The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable, report "No Flow," as outlined in Part III, Section Q. Also, please note that Tier 3 Actions in Part II of your permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this permit and do not count prior exceedances. Additional conditions for specific industry sectors have been added to the SPPP requirements in some cases. • Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring that the permittee begin a monthly sampling scheme. • Sections B, C: A lower TSS benchmark of SO mg/I for HQW, ORW, PNA and Tr Waters applies to these more sensitive waters. • Sections B, C. The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other analytical monitoring requirements. • Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined in the "Definitions" section of the permit. • Sections B, C: The term "Representative Storm Event" has been replaced by "Measurable Storm Event." While it may be a fair argument against a locked and closed valve if there is solid assurance the sensor is functional or has some kind of back-up system (and is routinely maintained), how does the company know the sensor is working, and how often do they check for problems? Our advice is to question the reliability of the hydrocarbon sensor and what type of tests and maintenance procedures are in place, and how often. Is there- any.way to test it? How often is, it tested? Do they have a back-up if the system fails? They should provide some more information on reliability to justify a departure from the requirements of the permit. This inspection was conducted as part of a cooperative working agreement between Mecklenburg County and the Division of Water Quality. The facility operates 6:00 a.m. through 11:00 p.m., Monday through Friday and Saturdays as needed. No vehicle maintenance or washing is conducted at the facility but hazardous materials are handled at the facility. Detrex Corporation, Allied Waste, and Nesbit Oil are waste haulers for the facility. Compliance History: The permitteetfacility does not have any prior compliance issues with the NC Division of Water Quality but on September 12, 2007, Masonite Door Corporation was issued a City of Charlotte Notice of Violation for the discharge of approximately 1,000 gallons of liquid Polyol resin to the ground surface. Industrial Operations/CityOperations/City of Charlotte Stormwater Ordinance Review: Eve Wash — One eye wash sink located inside the building near the Line One Foaming Area was plumbed outside to the earthen ground. The permittee shall properly plumb and remove all illicit connections. Baghouse — Particulate material from the baghouse was observed outside on a paved surface. The permittee should routinely inspect and properly maintain the area to prevent stormwater contamination. Paint Totes — Four 300-gallon totes were observed outside on a paved surface and exposed to stormwater. Facility personnel explained that the totes contain leftover paint and are set outside to dry out, then disposed. Dried paint residue was observed on the outside of the totes. The permittee should consider storing the totes in a location not exposed to stormwater. Stormwater Pollution Prevention Plan (cont. from Page 4) The facility houses an outside 12,000-gallon cyclopentane tank that sits within a concrete secondary containment structure. Currently the drain valve for the secondary containment structure is kept open and is actuated by a hydrocarbon monitoring system located inside the sump in the containment area. The facility's SPPP states that the monitoring system and valve.actuator are maintained and tested in accordance with manufacturer's recommendations. During the inspection facility staff explained that standing water inside the containment structure would ruin the sensor on the monitoring system, which is expensive to replace. Chemical research indicates that cyclopentane is a clear chemical compound with a petrol -like odor and a boiling point of 49°C. The facility is in ongoing discussions with the Division of Water Quality to ensure the current system meets the intent of the secondary containment requirements of General Permit NCG030000. The permit states that secondary containment structures are to be controlled by a manually activated valve or other similar devices, which are to be secured closed at all times with a locking mechanism. In addition, the permit requires that accumulated stormwater in the containment area shall be at a minimum visually observed for color, foam, outfall staining, visible sheens and dry weather flows prior to release of the accumulated stormwater. The permittee should provide the Division with details regarding the reliability of the hydrocarbon sensor, the back-up systems in place, the testing and maintenance procedures of the monitoring system and the frequency with which they are completed to justify a departure from the requirements of the permit. Sediment was observed in the outfall with minor erosion observed around the outfall area. The permittee should conduct proper maintenance of the outfall. Storrs Drain Conveyance System - A storm drain ditch had been created to accommodate new storm drain structures on the southeast side of the property near the resin unloading area. Sedimentation and erosion of the ditch was apparent at the time of inspection. The permittee should stabilize and conduct proper maintenance of the storm drain conveyance system. The SPPP was reviewed and updated on 11/29/06, 3/18/08, and 2/16/09 and stormwater facility inspections were conducted on 10/9108, 11/12/08, 12/16/08, 1/20/0909, and 2/19/09. Charlotte, NC 282a6 (704)-921-3430 November 8, 2000 To: Dean Rossi RE: Charlotte 10/30/00, 10/31/00 discharge below Reportable Quantity (RQ) Summary I am writing to inform you of a discharge of mop rinse water containing a citrus solvent degreaser that I became aware; of yesterday, 11/07/00. We have determined through estimation, and taking into account "worst case", that much less than 53 lbs. total of D-LIMONENE, CAS#5989-27-5, Waste NOS: DO01 (ignitable) was discharged in an area adjacent to our west driveway storm sewer on first shift of 10/30/00 and on first shift of 10/31/00. The chemical is paint of ZEP BIG ORANGE Industrial Solvent (citrus) Degreaser and was diluted with water. Because the mixture discharged was primarily water, we do not believe that the mop rinse water was a ignitable waste (DOOI) at the time caf discharge. According to the manufacturers label, this product is " L00% Biodegradable." The spill has not been reported to the NRC, County of Mecklenburg or the State of North Carolina because the quantities of the discharges, separately, or combined, is/are below the CERCLA Reportable Quantity of 1001bs for WASTE NOS: DOOI (as mentioned above, we do not believe that the mop rinse water was a 13001 waste)_ There is no specific RQ for D- LIMONENE. Per my 11/08/00 conversation with Richard Berman of the North Carolina Division of Emergency Management, NCDNR regulation on Reportable Quantities does not differ from federal as it applies to CERCLA. What happened It was brought to my attention 11/07/00 that a degreaser/industrial solvent had been used to clean floors for painting as part of an SPS project. I sought out the project (SPS) manager who informed me that they had disposed of it by dumping it on the driveway and down the drain. He claimed they used less than 15 gallons over the two-day period - "worst case scenario". On 11/08/00 1 received information in greater detail from the end -user, a Maintenance worker assigned to the SPS project. He was the only individual to have used the product on the project. According to him, a thin layer of the BIG ORANGE was applied to the floor with a paintbrush and allowed to soak for a few moments. After soaking, the product was smoothed away to cover the next area to soak in a kind of"recycling" fashion. Then the area would be mopped with water. The worker stated that he filled a 5-gallon bucket 'Afull of BIG ORANGE, three times on 10/30/00, but did not use the entire third and final bucket until 10/31/00. According to the worker, often times the BIG; ORANGE would be dry before the floor was mopped. After the excess had been brushed away to the next floor area to be cleaned, the clean area would then be mopped witfn water. There were 2 buckets each containing 5 gallons of water. The mop was "double rinsed", first in one bucket, then in the second. The water in each bucket was changed out "between 4 and 5 times" throughout the project. It was the mop bucket rinse water that was dumped into the parking lot and into the storm sewer. The Associate then hosed down the area where the mixture was dumped with a % inch garden hose for approximately % hour. The mixtuire flowed out into the center of the drive, into a large pothole and adjacent storm drain. The storm drain leads to an earthen ditch that runs along Ream es Rd. As of 11/09, there were no citrus odors either at the storm drain or earthen ditch, nor were there any visual indicators of contamination. Worst Case Calculations To determine worst case scenario, it was assumed that the associate filled 5 gallon bucket 1/2 full three timer-insteadl of V. full 3 times with BIG ORANGE. This was done to compensate for any error in the Associates judgement of" 1/41 full bucket". Assuming a usage of 7.5 gallons of BIG ORANGE, and based on the MSDS, its' specific gravity of 0.93, and that the product is 1001/9 D-LIMONENE: 2.5(gal)*3(buckets)=7.5 (gal) 7.5* 9.2 lbs/gal *0.85 (spec grav)-- 52.275lbs Worst case scenario = 53lbs were released.
