The following is a summation of the discussion that occurred and decisions reached at the
meeting described above.
Brian Yamamoto opened the meeting with introductions of the Project Team participants,
PDEA staff involved in the project, and representatives from Earth Tech, the engineering
firm responsible for the project's environmental document and preliminary design. He
noted the status of the project and the prior Merger Concurrence Point approvals.
2. Richard Spencer noted the difference between the calculated mitigable impacts,
specifically that different totals were related to mitigation likely to be required by DWQ
or USAGE, not their jurisdiction. He clarified that all stream impacts cited in the Merger
Team packet were jurisdictional and that the higher impacts, the DWQ totals, would be
those considered in the meeting. The total amount of linear feet of impacts for which
mitigation would be required would be determined at the permit phase. He also noted
that the wetland verification conducted for the project is over five years old and has
expired. Re- verification would be required prior to the permit application, but not before
then, given that the current let date is 2012.
3. Roger Lewis provided an overview of the project status and presented the preliminary
design plans prepared for Alternative 29, the preferred alternative, using PowerPoint and
aerial photography with design overlays provided in the merger team packet. He
identified areas where minimization efforts occurred, including grade separations at
West Chapel Road and Pastureview Road, which minimized community impacts;
perpendicular stream crossings; areas where streams were avoided; bridge locations; a
noise barrier at Twelve Tree Road; and areas inside interchange ramps where stream
impacts were reduced.
4. Chris Militscher asked about the design of the Madison Circle service road, particularly
why it is extended as far to the southeast as proposed. It was explained that the roadway
had to be realigned to accommodate the access control required at the interchange.
Existing Madison Circle parallels Gabriels Creek. There is an elevation difference of over
100 feet between it and existing US 64. The design followed the topographic contours
before aligning in a tangent with another intersecting roadway on the north side of US
64, creating one four - legged intersection.
5. Max Price asked if it was appropriate to credit streams inside interchange loops as
minimization at Concurrence Point 4A. He said they were looking at this issue at
Concurrence Point 4B when more detailed designs were available, as some streams Iose
their functionality due to loss of buffer and grading impacts. Members of the Project
Team agreed that the calculations of impacts should exclude areas inside the
interchanges for Point 4A.
6. Felix Davila asked whether the impacts calculated were based on the right -of -way Iimits
or construction limits. They are based on the construction limits.
7. Chris Militscher stated that the Concurrence Form should list all forms of minimization,
including noise walls and perpendicular crossings, and it should specify that the bridge
over the North Prong Richland Creek is at the Zoo Connector. He also asked that
NCDOT attempt to minimize impacts to the following unnamed tributaries to Squirrel
Creek: SQUI_UT08, SQUI_UT01, and SQUI_UT06 by evaluating the possibility of
shifting the roadway alignment to the east. The NCDOT agreed to attempt to minimize
impacts to these three streams.
8. Richard Spencer noted that the impacts to Taylor Creek by the NC 49 interchange are
substantial. Therefore, a justification for the interchange revision, specifically the semi -
directional ramps and the loops in the southeast and southwest quadrants will be needed
at the permit phase. The semi - directional ramp is needed to accommodate the highest
traffic volumes in the interchange, between westbound US 64 and southbound NC 49
and conversely, northbound NC 49 and eastbound US 64. The loops are needed to
provide full access control and avoid stops signs or signals within the interchange.
9. Gary Jordan noted that another Schweinitz's sunflower survey would be needed prior to
construction. Leza Mundt stated that a commitment to conduct the survey is included in
the FEIS.
10. Gene Nocerino reviewed possible on -site mitigation areas identified by the NCDOT,
including potential stream restoration sites at South Prong Richland Creek, northwest of
the NC 159 Zoo Connector interchange and two sites along North Prong Richland Creek,
one near NC 159 and one east of Business 220. The Department will continue to survey
the area for on -site mitigation potential.

AVOIDANCE AND MINIMIZATION EFFORTS TO DATE:
Bridges were added over Little River, Vestal Creek, and North Prong Richland
Creek (at the Zoo Connector) with minimum lengths totaling 165 feet over each
stream.
The NC 49 interchange design was modified to minimize impacts to Taylor Creek
and two unnamed tributaries in its vicinity. The modified design includes a
grade - separation with NC 49 crossing over the proposed Bypass. This change
resulted in a lower profile from just east of Old NC 49 to near Mack Road. As a
result, fewer overall embankments are needed along the streams in the
interchange area, resulting in less overall linear stream impacts.
Fill slopes were held at 2:1 streams and wetlands along the mainline and at
grade - separations.
Construction limits within and around interchanges were "tightened" to minimize
potential stream impacts.
A noise barrier will be constructed at Twelve Tree Road.
Perpendicular crossings at streams were designed where possible to minimize
stream impacts.
Additional minimization efforts will be considered in accordance with the meeting
minutes.
The Project Team has concurred on this date of MAY 25, 2006 that jurisdictional
impacts have been avoided and minimized to the extent practicable based on
current design information.
