On behalf of Wilbara, LLC/Southern States Chemical, Terracon Consultants, Inc. (Terracon) has
completed the enclosed Industrial NPDES Permit Application and supporting documentation for
the above -referenced facility. Preparation of this NPDES Individual permit application is
associated with the proposed addition of wash waters from facility tank cleaning and
maintenance activities to the facility's present discharge of non -contact cooling water, boiler
blowdown, and cooling tower blowdown through Outfall 001. The individual permit would
replace the facility's present NPDES General Permit NCG500000.

Terracon was retained by Wilbara, LLC, who is owned by Southern States Chemical, to prepare
an Engineering Alternatives Analysis (EAA) for the Wilbara, LLC site located at 4620 Hwy 421 N
in Wilmington, North Carolina. The Wilbara facility consists of approximately 15 acres within the
Invista property bordered to the west by the Invista facility, to the north south and east by
undeveloped land with the Northeast Cape Fear River beyond and to the northeast. Exhibit 1
and 2 show the Wilbara facility and plant layout.
Preparation of this EAA has been complete in conjunction with a NPDES
application for the addition of proposed wash waters from facility tank cleaning and
maintenance activities. The facility presently operates under NPDES General Permit
NCG500000 for discharge of non -contact cooling water, boiler blowdown, and cooling tower
blowdown through Outfall 001. The proposed addition of the process waters (tank and
equipment cleaning, maintenance activities, and operational activities) requires the facility
obtain an individual NPDES Permit. This EAA is for a non —municipal application, process tank
wash downs, non -contact cooling water, boiler and cooling tower blowdown; therefore, the flow
projections are based on engineering design considerations rather than population projections.
A description of the proposed project follows. Projections for flow, evaluation of technical and
financial feasibility, and Local Government Review are provided in later sections.
STEP 1. Background and Project Description
Terracon has reviewed the potential restrictions identified in the EAA guidance document and
do not believe that the identified restrictions will pose an impediment to an NPDES discharge
from this location. The discharge is to an unnamed canal to the Northeast Cape Fear River and
the treated discharge will be well— aerated and is expected to contain significant concentrations

B. Description of Proposed Project
The Wilbara facility presently utilizes a metal basin to collect non -contact cooling tower water,
boiler blowdown and cooling tower blow down. The dimensions of the basin and volume of the
basin are as follows:

Description:
Non -Contact cooling tower water along with boiler and cooler tower blowdowns are presently
collected in the basin. Wilbara proposes to add process wash water associated with tank and
equipment cleaning, maintenance activities, and operational activities to this discharge stream.
The anticipated volume to be added, 3,700 gallons per year or approximately 14.25 gallons per
day (GPD -assumes 260 days per year), is minimal compared to the volume generated from
the non -contact cooling water and blowdown waters — 18,225 GPD (average). Discharge of the
tank/equipment/maintenance cleaning waters will be intermittent with some additions occurring
once every 2.5 (cleaning towers) and 6 years (tank cleanings).
The wastewater is continuously recirculated through a sprayer inside the basin to cool down the
wastewater. The wastewater is continuously sampled for pH content and adjusted accordingly
with sodium hydroxide and/or sulfuric acid to keep the wastewater pH levels between 6.00 and
9.00. Float switches determine the timing of wastewater release to activate the release pump for
discharge to Outfall 001. Information on the automatic pH controller is attached for your
reference. Typical chemicals used in the water for treatment include biocides, corrosion
inhibitors and sodium hydroxide (pH adjustment). Discharge occurs seven days per week and
the discharge is automated based on the level accumulated in the basin.

As described above, the facility is presently permitted to discharge non -contact cooling water
along with boiler and cooling tower blowdown and discharges an average of 18,225 GPD.
These waters are collected in a steel basin where it is recirculated through a surface spray to
cool the water. The basin also has an automated pH controller for continuous pH sampling and
adjustments. The facility cleans and washes out sulfuric acid tanks ever 6 years and also cleans
equipment. The estimated volume to be added to the average discharge of 18,225 gallons per
day is approximately 14.25 GPD as discussed above. Pumping rates for discharge to outfall 001
are 75 gallons per minute (GPM) based on the facilities documented discharge monitoring
events.

D. Low Flow Data for Receiving Stream
Low flow information for the receiving water(s) was obtained from the US Geological Society
(USGS)and the NCDEQ in Raleigh, North Carolina. Correspondence from the agencies is
provided in Attachment A. Generally, the discharge from the basin will be outfall 001 through
underground piping. From the point of discharge, underground piping runs northeast and
discharges to an unnamed canal that flows directly to the Northeast Cape Fear River.
As summarized in the USGS correspondence (copies of the correspondence are including in
the attachments), the USGS South Atlantic Water Science Center (Raleigh office) currently
refrains from providing (or updating previously determined) low -flow estimates for streams
known or suspected of being tidally affected. There are currently no techniques that allow for
quantifying the effects of tides on low flows.
Concerns that tides may possibly reduce low -flow discharges (that is, relative to low -flow
estimates for the same stream not tidally -affected) lead us to speculate that any such estimates
for these streams may be too high. Given the "back-n-forth" flow dynamics associated with tidal
effects, attempting to determine low -flow characteristics based on the assumption of uni-
directional flow characteristics is not meaningful.

STEP 2. Reasonable Projections for Flow
As discussed in the EAA Guidance Document ,non —municipal flow projections are based on
engineering design considerations and/or production projections rather than population
projections. Based on information available from the facility's present discharge of non -contact
cooling water, cooling tower blowdown and boiler blowdown the basin presently has an average
discharge of 18,225 GPD or 0.018225 MGD. With the addition of the tank and equipment
cleaning wash waters (14.25 GPD), the volume will increase to 18,239 GPD or 0.018239 MGD.

STEP3. Evaluate Technologically Feasible Alternatives
As discussed in the EAA Guidance Document, discharges from the basin (non -domestic waste
water) are required to evaluate whether wastewater treatment plant(WWTP) connection , land
application, wastewater reuse, discharge to surface waters, and combinations of the above.
A. Connection to an Existing WWTP
Review of available sewer connection to the local treatment works is not presently available at
the facility; therefore, use of an existing WWTP is not feasible.
B. Land Application
The facility is located at 4620 Hwy 421 N, Wilmington, North Carolina. This location is in a rural
industrial area. The facility is located within the INVISTA property and has a current State
Stormwater Management System (Permit No. SW8 090331) that utilizes an infiltration basin for
stormwater. The basin designed was based on the site specific stormwater drainage areas. The
addition of the non -contact cooling water, boiler and cooling tower blowdown , and tank/process
equipment cleaning waters would exceed the design parameters of the infiltration system.
Based on the design and land constraints and the available land, this application is not feasible
at this time.
C. Wastewater Reuse
The reuse of the wash/cleaning waters, cooling waters and boiler blowdown is not feasible for
the sulfuric acid process due to impurities. Therefore, wastewater reuse is not technically
feasible.
D. Direct Discharge to Surface Waters
Surface water discharge has been determined to be the only technically and economically
feasible alternative for disposal of tank and equipment wash waters that are proposed to be
combined with the non -contact cooling water, and boiler cooling tower blow downs. Generally,
the discharge from the metal basin will be Outfall 001 through underground piping. From the
point of discharge, underground piping runs northeast and discharges to an unnamed canal that
flows directly to the Northeast Cape Fear River. Refer to Exhibit 1 for the location of the facility
in relation to the Northeast Cape Fear River. Exhibit 2 shows the location of Outfall 001 and the
coordinates for the discharge point.

Surface water discharge has been determined to be the only technically feasible alternative for
disposal of tank and equipment wash/cleaning waters along with cooling tower waters and boiler
blowdown. The 20—year, present value cost analysis (PVCA) is, therefore, limited to
assessment of the costs for surface water discharge under a NPDES Individual Permit. The
costs are also limited to those elements specific to the discharge, e.g. operational requirements,
treatment costs, monitoring costs and maintenance. As only one alternative is considered to be
technically feasible, potential lost opportunity costs are considered to be zero. All costs are
outlined, with references, in the enclosed tables and summarized below.

In response to your inquiry about the low -flow characteristics for a location on the Cape Fear River or the
Northeast Cape Fear River in the vicinity of Wilmington in New Hanover County, the following information is
provided:
Visual inspection of the facility location using Google Earth places the point of interest east of Lake Sutton
between the Cape Fear River and Northeast Cape Fear River. Plotting the lat/long coordinates
(34°18'55.78"N, 77°58'26.76"W) provided via your January 10 email indicates a possible point of interest at
the headwaters of a small channel draining towards the Northeast Cape Fear River. Your email mentions
needing the low -flow statistics for the Cape Fear River.
Regardless of the location for the point of interest, both the Cape Fear River and Northeast Cape Fear River
are known to be tidally affected at near the facility location.
The USGS South Atlantic Water Science Center (Raleigh office) currently refrains from providing (or updating
previously determined) low -flow estimates for streams known or suspected of being tidally affected.
There are currently no techniques that allow for quantifying the effects of tides on low flows.
Concerns that tides may possibly reduce low -flow discharges (that is, relative to low -flow estimates for the
same stream not tidally -affected) lead us to speculate that any such estimates for these streams may be too
high. Given the "back-n-forth" flow dynamics associated with tidal effects, attempting to determine low -flow

You will need to contact the NCDEQ Division of Water Resources to obtain further guidance concerning any
efforts to obtain an NPDES permit for a location in a tidally -affected stream. Please note that I have cc:ed Mr.
Klaus Albertin with NCDEQ, who a primary State contact for low -flow requests sent to USGS. I will defer you
to him concerning a member of the staff within the water -quality unit at NCDEQ who can provide you this
further guidance.
I regret this response does not provide the flow statistics you were seeking, but hope this information is
helpful in some manner or at least provides some direction to you in your efforts on this matter.

governments in the issuance of NPDES Permits for non -municipal domestic wastewater treatment facilities.
Specifically, the Environmental Management Commission (EMC) may not act on an application for a new non -
municipal domestic wastewater discharge facility until it has received a written statement from each city and county
government having jurisdiction over any part of the lands on which the proposed facility and its appurtenances are to
be located. The written statement shall document whether the city or county has a zoning or subdivision ordinance in
