9. PROJECT DESCRIPTION:
The project site is located at 970 Mallard Bay Drive, adjacent to a man-made canal, which connects to the
AIWW, in Hampstead, Pender County. To get to the site from Wilmington take US Hwy 17 N to Country Club
Road. Turn right onto Country Club Road, and travel approximately 2.8 miles to Mallard Bay Road. Turn right
onto Mallard Bay Road and follow it approximately 1 mile to a sharp curve to the left. The property is located
on the right after the curve.
The lot is approximately 0.5 acre and the application states the highground portion of the property is elevated
approximately 9 feet above Normal High Water. Vegetation consists of lawn grasses, ornamental trees and
shrubs on the highground. Existing man-made features on the property include asingle-family residence and a
boat basin bordered with rip rap. The coastal wetlands consist of Salt Meadow Hay (Spartina patens), which
form a sparse fringe around the northern side of the boat basin. A few additional patches of S. patens exist along
the upper edge of the basin, but do not appear to be regularly or irregularly flooded. Other species growing at the
edge of the basin include Sea Oxeye (Borrichia frutescens) and Grounselbush (Baccharis halimifolia).
State Permit #125-00 was issued on July 18, 2001 for maintenance dredging of the channel adjacent to Mr.
Nystrom's property. This permit did not authorize dredging within the basin.
The waters of the AIWW adjacent to the project site are classified as SA by the-North Carolina Division of
Water Quality. They are designated. as a Primary Nursery Area (PNA) by the North Carolina Division of
Marine Fisheries, and they are OPEN to the harvest of shellfish.
PROPOSED PROJECT:
The applicant is proposing to construct a new wooden bulkhead around the man-made basin, a boat ramp, pier,
and to perform excavation on his property adjacent to the canal off the AIWW. The bulkhead would measure
28' in length on each the northeastern and northwestern sides of the basin, and would measure 25' in length to
the southwest, with two 10' wingwalls along the canal, on either side of the basin. The applicant proposes to
install the bulkhead 2' waterward of Normal High Water (NHW) along the northwestern side and 4' waterward
of NHW on the northeastern and southwestern sides of the bulkhead. The wingwalls would be installed at
NHW. Furthermore, a 20' in length by 8' in width concrete boat ramp is proposed in the west corner of the
basin, as is a 14' in length by 5' in width fixed pier to the north of the boat ramp. The applicant also proposes
excavation within the boat basin, measuring 28' in length and 28' in width, with a final project depth of -3.5' at
Mean Low Water (MLW). Material would be excavated using a backhoe and the spoil would be placed on the
highground portion of the property behind silt fence and outside of the,30' buffer. The spoil site would measure
30' in length by 30' in width. Approximately 145 cubic yards would be excavated. Once dry, the dredged
material would be used as backfill behind the bulkhead.
10. ANTICIPATED IMPACTS
The boat ramp construction and excavation of the boat basin would disturb approximately 784 ft.2 of shallow
bottom. The dredging operation would likely result in a temporary increase in turbidity. The proposed bulkhead
would result in the filling of approximately 20 square feet of Coastal Wetlands, vegetated sparsely with Salt
Meadow Hay (Spartina patens), and 436 square feet of Estuarine Waters and Public Trust Area. The project

would also result in the disturbance of approximately 2,520 sq. ft. of high ground as the result of
spoil disposal, bulkhead construction, the associated anchor and tie-back system and backfill. The construction
of the boat ramp would result in the filling of 160 square feet of Estuarine Waters and Public Trust Area and the
pier would result in the shading of 70 square feet of open water. The pier would be located entirely within the
basin and would conform to the '/4 width rule.
