Corey Basinger Water Quality Regional Operations Section Mooresville Regional Office Division of Water Resources, NCDEQ Subject: NOTICE OF VIOLATION Tracking number: NOV-2021-LV-0440 Permit No. NC0075701 City of Albemarle — Tuckertown Water Treatment Plant Stanly County To Whom It May Concern, Thank you for allowing Tuckertown Water Treatment Plant the opportunity to respond to the Notice of Violation dated June 15th, 2021. Our response below is in regard to the daily maximum exceedance of the total copper & TSS concentrations along with the monthly average exceedance of the total copper and TSS concentration violations. Regarding our daily & monthly total copper exceedance levels and the daily & monthly total suspended solids concentration. As reflected in the April 2021 eDMR, Synagro came in during April and removed the buildup of alum residuals from our lagoons. During the alum sludge removal process they require mixing the residuals with any water present in order to remove the alum sludge. We took a subsequent sample on April 30th after the cleaning of the lagoons was completed and both TSS and copper were both back under the daily and monthly average. However the samples from April 13`h combined with the below average sample results from April 30`h skewed the monthly averages resulting in the violation of copper and TSS monthly averages. Due to scheduling conflicts and dissatisfaction with their overall work we are no longer going to use Synagro for our settling lagoon sludge removal. We are going to partner with a company that uses dredging technology to eliminate the need for a tractor to mix and stir up the sludge in order to remove it so we can avoid future potential for non-compliance. We believe that the issue has been taken seriously, and the Tuckertown Water Treatment Plant intends to remain in compliance. The measures being taken we believe to be adequate in resolving these concerns. It is always our goal to adhere to regulations set forth by the Division of Water Resources. The errors that led to this facility's non-compliance have been clearly noted to avoid future non-compliance status. It is our request that our cooperation and action in these matters be taken into account by the Division when enforcement action is taken.
