Dear Ms. Higgins:
S &ME, Inc. (S &ME) is submitting this application for proposed impacts to waters of the
U.S. in accordance with North Carolina Division of Water Quality Certification (WQC)
No. 3883 a general certification for projects eligible for U.S. Army Corps of Engineers
( USACE) Nationwide Permit (NWP) 3 for maintenance. S &ME has been retained by
PSNC, the applicant for the proposed project, to provide services related to acquisition of
the NWP and corresponding WQC pursuant to the Clean Water Act. The USACE has
determined that the proposed activities do not require written notification for a NWP 3,
however a courtesy copy will be submitted to Mr. Eric Alsmeyer of the USACE for his
records.
PSNC is proposing to replace approximately 2,600 linear feet of 12 -inch steel natural gas
pipeline with 10 inch steel natural gas pipeline generally south of and paralleling
Lancaster Drive in Chapel Hill, Durham County, North Carolina. The pipeline will be
constructed within an existing maintained 65 -foot wide, cross - country easement owned
by PSNC with a proposed disturbed width of approximately 65 feet. The new 10 -inch
steel gas pipeline will be installed parallel to the existing 12 -inch gas pipeline which will
be abandoned in place. In addition, there will be a valve assembly with approximately
1.200 square feet of impervious surface constructed on an upland portion of the easement
near the eastern terminus of the project.

BACKGROUND INFORMATION
The location of the project area is depicted on the Chapel Hill N.C. (1993) USGS
Topographic Map (Figure 1), the Durham County Soil Survey Map (Figure 2), a Color
Aerial Map (Figure 3) and the Stream & Wetland Impact Map (Figure 4) included in
Appendix II.
The purpose of the proposed project is to allow for internal pipeline inspection per the
Pipeline Hazardous Materials Safety Administration requirements, which cannot be done
on the existing pipeline due to non - conforming pipeline diameter and therefore a new
pipeline with the appropriate diameter is warranted.
S &ME performed wetland and stream delineation services within the existing pipeline
easement in April of 2013. Both the USACE and NCDWQ were contacted for a site visit,
however based on the scope of the project, the fact that all impacts are temporary and
within an existing maintained easement, and proposed impacts are exempt from the
Jordan Lake Riparian Buffer rules, neither agency requested a site visit to confirm our
delineation. Please refer to Appendix III for site photographs of the existing maintained
easement.
PROPOSED PROJECT IMPACTS
As mentioned above, the project will result in temporary impacts only to the wetlands
and stream channels within the existing easement. A temporary travel lane constructed of
large timber mats will be placed along the entire length of the project to allow for
equipment ingress and egress and to serve as a platform for construction activities.
Wetland and stream impacts for the proposed project are included in Figure 4. The
temporary impacts include 78 linear feet of stream channel impact and 2.56 acres of
wetland impact.
PROTECTED SPECIES AND CULTURAL RESOURCES
Protected Species
S &ME's review of potential protected species habitat entailed a literature review of
existing records obtained from federal and state sources to identify documented records
of protected species. The USFWS current list of federally protected species was
consulted for a listing of protected species documented within Orange and Durham

County, North Carolina. This review identified two protected plant species and two
animal species. Listed fauna and flora and their federal status are identified in Table 1.
Explanations of rankings are included at the end of the table.

As part of the literature review, S &ME also consulted the North Carolina Natural
Heritage Program NCNHP Geographic Information Systems (GIS) database Virtual
Workroom and Element Occurrence (EO) Database for a listing of EO's of endangered or
threatened species within or near the project area. This review did not identify EO's
pertaining to federally protected species within a two -mile radius of the project area.
Cultural Resources
S &ME reviewed the NC Historic Preservation Office (NCSHPO) GIS web service
( HPOWEB - http: / /gis.ncdcr.gov/hpoweb/) to identify previously recorded historic
resources in the vicinity of the project area and none were identified.
AVOIDANCE AND MINIMIZATION
This project is located within the 100 -year Federal Emergency Management Act (FEMA)
Floodplain and as such all equipment will be located on high ground outside of the
floodplain each day after the completion of construction activities, no refueling will be
allowed within the floodplain, wetlands, or adjacent to streams, and no imported fill
material will be stockpiled in the floodplain.
Stream crossings will be conducted using the open -cut trench method. A double row of
silt fence spaced two feet apart and placed parallel to the stream will be used at the
crossing to reduce the potential for sediment reaching the stream. Coffer dams will be
constructed upstream and downstream of the crossing, and the contractor should conduct
the crossing "in the dry". The contractor will either use a pump to dewater the workspace
and bypass clean water around both coffer dams or install a flume to convey clean water
through the workspace. Sediment laden water from dewatering the workspace will be
discharged in an upland area and filtered through a sediment bag. Bypassed water will be

released downstream of the crossing and filtered through sediment bags to reduce the
amount of sediment in pumped water.
The stream crossing will be made perpendicular to the stream to the fullest extent
practical. Disturbed stream banks and bottom shall be restored to pre - construction
conditions to the fullest extent practical. Temporary matting and permanent seeding will
be used to stabilize disturbed stream banks following construction. A double row of silt
fence spaced two feet apart and placed parallel to the stream will be installed following
the open -cut crossing to reduce the potential for sediment reaching the stream. The
native riparian seed mix specified in Table 2 below shall be utilized.

Recommended application rate: 20 -25 Ibs per acre
Wetland areas will be crossed using the open -cut trench method. Prior to pipeline
construction, two rows of silt fence spaced two feet apart shall be installed perpendicular
to the construction easement 5 feet from the wetland area to minimize potential
disturbance to the wetland. This silt fence may be removed only during construction
activities associated with the wetland crossing.
No wastes, spoils, solids or fills will be placed within wetlands, waters or riparian areas
beyond the limits of those depicted on the drawings. The wetland crossing shall be
restored to original contours, to the extent practical, once construction is completed.
Temporary matting (crane mats), or similar methods, will be used to cross wetland areas
during construction. Based on locations in the field, hay bales or wattles may be installed
parallel to the spoils piles to help prevent sediment from leaving the disturbed area and
entering adjacent undisturbed wetland areas.
Following construction, two rows of silt fence spaced two feet apart shall be installed
perpendicular to the construction easement at the wetland crossing to minimize potential
disturbance to the wetland. Disturbed areas associated with temporary wetland crossings

will be stabilized with a native seed mix following construction (see Table 3). This seed
mix will be installed to provide immediate coverage of disturbed soil, and will cover the
disturbed wetlands from the jurisdictional boundary extending five feet landward.

Several temporary bridges will be installed to cross jurisdictional streams along the
proposed access road for the Lancaster Drive section of the project. The bridges will
reduce the potential for temporary impacts to the streams being crossed. Crane mats, or
some similar item, will be installed to create a temporary access road through wetland
areas at the western end of the Lancaster Drive section of the project.
Appropriate sediment and erosion control practices outlined in the most recent version of
the "North Carolina Sediment and Erosion Control Planning and Design Manual' will be
in compliance with specifications governing the proper design, installation, operation and
maintenance of such Best Management Practices (BMP's) to comply with the appropriate
turbidity water quality standard. Sediment and erosion control measures placed in waters
will be removed and the original grade restored within two months after the Division of
Land Resources has released the project. Impacts have been avoided and minimized, and
appropriate measures will be taken during construction to allow flow and circulation
patterns of waters of the U.S. to remain unaffected. After construction, disturbed areas
will be seeded and restored.

D. Impact Justification and Mitigation
1. Avoidance and Minimization

The new gas line will parallel the old gas line as close as possible in order to minimize impacts to jurisdictional features within
the existing maintained 65 foot deeded easement. Construction will take place in summer months (June, July) so the wetland
areas should not be as wet as they would be in the winter. The existing pipeline will be abandoned in place instead of being
removed which will further minimize impacts.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
Large timber mats will be used to bridge all streams and create a travel lane for construction equipment ingress and egress,
as well as for a construction platform in wetlands. Equipment will not be stored within 100 feet of any jurisdictional wetland or
stream, or within the 100 -year floodplain. No refueling will take place within any jurisdictional area or within the 100 year
floodplain. Stream crossings will be conducted using the open -cut trench method. A double row of silt fence spaced two feet

Wetland areas will be crossed using the open -cut trench method. Prior to pipeline construction, two rows of silt fence spaced
two feet apart shall be installed perpendicular to the construction easement 5 feet from the wetland area to minimize potential
disturbance to the wetland. This silt fence may be removed only during construction activities associated with the wetland
crossing.
No wastes, spoils, solids or fills will be placed within wetlands, waters or riparian areas beyond the limits of those depicted on
the drawings. The wetland crossing shall be restored to original contours, to the extent practical, once construction is
completed. Temporary matting (crane mats), or similar methods, will be used to cross wetland areas during construction.
Based on locations in the field, hay bales or wattles may be installed parallel to the spoils piles to help prevent sediment from
leaving the disturbed area and entering adjacent undisturbed wetland areas.
