Dear Mr. McMillion:
On December 24, 1991, the Division of Environmental Management(DEM) received your
letter requesting the NH3 as N limit be dropped from your permit and the original limits be
reinstated.
The division is required to protect the receiving stream from ammonia toxicity. This can be
achieved by establishing either an amonia limit or a toxicity limit. The DEM calculated the
amonia limit of 12.8 mg/I to protect an instream level of 1.0 mg/I in Buffalo Creek. Your
instream waste concentration is 6.0 %. This would be the limit for the toxicity test. Attached for
your use is an information package on aquatic toxicity testing. The DEM chose the NH3 as N limit
based on your compliance data because you could meet the 12.8 mg/I requirement.
The DEM feels that the present permit is sufficient but if you decide the NH3 as N limit is
inappropriate then feel free to contact us 10 modify your existing permit to drop the NH3 as N
limit and to include the toxicity limit.
