The Division of Water Resources has received the January 18, 2016 request for approval of a
Pretreatment Program. The Town of Biscoe has successfully completed the required activities
established by the Division's Pretreatment, Emergency Response and Collection Systems
(PERCS) Unit for the development of a Division of Water Resources approved Pretreatment
Program. With consideration of the successful completion of the required activities and the public
comments received on the delegation request, the Pretreatment Program for the Town of Biscoe
is approved as of June 6, 2016.
Your NPDES permit contains pretreatment program requirements in Part IV (Special Conditions
for Municipal Facilities) under Section D (Pretreatment Programs) that are an important and
enforceable part of your Delegated Pretreatment Program.
The Town of Biscoe's Pretreatment Program is considered to be a Modified Pretreatment
Program. Modified Pretreatment Programs must send in a Pretreatment Annual Report (PAR) or
call to schedule a meeting with the Division's Pretreatment Staff by March 1st of every year. The
compliance status for each industrial user must be judged for each six-month period (January 1
— June 30 and July 1 — December 31), and appropriate enforcement actions initiated in
accordance with the Enforcement Response Plan approved by the Division.

The Pretreatment, Emergency Response, and Collection Systems (PERCS) Unit of the Division
of Water Resources has reviewed the Industrial Waste Survey (IWS) for the Town Biscoe. The
IWS was received by the Division on May 31, 2016, via email in support of the Town's
pretreatment program development.
The review indicates that the IWS is adequate and meets the minimum requirements of 40 CFR
403.8 (f) (2). Proper completion of an Industrial Waste Survey is required by Part III (B) of your
NPDES permit.
Please remember it is the responsibility of the POTW to implement ongoing activities to ensure
that any Significant Industrial Users (Sills), as defined by NCAC. 15A 2H .0903(b)(34), are
identified and subsequently added to the local pretreatment program. Please see chapter 3 of
the Comprehensive Guidance for North Carolina Pretreatment Programs for more information on
IWS requirements. The next updated IWS summary is due on April 1, 2020, unless conditions
at the POTW change significantly and thus warrant an earlier submittal.

The Pretreatment, Emergency Response, and Collection Systems (PERCS) Unit of the Division of
Water Resources has reviewed the Design/Site Specific Headworks Analysis (HWA) for the Town
of Biscoe WWTP, submitted by LKC Engineering on behalf of the Town. The HWA was received
by the Division on December 3, 2014, in reference to the development of the Town's Pretreatment
Program.
The Division .concurs with the HWA calculations for all pollutants of concern, with the
corrections outlined below. These approved Maximum Allowable Headworks Loadings
(MAHLs), Maximum Allowable Industrial Loadings (MAILs)., and the basis for these values are
found on the last page of the enclosed HWA spreadsheet, which has the corrections marked.
The results of the-HWA.aretalso listed in..the bottom section of the enclosed Allocation Table.
1) Changes to the HWA Approved Today: Please feel free to contact PERCS if you have any
questions about the changes outlined below. All corrected spreadsheets were emailed to you
for your files, and other corrected documents, if necessary, were faxed. Please ensure the
POTW's paper and electronic HWA, AT, and other supporting documents _ contain these,
corrected documents, especially the Allocation Table. As needed, please mark any original
documents as "replaced" or "voided."
a) Pass -Through and Design Loading Calculations:
i) Removal Rates:. PERCS updated the removal rates for.ammonia, chromium, copper,
and zinc based on site specific DMR/STMP data (See attached).
ii) Action Level Parameters: Copper, silver, and zinc are Actioln Level (AL) parameters.
Stream standards for these parameters are not required to be used in the HWA unless
the POTW is failing the Whole Effluent Toxicity (WET) due to these parameters.
iii) Design Criteria: PERCS chose not to use multiplier of 1.5 to BOD and TSS design
criteria this time as the VVVVTP has had NPDES limits violations within the past two
years. We can review this option during the next HWA calculations.
b) Uncontrollable Loadings: Since there are no Sills currently discharging wastewater to the
WWTP, PERCS chose to use averageinfluentconcentrations as uncontrollable
concentrations where sampling data is available.

2) Allocation Table: For future planning, PERCS estimated an average of 100,000 gallon/day of
process wastewater from the industry (Per email from Consultant). We also estimated average
BOD and TSS as 200 mg/I and 20 mg/I. Please remember these are estimates only. . We
noted that mercury shows over allocation on the AT. This is due to all BDL mercury data using
method 245.1. We will revisit this issue next time we review HWA.
3) HWA Due Date: The HWA was developed and approved today is based on DMR/STMP data
for the period • of January 2012 through October 2014 along with design/literature data.
Currently, PERCS will not issue a due date for the next HWA submission. Once, the POTW
receives Division approval for the implementation of Pretreatment Program and starts
accepting wastewater from the industry, we will evaluate the due date.

Draft industrial user permits (IUPs) and applications .
The majority of the following comments have been conveyed to the Town's consultant, Mr. Bill
Lester, Jr., P.E., via email or telephone and several items have already been addressed.
1 .The Attorney's Statement is acceptable.
2 Updated HWA is adequate. The HWA was initially approved by PERCS on February 20,
2015. The updated allocation table may change depending on the IUP limits. At this time,
there is no set due date to submit the next HWA.
3 Sewer Use Ordinance (SUO): The SUO is adequate and meets the requirements of 15A
NCAC 2H .0900. An adoption date of August 11, 2014 has been noted in our database.
4 Short Term Monitoring Plan (STMP): STMP needs to be updated and resubmitted as
discussed with Mr. Lester.
5 The ERP is adequate and meets the requirements of 15A NCAC 2H .0900.
6 Resources description is adequate.
7 Draft IUPs: Under review.
8 Industrial Waste Survey (IWS): Please submit summary narrative of on -going waste survey
procedures along with completed IWS checklist. Please review the IWS materials on the
"Industrial Waste Survey" and "Training" pages of the PERCS web -site for more information.

Resources has reviewed the Industrial User Pretreatment Permits (IUPs) submitted by the Town's

effectively control and document the discharge of wastewater from Significant/Categorical
Industrial Users to the POTW. It is the POTW's responsibility to ensure that these objectives are
consistently met.

The Pretreatment, Emergency Response, and Collection Systems (PERCS) Unit of the Division
of Water Resources has reviewed the Short Term Monitoring Plan (STMP) for the Town Biscoe.
The STMP was initially received by the Division on January 18, 2016 via email in support of the
Town's pretreatment program development, followed by corrections received on April 22, 2016.
The review indicates that the STMP is adequate and meets the requirements needed to establish
a site -specific Headworks Analysis (HWA). Proper implementation of an STMP is also required
by Part IV (C) of your NPDES permit.
1) STMP Data Summary: Comprehensive Guide, Appendix 4-8. Sample collection and
laboratory analysis must be done as outlined in this STMP. It is also very important to organize
and summarize your data. Example STMP data summary forms can be found on our website
(web address listed in footer of this letter) or on disc by request, and also in the
Comprehensive Guide.
2) Division Review of Data: As your STMP data is accumulated, organized, and analyzed, the
Division may request to review tabulated data and to see chain of custody forms and
laboratory data sheets.
3) STMP Modifications: Interpretation of monitoring data or changes in operation at your POTW
may indicate that the STMP needs to be modified; however, please be aware that
modifications to your STMP must be approved by the Division.
