Johnston Dare County Project setting Dennis Hawthorn with Coastal Area Permit Assistance, on behalf of William N. and Dana L. Johnston, has requested the attached .application be processed under the Express Permit Review Program, for the replacement of a deteriorated bulkhead. The project site is located at 4712 Roanoke Way in the Old Nags Head Cove Subdivision off US 158 (South Croatan Highway) in the Town of Nags Head on Roanoke Sound in Dare County, North Carolina. The site is a 0.14-acre lot and with the exception of the deteriorated bulkhead and an old section of wooden groin (located on the landward side of the bulkhead), is currently undeveloped. The property has 160' of shoreline and is 1100' deep. The breach of the bulkhead has resulted in an eroded escarpment 138' landward of the old bulkhead across the entire property, and a normal water level (NWL) between 5' and 7' landward of the old bulkhead. Vegetation on the site is upland grasses, Spartina patens, pennywort, a few bay and small pines. The soil is sandy and the site is t7' above the NWL. The water on the landward side of the deteriorated bulkhead is less than 6 inches deep and no submerged aquatic vegetation (SAV) is present in this area or within 25' of the sound side of the old bulkhead. Water depth on the sound side of the deteriorated bulkhead is t1' at 25' offshore. The site is bordered on the both sides by developed lots with bulkheads and dwellings. Vegetation on the adjoining properties is lawn grass, ornamental shrubs, and a few small pines. In addition, the property on the upstream (north) side has riprap adjacent the existing bulkhead, a wooden groin, and a platform over the existing riprap. Roanoke Sound in this area is classified SA by the Environmental Management Commission and is open to shellfishing. Project description The applicant proposes to replace the deteriorated bulkhead with a new 160' long bulkhead (wood or vinyl) that will connect to the adjacent bulkheads in a corner to corner alignment. The new bulkhead will average 6' (with a maximum of 7') waterward of the existing NWL on this property but in line with the NWL on the adjoining lots. Backfill of the new bulkhead includes the area landward to the erosion escarpment (160 wide by 138' deep) and totals 12,280 ftZ. Anticipated impacts The project as proposed will result in the filling of 1360 ft2 of sound bottom associated with the installation of the bulkhead. Approximately 1,920 ft2 of uplands will be filled to bring the eroded area back to adjacent grade. The project will result in localized turbidity as a result of the construction activities. David W. PROJECT SUMMARY: The applicant proposes to replace a deteriorated bulkhead in the same alignment, between adjacent existing bulkheads, and backfill to adjacent grade. 13 The Johnston -Shoreline Stabilization Project Narrative The Johnston Project consists solely of the construction of a bulkhead shoreline stabilization structure £t the associated tieback, backfill &t grading work related to the installation of this structure. This new proposed structure replaces a previous structure which was destroyed within the last 5 or 6 years l"t is proposed in the same alignment >:t location as the previous structure. The proposed structure will align with both existing bulkhead structures to the north Ft south on the adjacent riparian properties. The project is located on a vacant lot (Lot 1, Section D) on Roanoke Way in the Old Nags Head Cove Subdivision, directly adjacent to the Roanoke Sound in the Town of Nags Head in Dare County. The property is owned by William Neil Johnston (Neil) &t wife Dana L. JohnsXon. The Johnston's purchased / or were "granted" the property in May of 2005 from the estate of Mark Stanley Hatzopoulos, Sarah H. Johnston ft Kenneth W. Johnston. The adjacent properties are developed with single family residences. Property to the north is owned by C. Reeves Powell, III It the property to the south is owned by Joseph Hatzopoulos. The shoreline was previously stabilized with a bulkhead structure; however, the bulkhead failed in the last 5 or 6 years It was not repaired by the previous landowner, leaving an erosion escarpment along the shoreline that is approximately 38 ft landward of the adjacent shorelines to the north ~ south It approx. 32 ft landward of the current NWL that exists between the two neighboring bulkhead structures. Several pilings £t whaler structure timbers remain along the previous bulkhead alignment. The land elevation of the adjacent properties at the adjacent bulkhead walls is approx. 6 %i ft above the NWL. It is the intent of this application to request a bulkhead shoreline stabilization alignment that is consistent £t aligned with the stabilization structures directly adjacent to the Johnston propertyft along the same alignment as the previous structure, the remnant bulkhead alignment. The proposed bulkhead alignment will extend an average of 6 ft landward of the existing `crescent shaped NWL', a maximum of approximately 7 ft. The backfill- tieback area will be backfilled with clean sand Ft fill material from an off-site location. The old remnant bulkhead wilt be removed prior to the construction of the new structure. The grading area of the site will include an area slightly east of the present escarpment, approx. 43 ft east of the proposed bulkhead alignment. Approx. 2,800 sf of the lot will be disturbed from the proposed development. Approx.- 400 sf of waters that have migrated landward of the old bulkhead alignment will be filled. The Johnston's, who own property next to yours, are in the process of applying for a CAMA Major Permit to replace the previous bulkhead structure which was located along their shoreline. The Johnston's have asked me to notify you in this regard. The purpose of this letter is to fulfill the adjacent riparian property owner not cation permit requirements of the North Carolina Coastal Area Management Act (CAMA or Act). The Act requires that CAMA Major Permit applicants notify their adjacent riparian (waterfront) neighbors in writing by certffied mail to advise them of plans prior to permit issuance to undertake CAMA Permit jurisdictional work & to advise them that, if they wish, they have 30 days from the receipt of this document to offidally comment about the project. Please see the enclosed permit application & bulkhead structure details provided. If you wish, it is requested that you please indicate on the bottom of this letter that you own property adjacent to this project & you do not object to the work proposed.
