Per your phone conversation with Kyle Ketchum Wastewater Plant Superintendent this morning.
This is the requested accelerated permit modification approval for Glenmark Pharmaceuticals
Inc. USA. Glenmark has done extensive testing and believes they can achieve compliance with
the 40 CFR 439.47 limits.
Please find enclosed for your review a copy of IUP No. CM-33 modified pages for Glenmark
Pharmaceuticals Inc. USA facility reflecting a permit modification, for limit changes to 40 CFR
439.47 daily concentration and monthly average. Also included is an updated allocation table,
the SOC executed on June 15, 2020 and SIU cover letter.

Please find enclosed herein pages reflecting the requested modification of Industrial User Permit
CM-33 authorizing Glenmark Pharmaceuticals Inc., USA to continue to discharge process
wastewater to. the City of Monroe sewer system for further treatment at the City of Monroe
Wastewater Treatment Plant through June 30, 2021 and specifying the conditions governing this
discharge. Please replace the old pages of IUP CM-33 with the enclosed, and keep the old pages
on file with current permit. All other pages of CM-33 remain in effect. Please review this permit
carefully in order to meet all requirements.
This IUP modification includes limit changes (daily concentration and monthly average) for
acetone, n-amyl acetate, ethyl acetate, isopropyl acetate and methylene chloride.
The Schedule of Compliance executed June 15, 2020 will be closed out on the effective date of
the permit with approval of the permit modification from NCDWR.
Consistent with the provisions of § 52.051 of the City's Sewer Use Ordinance, the terms and
conditions of this permit are binding upon the industrial user.
§ 52.051 WASTEWATER PERMITS.
(I) Hearings.
(1) Initial Adjudicatory Hearings. An applicant whose permit is denied, or is granted
subject to conditions he deems unacceptable, a permittee/user assessed a civil penalty under §
52.999, or one issued an administrative order under § 52.120 shall have the right to an
adjudicatory hearing before the POTW Director or other hearing officer appointed by the POTW

Director upon making written demand, identifying the specific issues to be contested, to the
POTW Director within 30 days following receipt of the significant industrial user permit, civil
penalty assessment, or administrative order. Unless such written demand is made, within the time
specified herein, the action shall be final and binding and further appeal is barred. For modified
permits, only those parts of the permit being modified may be adjudicated. The hearing officer
shall make a final decision on the contested permit penalty, or order within 45 days of the receipt
of the written demand for a hearing. The POTW Director shall transmit a copy of the hearing
Consistent with the provisions of § 52.051 of the City's Sewer Use Ordinance, the terms and
conditions of this permit are binding upon the industrial user.

SCHEDULE
OF COMPLIANCE
June 11,2020
This Schedule of Compliance replaces the previous Schedule of Compliance dated March 1,
2020 due to Covid-19 complications.
Pursuant to provisions of the City of Monroe Sewer Use Ordinance, this Schedule of Compliance
is made and entered into by Glenmark Pharmaceuticals, Inc. USA hereinafter referred to as
Glenmark, and the City of Monroe, hereinafter referred to as the City. The City and Glenmark
agree to the following:
1. Glenmark located at 4147 Goldmine Road, Monroe, NC, holds Industrial User
Pretreatment Permit CM-33 for discharge of wastewater to the City of Monroe
Wastewater Treatment Plant, NPDES Permit NC0024333.
2. Glenmark has been unable to consistently meet permit limits contained in CM-33.
3. Glenmark has proposed a corrective action plan whereby pretreatment system
improvements will be identified, designed, funded and constructed to provide a long term
solution to meeting all required permit limits.
4. Glenmark will complete activities identified in the corrective action plan to meet permit
limits in accordance with the following milestones:
a. Complete wastewater testing/characterization and engineering design, by October
10, 2020.
b. Submit pretreatment improvement plans and request for Authorization to Construct
by October 17, 2020.
c. Complete and equipment bidding/funding, and vendor selection by November 26,
2020.
d. Complete pretreatment system installation, testing, and commissioning by July 31,
2021.
5. Glenmark shall submit progress reports to the City within 14 days of the completion of
milestones shown above.
6. To assist Glenmark in completing the corrective action plan and to comply with all
conditions of their permit, this Schedule of Compliance is hereby established and will

remain in effect from the execution date until July 31, 2021. During this time period,
Glenmark shall meet and comply with all terms of their current Industrial User
Pretreatment Permit No. CM-33, except as modified by the interim limits and monitoring
requirements specified below:

7. Modification of IUP No. CM-33 permit shall occur after the Authorization to Construct
has been received and approved. Effective July 31, 2021, it is the City's intent to
replace the interim permit limits shown above with daily and monthly limits contained in
40 CFR Part 439, Subpart B.
8. Any violations of the terms of this Schedule of Compliance shall subject
Glenmark to the following penalties:
A. Violation of an interim limit during Schedule of Compliance period;
• $200.00 per violation per day.
B. Failure to meet sampling requirements;
• $100.00 per missed sample
C. Failure to meet schedule milestones;
• $250.00 per day until complete.
9. Once Compliance is achieved, this Consent Order shall terminate and all obligations
hereunder except any obligation to pay identified moneys to the City shall expire. Upon
termination of this Order, Glenmark shall be subject to all terms of the Permit.
10. In the performance of activities under this Consent Order, Glenmark must otherwise
follow the procedures, rules, regulations, ordinances, and statutes of the City, State, and
Federal governments as they may apply. Nothing contained herein shall be construed as a
waiver thereof by the City.
