application: The existing conditions on site consist of a borrow site for the closed North Wake Landfill. The general land
use in the vicinity of the project is mixed residential, commercial and industrial (i.e. Mallinckrodt Inc.).

The purpose of the proposed project is to construct infrastructure (i.e. roads & utilities) for a planned community park and
future elementary school.

The overall project consists of the construction a planned community park, including but not limited to, ball fields,
multipurpose/football fields, a skate park, restrooms, a comprehensive community center and the infrastructure (i.e.
roads, parking, utilities and stormwater measures). In addition, there is a future elementary school planned at this
site. Specifically, this project will require a road crossing, an offsite sanitary sewer connection, and bypass
channels for stormwater BMP's. Equipment such as bull dozers, bucket loaders, excavators and other typical
equipment used for land disturbance and construction will be utilized for this project.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
S &EC completed a wetland delineation and Neuse River Buffer evaluation for the entire property and the offsite
easement in order to identify natural resources so that the project engineer could design a site plan that would
minimize impacts to the maximum extent practicable. The project is proposing two stream impacts, only one of
which will be permanent and within the project boundaries. The second is within the offsite sanitary sewer
easement which is an existing Force Main easement. The existing Force Main will be removed and replaced with a
sanitary sewer line. There are no proposed wetland impacts. Impacts #1 is a proposed road crossing to access
the property. This road crossing has been redesigned to cross the stream at a perpendicular angle. Retaining
walls have been utilized to minimize impacts to the stream and riparian buffers. Impact #'s 2 & 3 are proposed
bypass channels for stormwater BMPs that are required by the City of Raleigh. Impact #4 is a proposed sanitary
sewer crossing. This crossing is within the existing Force Main Easement therefore the crossing angle was set.
Please note that compensatory mitigation is being proposed for the new parallel Zone 1 riparian buffer impacts (i.e.
2316 ft2) outside of the existing, Force Main Easement. No mitigation is being proposed for the parallel Zone 1
impacts within the existing easement (RE., Buffer InterpretatiorXIarification #2011 -001: Replacing and existing non-
electric utility line within the footprint of the existing maintenance corridor). Impact #'s 5, 6 & 7 are all riparian buffer
impacts for the construction of the sanitary sewer line within and adjacent to the existing Force Main Easement.
Impact #5 includes an additional 74 ft2 of parallel Zone 1 that is included within our compensatory mitigation
proposal.
The applicant is aware of the regional conditions associated with the Nationwide Permits 39. With respect to
institutional development conditions (NWP 39- Regional Conditions section 4.0) the applicant does not anticipate
any impacts to streams or wetlands associated with stormwater facilities, there are no impact associated with
single- family recreation facilities, there are no permanent wetland or stream fills proposed within the
floodway/floodplain and the stream classification for this project is WS -IV; NSW, CA (i.e. not Outstanding Resource
Waters, High Quality Waters, Coastal Wetlands or wetland adjacent to these waters).
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
The project proposes the installation of tree protection and temporary silt fence and other sediment control
measures. The project also has been designed to the minimum design standards to protect the existing features to
the greatest degree possible. All disturbed areas to be reseeded and vegetated.

site stormwater quantity analysis splits the site into four separate drainage areas. The majority of the site, areas "A" B"
and "C" discharge run -off to three channels/streams that leave the eastern margin of the property and enter Bounce
Branch that then discharges into the Neuse River. Best Management Practices control the runoff from these four areas to
detain the post development rates from the 1 yr, 2 yr, and 10 yr 24 hour design storm to pre - development rates and
nitrogen reduction. Area "D" discharges into an existing storm drain system within Durant Road.
Stormwater BMP's are utilized as follows:
Area A: One Detention Wetland; Area B: One Wet Detention Pond and One Detention Wetland; Area C. None; Area D:
None. Proposed BMPs are designed to meet City of Raleigh Stormwater Requirements.

We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and
Isolated Wetlands Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version
2.1. The draft states that publically funded developments may or may not result in cumulative impacts. For
instance, the development of a regional, public park or new library is unlikely to result in cumulative impacts. The
Abbot's Creek Park and Elementary School (E -20) project will be a community park and institutional development.
Additionally, this project is located within City of Raleigh's jurisdiction, therefore the adjacent properties that have
potential for development will have the following regulations to protect downstream waters: 1) Phase II NPDES
Stormwater Permit Program, this program includes permitting requirements for Municipal Separate Storm Sewer
Systems (MS4s) in addition to post - construction stormwater management requirements, 2) the Water Supply,
Watershed Protection Program which limits development densities as well as requires protective riparian buffers,
and 3) the Neuse River Basin Riparian Buffer Protection regulations, these regulations require limited development
within the riparian buffer area in addition to "diffuse flow" requirements at a minimum and could require Best
Management Practices that control nitrogen if diffuse flow cannot be achieved. We anticipate that the DWQ will
advise us if any additional information is needed.
4. Sewage Disposal (DWQ Requirement)
4a. Clearly detail the ultimate treatment methods and disposition (non - discharge or discharge) of wastewater generated from
the proposed project, or available capacity of the subject facility. This property will be connected to City of Raleigh's
Sanitary Sewer System and treatment plant. The City will ensure that capacity of their treatment facility will not be
exceeded.

This document confirms that Phillip D. Stout with Wake County Facilities Design and
Contruction (Applicant) for the Abbot's Creek Park and Elementary School (E -20) Project has
expressed an interest to utilize 7,170 Square Feet of Riparian Buffer Mitigation Credits from
either of the EBX Neuse Riparian Buffer Umbrella Mitigation Bank/Rudolph Site, Forrest Creek
Riparian Buffer Mitigation Bank, and /or the Upper Neuse Buffer Bank located in Neuse -Cedar
Grove Site, all located in HUC 03020201. .
Banker will notify applicant if the 7.170 So. Ft. of Buffer Mitigation become considered "At
Risk" of not being available prior to impact. Credits are not considered secured until payment
in full is received from the applicant resulting in the issuance of a Bill of Sale and Affidavit of
Sale by the bank acknowledging that the applicant has fully secured credits from the bank and
the Banker has accepted full responsibility for the mitigation obligation requiring the
credits /units.
The Banker will issue the Affidavit of Sale within ten (10) days of receipt of the balance of the
Purchase Price. Banker shall provide to Applicant with a copy of the Affidavit of Sale and a
documented copy of the debit of credits from the Bank Official Credit Ledger(s) showing the
permit number and the resource type secured by the applicant. A copy of the Affidavit of Sale,
with an updated Official Credit Ledger will also be sent to regulatory agencies showing the
proper documentation.
