The moratorium was based upon a review of your self -monitoring reports, which indicated flow at the subject facility exceeded the 80% threshold of the current treatment capacity for calendar year 2020. Subsequent to your receipt of the moratorium, Chuck Baxley with the Fayetteville Public Works Commission (FPWC) contacted the Division indicating that FPWC has been working towards expansion of the Rockfish Creek WWTP to 28 MGD since 2018. Based on a review of the information submitted to the Division, the Fayetteville Public Works Commission has met the requirements of 15A NCAC 02T .0118, "Demonstration of Future Wastewater Treatment Capacities". The Division hereby lifts the sewer line moratorium imposed against the Fayetteville Public Works Commission — Rockfish Creek WWTP for exceeding the 80% threshold of the current treatment capacity. Please note that future moratoriums may still be imposed for exceeding 90% threshold of the current treatment capacity or if the facility demonstrates it is unable to sufficiently treat the volume of wastewater entering the facility.
