage discharges onto private property, public right-of-way, or to surface waters, carry out the provisions for containment, reporting, and clean up as described in MAINLINE BLOCKAGE. PUMP STATION FAILURE 1. Most pump stations are equipped with a Supervisory Control And Data Acquisition (SCADA) to monitor pump stations around the clock. Set point for low and high-water thresholds are set to alert the county staff of a pump station system failure. 2. County staff will check the status of alarm utilizing the interface via their desktop workstation or portable laptop and determine if a remedy can be made remotely, or whether county staff needs to go to the lift station. 3. If a site visit is warranted, upon arrival at the pump station, a determination is made as to what extent of action is required. Staff performs the necessary actions to return the pump station to normal operations. 4. If an overflow has occurred, staff carries out provisions for containment, reporting, and cleanup as described in MAINLINE BLOCKAGE. This purpose of this 0 & M Plan is to help the County maintain the design capacity in its sewer system, and minimize backups, pump station failures, and sanitary sewer overflows. Sewer System Overview Burke County's sewer system was originally constructed in the 1970's and has been added to over the years. This system contains approximately 19 miles of gravity sewers ranging in size from 8 inch to 18 inch, approximately 12 miles of sewer forcemains ranging in size from 8 inch to 12 inch, and four pump stations. These four pump stations are referred to as the George Hildebran pump station, the Island Creek pump station, Eckerd Creek pump station, and the Indian Hills pump station. Of these four, the Island Creek pump station and the Indian Hills pump station has been upgraded in recent years. The George Hildebran pump station receives flow from the area adjacent to the George Hildebran Elementary School and conveys this flow to the Indian Hills pump station. The Island Creek pump station receives flow from the towns of Rutherford College and Connelly Springs and conveys this flow to the Town of Valdese WWTP. The Eckerd Creek pump station receives flow from an area west of Hildebran and conveys this flow to the Indian Hills pump station. The form should be used to ensure that start-up activities are properly conducted, especially in the event of an emergency when the regular operator is not available. The Weekly/Monthly Inspection Report can be used to document weekly and/or monthly inspections of mechanical equipment and appurtenances. Weekly/monthly inspections will ensure that the system is operating properly and in compliance with all applicable rules, regulations, and permit conditions. The Maintenance Activity Report can be used to document preventative maintenance and testing activities, based on the manufacturer's recommendations and specifications for equipment. The Incident/Follow-up Action Report can be used to record follow-up measures taken to correct any deficiencies noted during daily, weekly or monthly inspections. SECTION 4 — SANITARY SEWER OVERFLOW RESPONSE PROCEDURE The North Carolina General Statues require entities that own or operate wastewater collections or treatment systems to report sanitary sewer overflows (SSO's) of untreated wastewater in the following manner: Discharge of any volume of wastewater that reaches surface waters, or discharge of 1,000 gallons or more of wastewater to the ground surface must be reported to the Division of Water Resources within 24 hours of first knowledge of the occurrence. Also, the owner must issue a press release to the media in the affected county within 24 hours after it has been determined that a discharge of 1,000 gallons or more of untreated waste has reached surface waters. Example Press Release: NOTICE OF DISCHARGE OF UNTREATED SEWAGE The (utility) had a discharge of untreated wastewater from our (collection system, pump station) located at (street/highway) of approximately (amount) gallons. The discharge occurred on (date) for approximately (amount) hours. The untreated wastewater entered into (stream, creek, water body) in the (name) river basin. (List action) has been taken to prevent further discharge. This notice was required by North Carolina General Statutes Article 21, Chapter 143.215C. For more information contact (name, title) at (phone number). In the event of a discharge of 15,000 gallons or more of untreated wastewater to surface waters the owner must also publish a notice of the discharge in a newspaper having general circulation in the county in which the discharge occurs and in each county downstream from the point of the discharge that is significantly affected by the discharge. This publication is to be coordinated with the Division of Water Resources. In the event of a discharge, contact the Asheville Regional Office at 828- 296-4500. 21 Spill Responses for spills occurring on: Major Sewer Interceptor Right of Way: 1. Put up warning tape such as "DO NOT ENTER" around SSO site to restrict access. 2. In open areas, add lime, remove debris, roto-till area, re -seed and mulch with straw. In areas of undergrowth and small trees, flush SSO area with potable water until no waste remains. Wait 12 — 24 hours, and then lime the area as above. Be certain that no lime reaches receiving stream. In Citizen's Yard: 1. Till entire SSO area if possible. Apply lime, seed, and straw. 2. If debris is not visible, add 2 inches of topsoil and mix thoroughly. Apply lime, seed, and mulch. On Asphalt or Concrete: 1. Set up containment area at or near the storm drainage system. Do not allow the spill to enter the storm drain system. 2. Put up "DO NOT ENTER" tape around the SSO area. 3. Spread lime on spillage and sand or other similar material to a depth of 1 inch. Let this material absorb for one hour then sweep up. Dispose of debris properly. Repeat if spill is still evident. 4. After removing the contaminated material, wash down area with high pressure water and bleach. 5. Pump clean up materials and wash water into sanitary sewer. In a Creek or Stream: 1. Take conductivity readings of the creek upstream and downstream to determine where temporary dam should be placed. 2. The dam should be constructed near a manhole which is accessible to the vacuum truck. 3. Dam should be placed below the spill as indicated by low conductivity readings. 4. Construct a dam sized to contain the flow of water plus any flush water added during clean up. 5. Station two pumps at clean-up site, one to be used as a back-up. 6. Have a backhoe at the site for dam repairs if needed. 7. Wash down rocks in stream bed until no residue is evident. 22 8. Put up "DO NOT ENTER" tape at spill site and 400 feet downstream. 9. Pull stream samples for fecal coliform, upstream and downstream of SSO site. 10. Repeat sampling until normal, background counts are near 500 cts/100 ml. 11. If settled sludge is evident, sweep stream bottom until it is clean. 12.
