Narratives Charlotte Water 4222 Westmont Dr, Charlotte, NC 28217 Charlottewdter,org Operated by the City of Charlotte 2020 Narratives Charlotte Water - System Protection Sugar Creek WWTP 5005 Allied Metal Finishing The SIU was not in SNC for the January to June 2020 reporting period. The SIU was not in SNC for the July to December 2020 reporting period. The annual inspection was conducted on 08/12/2020. Allied Metal Finishing was a recipient of the CLTWater Environmental Excellence Gold Award for 2019. 0097 ALSCO, Inc. The SIU was not in SNC for the January to June 2020 reporting period. During the SIU's first quarter monitoring event, the total daily Flow was recorded using the incorrect meter, invalidating the data for all flow and mass -based limited parameters. This error was recognized during data review in mid -March 2020. Due to COVID-19 related shutdowns during that time, the SIU suspended all process operations at the facility as of 03/20/2020. Compliance Monitoring was required to be conducted within 30 days of commencement of discharges. The SIU commenced operations on 06/20/2020 and conducted compliance monitoring in the third quarter. The SIU was not in SNC for the July to December 2020 reporting period. The annual inspection was conducted on 09/03/2020. ALSCO, Inc. (0097) was a recipient of the CLTWater Environmental Excellence Silver Award for 2019. 5009 A.O. Smith Corporation The SIU was not in SNC for the January to June 2020 reporting period. The SIU discharged a slug of Oil and Grease on 01/30/2020 at a concentration of 410 mg/I, which is 3.4 times the permit limit of 120 mg/I. An NOV with a civil penalty of $200.00 was issued on 04/13/2020. The slug was not considered SNC due to the compliance history of the SIU and because there was no impact to the POTW. The penalty was added to their bill on 04/27/2020. 1 The SIU discharged a slug of Oil and Grease on 05/12/2020 at a concentration of 420 mg/I, which is 3.5 times the permit limit of 120 mg/I. An NOV with a civil penalty of $500.00 was issued on 06/30/2020. The slug was not considered SNC due to the compliance history of the SIU and because there was no impact to the POTW. The penalty was added to their bill on 08/04/2020. The SIU was not in SNC for the July to December 2020 reporting period. The SIU conducted TTO analysis in the first and second quarters. The SIU filed TTO certifications in lieu of monitoring in the third and fourth quarters. The annual inspection was conducted on 11/05/2020. 0003 Barnhardt Manufacturing Company The SIU was not in SNC for the January to June 2020 reporting period. The SIU was not in SNC for the July to December 2020 reporting period. This permit was renewed on 08/01/2020 and will be effective until 07/31/2025. The CBOD limit was increased per the SIU's request and available allocation. The lead limit was removed based on historical data. The SIU did not conduct a self -monitoring event in October. During the first attempt at monitoring, the third -party laboratory did not collect the correct samples, and therefore abandoned the sampling event and rescheduled sampling for the last week of the month. When that sampling event began, it was determined that the flow meter was not functioning, therefore sampling could not be conducted. A single pH reading was recorded. This was recorded as a reporting violation and compliance monitoring was conducted in November, and there were no violations. The annual inspection was conducted on 08/28/2020. 0642 Cargill, Inc. The SIU was not in SNC for the January to June 2020 reporting period. During the SIU's first quarter self -monitoring event, three CBOD results were rejected due to greater -than values. Compliance monitoring was conducted in February, and there were no violations. The SIU was not in SNC for the July to December 2020 reporting period. During the Control Authority's third quarter monitoring event, one day of composites was missed due to a keypad error on the flow meter. 2 The SIU discharged a slug of Oil & Grease on 10/23/2020 at a concentration of 290 mg/I, which is 2 times the permit limit of 144 mg/I. The SIU was issued an NOV on 12/24/2020 with a civil penalty of $100.00. This slug was not considered SNC as there was no impact observed. The penalty was paid in full on 01/15/2021. The annual inspection was conducted on 07/24/2020. 0493 Charleston Spar Inc. The SIU was not in SNC for the January to June 2020 reporting period. The SIU was closed from 03/26/2020 until 05/26/2020 due to COVID-19. The SIU filed a no discharge certification, and no self -monitoring was performed during the second quarter. The SIU was not in SNC for the July to December 2020 reporting period. The SIU was issued an NOV with a civil penalty of $100.00 on 08/13/2020 for a late flow meter calibration. Calibration was completed 43 days past the 6-month requirement. The amount was paid in full on 8/28/2020. The SIU is required to send flow meter calibration reports within ten days of each calibration until 11/30/2021. The SIU filed TTO certifications in lieu of monitoring. The annual inspection was conducted on 08/25/2020. Charleston Spar Inc. was a recipient of the CLTWater Environmental Excellence Gold Award for 2019. 0170 Hardcoatings, Inc. The SIU was not in SNC for the January to June 2020 reporting period. The SIU was not in SNC for the July to December 2020 reporting period. The SIU filed the required TTO certifications in lieu of monitoring. The annual inspection was conducted on 07/21/2020. Hardcoatings, Inc. was a recipient of the CLTWater Environmental Excellence Gold Award for 2019. 5012 Haz—Mat Environmental Services, LLC The SIU was in SNC for the January to June 2020 reporting period. 3 The SIU was issued a Compliance Order (CO) on 08/07/2019 due to the SIU discharging non -representative wastewater while monitoring was being conducted. The CO required the SIU to hire a third -party lab to sample for all permitted parameters every day wastewater is discharged until 60 days after all activities in the CO are completed. The SIU was also required to create SOPs for the operation of their wastewater treatment system as well as perform COD tests with a Hach meter of all incoming treated wastewaters. The SIU also had to contract with an NC Certified Engineer to conduct the activities listed in the CO, which included performing a treatability study of the wastewater treatment system. The SIU was granted an increased, mass -based cBOD limit for the duration of the CO. An NOV with a civil penalty of $25,000.00 was issued on 08/27/2019 for the manipulation of sampling and non -representative industrial waste discharge. This violation was considered SNC. Cost recovery was also issued on 08/27/2019 in the amount of $52,946.19. The cost recovery was for unpaid COD surcharges, staff time investigating, lab analysis costs, and sampling costs. The SIU filed an appeal of the civil penalty and cost recovery on 09/10/2019. The Control Authority held an informal review meeting with the SIU on 10/01/2019. The SIU did not submit any new information to prove manipulation did not occur, but the SIU did want to emphasize their cooperation with the Control Authority. The SIU requested a payment plan if there was no reduction in the penalties. On 01/15/2020, the Control Authority issued a response to the informal review of the NOV with civil penalty and cost recovery. There was no reduction in the penalty, but the Control Authority allowed the SIU to split the NOV and cost recovery into three payments. The SIU accepted the response on 01/27/2020. The civil penalty of $25,000 was added to the SIUs water bill on 02/10/2020. The first cost recovery payment of $27,946.19 was added to the SIUs water bill on 03/09/2020, and the second cost recovery payment of $25,000.00 was added to the SIUs water bill on 04/03/2020. The SIU submitted a request for an Authorization to Construct on 12/30/2019 as part of their CO. The SIU was issued an Authorization to Construct on 01/15/2020. The ATC was for wastewater treatment upgrades including adding a pH sensor for their batch tank and ability for the batch tank to bypass the DAF unit. These were the recommendations of the contracted North Carolina Professional Engineer that the SIU hired as required by the CO. The SIU has completed the construction. The SIU was issued an NOV with a civil penalty of $200.00 on 04/13/2020 for a Lead slug on 01/21/2020 at 1.3 mg/I (7.56 times the permit limit of 0.172 mg/I). These violations were not classified as SNC because no issues within the collection system or the WWTP were associated with these discharges. The $200.00 penalty was applied to their bill on 04/27/2020. 4 The SIU was issued an NOV with a civil penalty of $500.00 on 06/04/2020 for a Lead slug on 02/11/2020 at 1.4 mg/I (8.14 times the permit limit of 0.172 mg/I). These violations were not classified as SNC because no issues within the collection system or the WWTP were associated with these discharges. The $500.00 penalty was applied to their bill on 06/19/2020. The SIU was issued an NOV with a civil penalty of $1,000.00 on 06/01/2020 for Lead slugs during their self -monitoring on 03/12/2020 at 2.6 mg/I (15.11 times the permit limit of 0.172 mg/I) and 03/13/2020 at 2.8 mg/I (16.27 times the permit limit), and also on the Control Authority's monitoring data on 03/12/2020 at 2.3 mg/I (13.37 times the permit limit) and 03/13/2020 at 2.3 mg/I (13.37 times the permit limit). These violations were not classified as SNC because no issues within the collection system or the WWTP were associated with these discharges. The SIU found the customer that was causing the Lead violations and stopped accepting waste from them. This was the last waste stream that they received from that customer, and the SIU had no further Lead violations in 2020. The $1,000.00 penalty was applied to their bill on 06/19/2020. The Compliance Order was terminated on 06/01/2020; a permit modification was issued on this date, and all items of the compliance order were completed. The permit was modified on 06/01/2020 and is effective until 12/31/2022. The cBOD limit was increased at the request of the SIU and converted to a pounds per day limit. Quarterly TTO monitoring and a limit were added. Several special conditions were added to help with tracking of waste streams being treated by the SIU and associated reporting to the Control Authority. The SIU was not in SNC for the July to December 2020 reporting period. The SIU was issued an NOV with a civil penalty of $200.00 on 11/16/2020 for Cyanide and Molybdenum slugs that occurred 08/29/2020. The Cyanide was 0.56 mg/I (4.67 times the permit limit of 0.12 mg/I), and the Molybdenum was 7.0 mg/I (3.35 times the permit limit of 2.09 mg/I). These violations were not classified as SNC because no issues within the collection system or the WWTP were associated with these discharges. The $200.00 penalty was applied to their bill on 12/16/2020. The SIU was issued an NOV with a civil penalty of $1,500.00 on 01/13/2021 for Molybdenum slugs on 09/29/2020 at 13 mg/I (6.22 times the permit limit of 2.09 mg/I), on 10/01/2020 at 19 mg/I (9.09 times the permit limit), and 10/02/2020 at 19 mg/I (9.09 times the permit limit). These violations were not classified as SNC because no issues within the collection system or the WWTP were associated with these discharges. The SIU discovered the source of the Molybdenum and no longer accepts the waste for treatment. The $1,500.00 penalty was applied to their bill on 01/27/2021. The annual inspection was conducted on 12/04/2020. 5 The SIU was published in April 2020 for being under the Compliance Order that was issued in 2019; they will not be published again per NCDEQ guidance that SIUs are not required to be published multiple times for the same violation. 0649 Norfolk Southern Railway - Charlotte Roadway Shop The SIU was not in SNC for the January to June 2020 reporting period. The SIU was not in SNC for the July to December 2020 reporting period. During the Control Authority's third quarter monitoring event, one day of composite samples was unable to be collected due to no flow. The annual inspection was conducted on 07/22/2020. Norfolk Southern Railway was a recipient of the CLTWater Environmental Excellence 4th Year Platinum Award for 2019. 5016 Orbit Energy The SIU was not in SNC for the January to June 2020 reporting period. The SIU was issued an NOV with a civil penalty of $400.00 on 04/20/2020 for Ammonia slugs on 02/11/2020 at 998.96 Ibs/day (2.49 times the permit limit of 400 Ibs/day), 02/12/2020 at 641.28 Ibs/day (1.6 times the permit limit), 02/13/2020 at 650.84 Ibs/day (1.62 times the permit), and 02/14/2020 at 666.59 Ibs/day (1.66 times the permit limit). All were classified slugs for exceeding the permit limit by more than 15% of the MAIL at the Sugar Creek WWTP; 15% of the MAIL is 240 Ibs/day, making the slug criteria 640 Ibs/day. These violations were not classified as SNC because no issues within the collection system or the WWTP were associated with these discharges. The penalty was applied to their bill on 04/27/2020. The SIU was issued an NOV with a civil penalty of $750.00 on 06/30/2020 for Ammonia slugs on 03/10/2020 at 732.08 Ibs/day (1.83 times the permit limit of 400 Ibs/day) and 03/11/2020 at 845.17 Ibs/day (2.11 times the permit limit). These violations were not classified as SNC because no issues within the collection system or the WWTP were associated with these discharges. The penalty was applied to their bill on 07/21/2020. The SIU was not in SNC for the July to December 2020 reporting period. The SIU was issued an NOV with a civil penalty of $750.00 on 10/13/2020 for Phosphorus slugs on 07/07/2020 at 102.91 Ibs/day (1.37 times the permit limit of 75 Ibs/day) and 07/08/2020 at 112.09 Ibs/day (1.49 times the permit limit). All were classified slugs for exceeding the permit limit by more than 15% of the MAIL at the Sugar Creek WWTP; 15% of the MAIL is 25.8 Ibs/day, making the 6 slug criteria 100.8 Ibs/day. These violations were not classified as SNC because no issues within the collection system or the WWTP were associated with these discharges. The penalty was applied to their bill on 11/02/2020 During a review of industry data it was found that the SIU has missed their Molybdenum and Selenium quarterly monitoring requirements that were added in the SIU's 2019 permit renewal. The SIU's lab did not add it to their collection schedule. Enforcement actions are pending. The annual inspection was conducted on 10/23/2020. 5003 Rohm and Haas Chemicals, LLC A Wholly Owned Subsidiary of the Dow Chemical Company The SIU was not in SNC for the January to June 2020 reporting period. Self -monitoring was not conducted in June due to facility closure. The SIU was not in SNC for the July to December 2020 reporting period. No monitoring was conducted in the third or fourth quarter of 2020 due to facility closure. Rohm and Haas Chemicals, LLC ceased manufacturing operations at their Charlotte facility in August 2019. Wastewater discharge from cleaning and decommissioning activities continued until June 2020. The closing inspection was performed on 07/16/2020 and a request to drop the permit was sent to NCDEQ on 07/31/2020. Approval of this request was received on 08/26/2020. Rohm and Haas, LLC, was a recipient of the CLTWater Environmental Excellence Silver Award for 2019. 5010 Southeastern Metal Products, LLC The SIU was not in SNC for the January to June 2020 reporting period. Self -monitoring and Control Authority monitoring were conducted in the first quarter only for this SIU. During the Control Authority's sampling event Mercury was not analyzed; therefore, this pollutant of concern was not sampled at this site in 2020. An oil and grease violation occurred during the Control Authority's monitoring event; compliance monitoring was not conducted due to the closure of the company. The SIU ceased operations on 04/15/2020. Charlotte Water was notified of the SIU's closing on 04/08/2020. At this time Charlotte Water was not performing industrial inspections due to COVID-19 restrictions. During a phone call on 04/24/2020, the primary contact at Southeastern Metals indicated that he would be working on site until July 2020. Charlotte Water resumed conducting inspections in July and contacted Southeastern Metals to schedule a closing inspection. Charlotte Water was informed that the property was sold on 07/01/2020 and the company was liquidated. We were therefore unable to perform a closing inspection. Our Customer Service Division confirmed that the account for the property is now assigned to the new owner. A request to drop the permit was sent to NCDEQ on 08/25/2020. The Control Authority received a formal notification that this request was approved on 01/05/2021. The SIU filed the required TTO certification in lieu of monitoring in the first quarter. 0498 Unifirst Corporation The SIU was not in SNC for the January to June 2020 reporting period. The SIU was not in SNC for the July to December 2020 reporting period. The annual inspection was conducted on 08/27/2020. 5015 Wind River Environmental Services dba L & L Environmental Services (formerly L & L Environmental Services, LLC) The SIU was not in SNC for the January to June 2020 reporting period. The SIU was not in SNC for the July to December 2020 reporting period. The permit was modified on 09/01/2020 to reflect the ownership and name change that occurred in 2019. No other changes to the SIU have taken place. The SIU did not discharge during the fourth quarter of 2020, so no self - monitoring or Control Authority monitoring occurred. The annual inspection was conducted on 07/13/2020. 8 Irwin Creek WWTP 1020 AERC Acquisition Corporation d/b/a DART, A Clean Earth Company Pipe 001 The SIU was in SNC for the January to June 2020 reporting period. The SIU was in SNC due to the issuance of a Compliance Order (CO) by the Control Authority, effective 04/24/2019, which expired on 12/31/2020. The SIU did not discharge any metal -bearing waste from their facility in 2020, therefore no monitoring was conducted at Pipe 001. The SIU was in SNC for the July to December 2020 reporting period. Pipe 002 The SIU was in SNC for the January to June 2020 reporting period. The SIU was in SNC due to the issuance of a CO by the Control Authority, effective 04/24/2019, which expired on 12/31/2020. The SIU was issued an ATC on 02/12/2020 for the installation of a new carbon filtration system and effluent holding tanks. The SIU and the Control Authority entered into a Settlement Agreement on 03/28/2020. The agreement acknowledged that AERC Acquisition Corporation d/b/a DART, A Clean Earth Company would pay the Control Authority the sum of $100,500.00 in connection with five NOVs issued related to the Compliance Order, and the sum of $181,299.53 in connection with the Assessment of Cost Recovery related to the costs of investigating the facts underlying the NOVs. As a result of the settlement agreement, an NOV issued on 08/27/2019 was amended and re -issued on 04/03/2020. This NOV was for non -representative self -monitoring from April through November of 2018; it included a civil penalty of $25,000.00 and was considered SNC. In the settlement agreement the SIU also agreed to pay the four remaining NOVs that were issued on 08/27/2019. These NOVs included one for multiple slug discharges which occurred during the second week of December 2018 with a civil penalty of $25,000.00, one for multiple slug discharges which occurred during the third week of December 2018 with a civil penalty of $25,000.00, one for multiple slug discharges which occurred in January 2019 with civil penalty of $25,000.00, and one for exceeding the 33% TRC threshold for the parameter of p-cresol during the January to June 2019 Compliance Judgement Period with a civil penalty of $500.00. Each of these NOVS included designation of SNC. 9 AERC Acquisition Corporation d/b/a DART was also issued a Cost Recovery Letter on 08/27/2019 for the time frame of April 2018 to January 2019. The Cost Recovery included unpaid COD surcharges, System Protection staff time, investigation laboratory analysis for both in-house and subcontracted analysis, and extra sampling and analysis performed by the Control Authority at the SIUs monitoring point. A Cost Recovery total of $181,299.53 was assessed. The penalties and Cost Recovery, totaling $281,799.53, were paid on 04/10/2020. On 05/26/2020, the SIU delivered a request for a modification to the deadlines for Activities 7b., 7c., and 8 of the CO due to several contractor/vendor scheduling and delivery delays as a result of weather and the COVID-19 pandemic. The modification was granted on 06/04/2020. On 07/30/2020, the SIU delivered a request for a modification to the deadlines for Activities 7b. and 8 of the CO to complete the installation of the remaining ancillary equipment for full operation of the new pretreatment equipment. The modification was granted on 08/13/2020. The SIU was in SNC for the July to December 2020 reporting period. During the Control Authority's 09/09/2020 monitoring event, no organic parameters were collected. During the SIU's 11/13/2020 self -monitoring event, Mercury was not analyzed due to a laboratory error; a reporting violation was recorded. On 12/31/2020, the CO automatically expired with the SIU having completed all Activities contained within. A modified IUP became effective on 01/01/2021. The annual inspection was conducted on 09/14/2020. The SIU was published in April 2020 for being under the CO that was issued in 2019; they will not be published again per NCDEQ guidance that SIUs are not required to be published multiple times for the same violation. 3024 ALSCO, Inc. The SIU was not in SNC for the January to June 2020 reporting period. The SIU was not in SNC for the July to December 2020 reporting period. The annual inspection was conducted on 09/03/2020. 10 0060 Aramark Uniform Services, Inc. The SIU was not in SNC for the January to June 2020 reporting period. The SIU discharged a slug of Lead on 11/19/2019 at 0.73 Ibs/day, which is 3.3 times the permit limit of 0.22 Ibs/day. The SIU was issued an NOV on 01/21/2020 with a civil penalty of $750.00. This slug was not considered SNC as there was no impact to the POTW. The penalty was paid in full on 1/31/2020. The SIU was issued an NOV on 01/21/2020 with a civil penalty of $200.00 for greater than 33% TRC violations of Zinc and Lead during the July to December 2019 reporting period. The penalty was paid in full on 02/12/2020. The SIU was not in SNC for the July to December 2020 reporting period. The annual inspection was conducted on 07/14/2020. 1003 Carolina Foods, Inc. The SIU was not in SNC for the January to June 2020 reporting period for Pipe 001, Pipe 002, and Pipe 003. The SIU was not in SNC for the July to December 2020 reporting period for Pipe 001, Pipe 002, and Pipe 003. The annual inspection was conducted on 07/23/2020. 0665 Charlotte Pipe and Foundry Company The SIU was not in SNC for the January to June 2020 reporting period. Oil and Grease was collected as a surrogate for TTO for first and second quarter SIU self -monitoring. During the Control Authority's second quarter monitoring event, one day of composite samples were unable to be collected due to sampling equipment issues. The SIU was not in SNC for the July to December 2020 reporting period. Charlotte Pipe and Foundry Company was issued an ATC on 07/14/2020 for the construction of a second E-Coat system with auxiliary waste treatment equipment. The SIU conducted its annual pond drop event from 08/24/2020 to 08/26/2020. 11 During the Control Authority's third quarter monitoring event, one day of composite samples was unable to be collected due to sampler programing issues. This permit was renewed on 11/01/2020 and will be effective until 10/31/2025. Multiple updates, due to the addition of a second E-Coat line and resulting increased process flow, included an updated pretreatment equipment list, and revised permit limits based on categorical regulations and local limits. Oil and Grease was collected as a surrogate for TTO for third and fourth quarter SIU self -monitoring. The SIU filed all required TTO certifications. The annual inspection was conducted on 08/26/2020. Charlotte Pipe and Foundry Company was a recipient of the CLTWater Environmental Excellence Gold Award for 2019. 1002 Chematron, Inc. The SIU was not in SNC for the January to June 2020 reporting period. The SIU was not in SNC for the July to December 2020 reporting period. This permit was renewed on 10/01/2020 and will be effective until 9/31/2025. No major changes were made to the permit. The annual inspection was conducted on 07/09/2020. Chematron, Inc. was a recipient of the CLTWater Environmental Excellence Silver Award for 2019. 1007 Chesapeake Treatment Company The SIU was not in SNC for the January to June 2020 reporting period. During the Control Authority's second quarter monitoring event, one day of composite samples was missed. The sampler did not collect sufficient aliquots. The SIU was in SNC for the July to December 2020 reporting period. This permit was modified on 08/01/2020 and will be effective until 07/31/2021. The Phosphorous monitoring frequency changed from monthly to quarterly due to an increase in allocation available at the Irwin WWTP. 12 The SIU discharged a slug of CBOD on 11/10/2020 at f 14,114.68 Ibs/day, which is 9.87 times the limit of 1430 Ibs/day. No impacts were observed; however, the slug was considered SNC as the amount discharged was 50% of the MAIL and presented a potential for pass -through. An NOV will be issued in 2021. The annual inspection was conducted on 07/09/2020. The SIU will be published. 3007 Cintas Corporation #200 The SIU was not in SNC for the January to June 2020 reporting period. The permit was modified on 02/01/2020 and is effective until 11/31/2021. The permit was modified to reflect the basin change to Irwin Creek WWTP from McAlpine Creek WWTP resulting from re-routing of the collection system. No other changes were made. The SIU was not in SNC for the July to December 2020 reporting period. During the Control Authority's third quarter monitoring event, only 3 days of composites were collected due to not enough aliquots on one day. The annual inspection was conducted on 07/29/2020. Cintas #200 was a recipient of the CLTWater Environmental Excellence Gold Award for 2019. 0429 DyStar Carolina Chemical The SIU was not in SNC for the January to June 2020 reporting period. This permit was modified, effective 01/01/2020 through 09/30/2020, due to a rerouting of the collection system placing the SIU in the Irwin Creek WWTP basin. To reflect the allocation available at Irwin Creek WWTP, the monitoring frequencies for Cadmium, Chromium, and Phosphorus were changed from quarterly to monthly. During the Control Authority's second quarter monitoring event, only one day of composites and two days of grabs were able to be collected due to no flow. The SIU was not in SNC for the July to December 2020 reporting period. During the SIU's August self -monitoring event, one day of composite samples was rejected due to insufficient aliquots. 13 This permit was renewed on 10/01/2020 and will be effective until 09/30/2025. All organic limits, as well as Lead and Zinc were calculated based on updated production information and OCPSF categorical limits. Cyanide was not included as a limited parameter due to there being no cyanide -bearing processes at the SIU. The monitoring frequency for Phosphorus was changed back from monthly to quarterly. The SIU discharged Toluene on 04/14/2020 at a concentration of 5.1 mg/I, which is 3.75 times the EPA Gas/Vapor Toxicity Screening Level of 1.36 mg/I. The SIU also discharged a slug of Oil and Grease on 04/16/2020 at a concentration of 230 mg/I, which is 2.3 times the permit limit of 100 mg/I. The SIU was issued an NOV on 08/05/2020 with a civil penalty of $1,100.00. This slug was considered SNC due to violation of prohibited discharge standards. The penalty was paid on 09/18/2020. The NOV also required a report to be submitted, determining the cause of the violations and the possible source(s). This was submitted to System Protection 08/29/2020. In the report, the SIU was unable to find the source of Toluene, however, the importance of following the heel collection program was reviewed with employees. The SIU was in SNC due to exceeding the 33% TRC threshold for TTO's during the first reporting period (out of 2 CJPS for TTO's, 1 was a TRC violation, which is 50%). An NOV with a civil penalty of $100.00 was issued 08/24/2020. The penalty was paid on 09/18/2020. The SIU was not in SNC for the July to December 2020 reporting period. The annual inspection was conducted on 07/24/2020. The SIU was published in the Charlotte Business Journal on 10/16/2020. 3022 Express Container Services The SIU was not in SNC for the January to June 2020 reporting period. The SIU was not in SNC for the July to December 2020 reporting period. 14 The annual inspection was conducted on 07/24/2020. 1015 Generics Bidco II, LLC, dba Prinston Laboratories (formerly Prinston Pharmaceuticals, Inc.) The SIU was in SNC for the January to June 2020 reporting period. During the SIU's first quarter self -monitoring event, one day of Cyanide was rejected due to a high detection limit and a reporting violation was issued. Resampling was conducted in February, and there were no violations. During the Control Authority's first quarter monitoring event, one day of composites was missed due to not enough volume collected. During the SIU's second quarter self -monitoring, three days of Cyanide, one day of Ethyl Acetate, and one day of Isopropyl Acetate were rejected due to high detection limits and a reporting violation was issued. Resampling was conducted in July, and there were no violations. The SIU discharged Toluene on 05/05/2020 at a concentration of 4.6 mg/I, which is 3.38 times the EPA Gas/Vapor Toxicity Screening Level of 1.36 mg/I. The SIU was issued an NOV on 08/13/2020 with a civil penalty of $1,000.00. This slug was considered SNC due to violation of prohibited discharge standards. The penalty was paid in full on 09/09/2020. The NOV also required a report to be submitted, determining the cause of the violations and the possible source(s). This was submitted to System Protection on 09/08/2020. In the report, the SIU determined the cause of the violation to be from the use of paint thinner. The SIU explained that this is not a common practice and that provisions are now in place to limit the purchase and distribution of paint thinner. Any use of paint thinner will also not be used in proximity to floor drains. During the SIU's fourth quarter self -monitoring, TTO's were rejected due to a high detection limit and a reporting violation was issued. Resampling was conducted in January 2021, and there were no violations. The SIU was not in SNC for the July to December 2020 reporting period. The annual inspection was conducted on 10/28/2020. The SIU was published in the Charlotte Business Journal on 10/16/2020. 3031 Greenway Waste Solutions The SIU was not in SNC for the January to June 2020 reporting period. 15 The permit was modified, effective 03/01/2020 until 08/31/2020, due to a rerouting of the collection system placing the SIU in the Irwin Creek WWTP basin. The SIU was not in SNC for the July to December 2020 reporting period. During the Control Authority's third quarter monitoring event, the PCB data was rejected because of elevated reporting limits. The annual inspection was conducted on 10/07/2020 Greenway Waste Solutions was a recipient of the CLTWater Environmental Excellence Silver Award for 2019. 0117 Independent Beverage Company The SIU was not in SNC for the January to June 2020 reporting period. The SIU was not in SNC for the July to December 2020 reporting period. The SIU discharged a slug of Oil and Grease on 11/18/2020 at a concentration of 870 mg/I, which is 3.6 times the permit limit of 240 mg/I. An NOV with a civil penalty of $300.00 was issued on 02/05/2021. The slug was not considered SNC due to the compliance history of the SIU and because there was no impact to the POTW. The annual inspection was conducted on 07/23/2020. Independent Beverage Company was a recipient of the CLTWater Environmental Excellence Silver Award for 2019. 1024 Liquid Environmental Solutions of Georgia, LLC. The SIU was not in SNC for the January to July 2020 reporting period. The SIU was in SNC for the July to December 2020 reporting period. During the Control Authority's third quarter monitoring event, one day of composites was unable to be collected due to a power failure for the sampler. The SIU discharged a slug of Oil and Grease on 11/04/2020 at a concentration of 2700 mg/I, which is 9 times the permit limit of 300 mg/I. This slug was considered SNC due to the magnitude of the violation and the observed buildup of Oil and Grease in the downstream lines indicating a chronic problem with the potential to damage/adversely impact the POTW. The SIU will also be required to evaluate their BMPs and submit a report identifying remedies to prevent future buildup from occurring. An NOV will be issued in 2021. 16 The annual inspection was conducted on 07/22/2020. The SIU will be published. 1021 NCG-ERC, LLC The SIU was not in SNC for the January to June 2020 reporting period. The SIU discharged a slug of Arsenic on 10/08/2019 at 0.297 Ibs/day, which is 9.31 times the permit limit of 0.03 Ibs/day. The SIU discharged slugs of Cyanide on 10/09/2019 at 0.343 Ibs/day, which is 9.2 times the permit limit of 0.038 Ibs/day, and again on 11/08/2019 at 0.118 Ibs/day, which is 3.1 times the permit limit. An NOV with a civil penalty of $320.00 was issued for these slugs on 01/15/2020. These slugs were not considered SNC because there was no observed impact to the POTW. The penalty was paid by check on 01/31/2020. The SIU did not discharge during 2020 due to facility closure, therefore no monitoring was conducted. The SIU ceased operation on 11/21/2019. A closing inspection was performed on 12/06/2019. A request was sent to NCDEQ to drop the permit on 01/03/2020, and approval was received on 02/05/2020. The SIU was not inspected in 2020 as the facility was not in operation and the closing inspection was completed in 2019. 0121 Pan-Glo Charlotte The SIU was not in SNC for the January to June 2020 reporting period. During the Control Authority's second quarter monitoring event, one day of composite samples and two days of grab samples were missed due to insufficient flow. The SIU was not in SNC for the July to December 2020 reporting period. During the fourth quarter Control Authority monitoring, only three days of oil and grease were reported because the one day's sample did not meet the preservation requirement. During the same sampling event one day of composite samples was missed due to insufficient aliquots collected. During a review of industry data, it was found that the SIU has missed their Chromium and Nickel quarterly monitoring requirements that were added in the SIU's 2019 permit renewal. The SIU's lab did not add it to their collection schedule. Enforcement actions are pending. The annual inspection was conducted on 08/13/2020. 17 Pan-Glo was a recipient of the CLTWater Environmental Excellence Silver Award for 2019. 3009 Quala Services, LLC This SIU was not in SNC for the January to June 2020 reporting period. This permit was modified effective 01/01/2020 due to the rerouting of the collection system, which now places Quala Services in the Irwin WWTP basin instead of McAlpine WWTP. The limits for Molybdenum and Selenium were both reduced due to the allocation available at Irwin WWTP. The SIU was not in SNC for the July to December 2020 reporting period. The annual inspection was conducted on 07/09/2020. Quala Services, LLC, was a recipient of the CLTWater Environmental Excellence Silver Award for 2019. 0125 Trane Charlotte The SIU was not in SNC for the January to June 2020 reporting period. The SIU was not in SNC for the July to December 2020 reporting period. The SIU was issued an ATC on 11/20/2020 for a new filter press and an additional sludge tank. The SIU conducted TTO analysis in the first quarter and filed the required TTO certifications in lieu of monitoring in the second, third, and fourth quarters. The annual inspection was conducted on 08/11/2020. Trane Charlotte was a recipient of the CLTWater Environmental Excellence Silver Award for 2019. 1026 Total Clean of North Carolina, LLC The SIU was not in SNC for the January to June 2020 reporting period. The SIU was issued an ATC on 07/17/2020 for a new pretreatment system to include: a sump pit, influent strainer, two equalization tanks, an oil water separator, flash/floc mixing system, inclined plate clarifier, sludge holding tank, filter press, and a flow measurement device. The SIU was in SNC for the July to December 2020 reporting period. 18 The SIU was issued a new permit effective 10/04/2020 through 09/30/2022. The permit was issued in compliance with 40 CFR 442.16 and all other lawful standards and regulations. The SIU discharged Toluene on 11/10/2020 at 1.7 mg/I, in violation of Part III.F of their permit and in violation of the Prohibited Discharge Standards in Section 23- 79 of the SUO as it exceeds the EPA Gas/Vapor Toxicity Screening Level of 1.36 mg/I. An NOV with a civil penalty of $1,000.00 was issued on 02/05/2021. Also, the SIU was required to submit a report identifying the cause of the violation and to review the existing plans and procedures in place. The discharge was considered SNC because of the violation of Prohibited Discharge Standards. The annual inspection was conducted on 07/07/2020. The SIU will be published. 1009 Trimac Transportation dba National Tank Services The SIU was not in SNC for the January to June 2020 reporting period. The SIU discharged a slug of Zinc on 10/09/2019 at a concentration of 3.1 mg/I, which is 4.4 times the permit limit of 0.70 mg/I. The SIU was issued an NOV on 01/09/2020 with a civil penalty of $500.00. This slug was not considered SNC as there was no impact to the POTW. The penalty was added to the SIU's water bill on 1/16/2020. The SIU discharged a slug of Zinc on 02/06/2020 at /a concentration of 2.9 mg/I, which is 4.1 times the permit limit of 0.70 mg/I. The SIU was issued an NOV on 04/20/2020 with a civil penalty of $600.00. This slug was not considered SNC as there was no impact. The penalty was added to the SIU's water bill on 04/27/2020. The NOV also required a report to be submitted, determining the cause of the violations and the possible source(s). This was submitted to System Protection on 04/28/2020. In the report, the SIU determined the customer that was the cause of the Zinc violation and explained how they will prevent this from happening again by training employees to go through SDSs more thoroughly. The SIU was not in SNC for the July to December 2020 reporting period. The annual inspection was conducted on 07/16/2020. 19 McAlpine Creek WWTP 0352 Aplix, Inc. The SIU was not in SNC for the January to June 2020 reporting period. The SIU was not in SNC for the July to December 2020 reporting period. The annual inspection was completed on 10/26/2020. 3010 Arjobex America, Inc. The SIU was not in SNC for the January to June 2020 reporting period. During the Control Authority's second quarter monitoring event, only three days of composites were collected due to a defective communication cable. The SIU was not in SNC for the July to December 2020 reporting period. The annual inspection was conducted on 08/21/2020. 3028 Bakkavor Foods USA, Inc. The SIU was not in SNC for the January to June 2020 reporting period. This permit was modified on 02/01/2020 and will be effective until 07/31/2021. The modification includes an increased Flow MGD limit at the request of the SIU, the establishment of a Flow GPM limit, and an updated pretreatment equipment list including the addition of a DAF pretreatment system and associated equipment. The SIU discharged a slug of Oil and Grease on 04/21/2020 at a concentration of 551 mg/I, which was 2.75 times the permit limit of 200 mg/I. The SIU was issued an NOV with a civil penalty of $1,000.00 on 08/13/2020. Due to the relatively low-level concentration of the slug and this instance being the first slug discharge since completing construction of a pretreatment facility, the Tier 7 violation was assessed at a reduced amount and was not considered SNC. The penalty was added to the SIU's water bill on 09/23/2020. The SIU was not in SNC for the July to December 2020 reporting period. The annual inspection was conducted on 11/23/2020. 3016 Brenntag Mid -South, Inc. The SIU was in SNC for the January to June 2020 reporting period. 20 The SIU discharged a slug of Total Toxic Organics on 01/10/2010 at 106.61 mg/I, which is 21.3 times the permit limit of 5 mg/I. The SIU discharged 62.1 mg/I of Chloroform, therefore it is also in violation of the Prohibited Discharge Standards in Section 23-79 of the SUO as it exceeds the EPA Gas/Vapor Toxicity Screening Level of 0.41 mg/I. An NOV with a civil penalty of $1,500.00 was issued on 04/13/2020. The slug was not considered SNC due to the compliance history of the SIU and because there was no impact to the POTW. It was also noted that Chloroform is not part of the facility's chemical inventory. The penalty was paid in full on 04/27/2020. Also, the SIU was required to submit a report identifying the cause of the violation and to review the existing plans and procedures in place. The SIU submitted a report on 04/16/2020, identifying the accidental introduction of solvents into their waste stream as the cause of the slug. The SIU put plans in place to ensure the proper segregation of waste chemicals and the use of dedicated hoses. The SIU discharged a slug of Phosphorus on 04/24/2020 at 71.36 Ibs/day, which is 10.98 times the permit limit of 6.5 Ibs/day. An NOV with a civil penalty of $1,000.00 was issued on 06/15/2020. The slug was not considered SNC because there was no impact to the POTW. The penalty was paid in full on 07/10/2020. Also, the SIU was required to submit a report identifying the cause of the violation and to review the existing plans and procedures in place. The SIU submitted a report on 06/26/2020, identifying the accumulation of Phosphorus bearing solids in the bottom of the pretreatment pit as the cause of the slug. The SIU put plans in place to have the solids in the pretreatment pit evacuated every three months. The SIU discharged a slug of CBOD on 05/06/2020 at 8200 mg/I, which is nine times the permit limit of 909 mg/I. An NOV with a civil penalty of $250.00 was issued on 07/01/2020. The slug was not considered SNC due to the compliance history of the SIU and because there was no impact to the POTW. The penalty was paid on 08/06/2020. The SIU was issued an NOV on 08/13/2020 with a civil penalty of $100.00 for greater than 33% TRC violations of TTO during the January to June 2020 reporting period (out of 3 CJPs for TTO; 1 was a TRC violation, which is 33.3%). This violation is considered SNC. The penalty was paid in full on 09/09/2020. The SIU was not in SNC for the July to December 2020 reporting period. The permit was modified on 11/01/2020 and is effective until 01/31/2023. At the request of the SIU the Phosphorus, Chromium, and Nickel limits were increased. The annual inspection was conducted on 08/07/2020. The SIU was published in the Charlotte Business Journal on 10/16/2020. 21 3014 Charlotte Plating, Inc. The SIU was not in SNC for the January to June 2020 reporting period. The SIU was not in SNC for the July to December 2020 reporting period. The annual inspection was conducted on 12/03/2020. 3019 Cintas Corporation #99K The SIU was not in SNC for the January to June 2020 reporting period. COD analysis from the Control Authority's monitoring on 06/12/2020 was removed due to D.O. depletions being inconsistent and none of the dilutions met the 2:1 ratio. The SIU was not in SNC for the July to December 2020 reporting period. During the Control Authority's third quarter monitoring event, one day of composites was rejected due to sampling being less than 22 hours. The annual inspection was conducted on 08/14/2020. Cintas #99K was a recipient of the CLTWater Environmental Excellence Gold Award for 2019. 0370 Duff -Norton The SIU was not in SNC for the January to June 2020 reporting period. During the Control Authority's second quarter monitoring, one day of grab samples was not collected because sampling personnel ran out of the sampling bottles needed. The SIU was not in SNC for the July to December 2020 reporting period. The SIU filed the required TTO certifications in lieu of monitoring. The annual inspection was conducted on 08/11/2020. Duff -Norton was a recipient of the CLTWater Environmental Excellence Silver Award for 2019. 22 0618 Frito-Lay Incorporated The SIU was not in SNC for the January to June 2020 reporting period. During the Control Authority's first quarter monitoring, a CBOD sample was reported as a greater -than value. This sample result was rejected. This permit was renewed on 05/01/2020 and will be effective until 04/30/2025. The pretreatment equipment list was amended and Chromium monitoring was added. The SIU was not in SNC for the July to December 2020 reporting period. During the SIU's August and September self -monitoring, it was discovered that their flow meter was recording erroneous flow measurements. The flows and subsequent mass -based pollutant monitoring were discarded. The annual inspection was conducted on 08/27/2020. Frito-Lay Incorporated was a recipient of the CLTWater Environmental Excellence Silver Award for 2019. 0505 Huntsman International, LLC The SIU was not in SNC for the January to June 2020 reporting period. The SIU was not in SNC for the July to December 2020 reporting period. This permit was renewed on 10/01/2020 and will be effective until 09/30/2025. There were no major changes made to the permit. The annual inspection was conducted on 07/14/2020. Huntsman International, LLC, was a recipient of the CLTWater Environmental Excellence Gold Award for 2019. 0500 IGM Resins USA The SIU was not in SNC for the January to June 2020 reporting period. The SIU had an accidental discharge of biological waste sludge due to a sludge removal pump failure on 02/17/2020. IGM was issued an NOV on 04/13/2020 with a civil penalty of $300.00. This was not considered SNC as there was no impact to the POTW. The penalty was added to the SIU's water bill on 04/27/2020. The SIU was not in SNC for the July to December 2020 reporting period. 23 The annual inspection was conducted on 11/17/2020. 3030 Index, Inc. The SIU was not in SNC for the January to June 2020 reporting period. During the Control Authority's first quarter monitoring event several organics were discarded due to matrix interference which caused higher detection levels. A greater -than CBOD value was also discarded on 03/12/2020. The SIU was issued an Authorization to Construct on 03/13/2020. The ATC was for wastewater treatment upgrades including adding waste neutralization with a pH adjustment tank, an organics separator, three new holding tanks, and a pH logger. The SIU is still completing upgrades. There have been delays due to COVID-19. The SIU was issued an NOV with a civil penalty of $100.00 on 04/13/2020 for an Oil & Grease slug on 02/06/2020 at 1000 mg/I (3.33 times the permit limit of 300 mg/I). These violations were not classified as SNC because no issues within the collection system or the WWTP were associated with these discharges. The penalty was applied to their bill on 04/27/2020. The SIU was not in SNC for the July to December 2020 reporting period. The SIU was issued an NOV with a civil penalty of $500.00 on 08/13/2020 for an Oil & Grease slug on 03/13/2020 at 1000 mg/I (3.33 times the permit limit of 300 mg/I). These violations were not classified as SNC because no issues within the collection system or the WWTP were associated with these discharges. The penalty was paid on 09/09/2020. The permit was modified on 05/01/2020 and is effective until 07/31/2021. This was a permit modification at the request of the Permittee. The Oil and Grease limit was converted to a pounds per day limit until completion of wastewater treatment upgrades from the Authorization to Construct issued on 03/13/2020. Monitoring frequency was increased to monthly until completion. This change was made to help prevent violations while continuing to protect the POTW while the SIU completes wastewater treatment upgrades during the COVID-19 pandemic. The Control Authority conducted downstream CCTV to confirm that Oil and Grease had not been building up in the sewer lines. The SIU was issued an NOV with a civil penalty of $500.00 on 10/13/2020 for failure to monitor as required by their permit. The SIU missed 4 days of Oil and Grease sampling in July due to a miscommunication with their lab. They made up the sampling in August. These violations were not classified as SNC due to no financial gain. The penalty was paid on 10/26/2020. 24 The SIU was issued an NOV with a civil penalty of $1,000.00 on 11/05/2020 for an Oil & Grease slug on 08/12/2020 at 455.8 Ibs/day (3.03 times the permit limit of 150 Ibs/day). These violations were not classified as SNC because no issues within the collection system or the WWTP were associated with these discharges. The penalty was applied to their bill on 12/11/2020. During the SIU's November self -monitoring event, composite sampling on 11/10/2020 was rejected due to samples being taken over a 27-hour period instead of 24 hours as required by the permit. The SIU collected extra samples the following week due to sampler errors on 11/12/2020 and 11/13/2020. This was in order to fulfill the 4 consecutive discharge days requirement for most samples. However, all Semi -volatile Organic Compounds (625s) were only collected on 11/10/2020 due to their one -day monitoring requirement. Since the 11/10/2020 composite samples were rejected, and it was the only day the Semi - volatile Organic Compounds were collected, a reporting violation was issued. All other parameters were collected as required by the permit. Extra flow data and Cyanide samples were collected due to extra sampling days during this event as well. The SIU completed the compliance monitoring on 01/08/2021. The SIU was issued two Authorizations to Construct on 11/25/2020. The first ATC was for replacing the current flume and flow meter with an ISCO Signature bubbler flow meter and an Extra Large 60-degree Trapezoidal Flume. The request was submitted on 11/06/2020, and the installation is expected to be completed in the first quarter of 2021.The second ATC was for an electromagnetic flowmeter and an actuator to better control flow through their treatment system. The request was submitted on 11/17/2020, and the installation was completed on 12/07/2020. The annual inspection was conducted on 10/26/2020. 3017 Masonry Reinforcing Corporation of America dba Wire -Bond The SIU was not in SNC for the January to June 2020 reporting period. The SIU was not in SNC for the July to December 2020 reporting period. The SIU did not discharge in 2020, therefore no self -monitoring or Control Authority monitoring was conducted. The SIU ceased discharge on 12/18/2019, and the Pipe 001 discharge line was severed. A closing inspection was performed on 07/15/2020. All waste is now being hauled offsite and the user has been added to our zero -discharge program. A letter was sent to the NCDEQ requesting to drop the permit on 08/20/2020, and approval was received on 09/16/2020. The annual inspection was conducted on 07/15/2020. 25 Wire -Bond was a recipient of the CLTWater Environmental Excellence Silver Award for 2019. 3021 Mecklenburg Co. Foxhole Landfill 521 The SIU was not in SNC for the January to June 2020 reporting period. This Permit was renewed on 03/01/2020 and will be effective until 2/28/2025. The flow was increased from 0.15 MGD to 0.20 MGD at the request of the industry. A TTO limit was added. Silver was added for monitoring only since the POTW has limited allocation. During the Control Authority's second quarter monitoring event, only three days of composite samples were collected due to sampling equipment issues. Only one day of cBOD samples were collected during this event due to sampling tech oversight. The SIU was not in SNC for the July to December 2020 reporting period The annual inspection was conducted on 08/25/2020. Mecklenburg County Foxhole Landfill was a recipient of the CLTWater Environmental Excellence 9th Year Platinum Award for 2019. 0515 Pelton & Crane The SIU was not in SNC for the January to June 2020 reporting period. The SIU was not in SNC for the July to December 2020 reporting period. The SIU filed the required TTO certifications in lieu of monitoring. During the Control Authority's fourth quarter monitoring, one day of composites was missed due to flow meter error. The annual inspection was conducted on 12/11/2020. Pelton & Crane was a recipient of the CLTWater Environmental Excellence Gold Award for 2019. 3027 Safe Fleet The SIU was not in SNC for the January to June 2020 reporting period. The SIU was not in SNC for the July to December 2020 reporting period. The SIU filed the required TTO certifications in lieu of monitoring. 26 The annual inspection was conducted on 8/12/2020. Safe Fleet was a recipient of the CLTWater Environmental Excellence Gold Award for 2019. 0368 Siemens Energy, Inc. Pipe 001 The SIU was not in SNC for the January to June 2020 reporting period for Pipe 001. Pipe 001 was dropped from the permit on 04/01/2020; Control Authority monitoring and self -monitoring occurred in the first quarter only. Mercury was not collected by the Control Authority during the 2020 reporting period. Pipe 002 The SIU was not in SNC for the January to June 2020 reporting period for Pipe 002. This permit was modified on 04/01/2020 and will be effective until 8/31/2021. Per request of the Industry, Pipe 001 was dropped from the permit after a water balance study conducted by a 3rd party environmental engineering and consulting firm showed that only 5 gallons of process water flows through Pipe 001 daily. Monitoring frequencies at Pipe 002 were decreased to one batch per 12 months from the Control Authority and one batch per 3 months by the SIU due to decreased usage of the nickel -plating process and a resultant decrease in flow. The SIU was not in SNC for the July to December 2020 reporting period for Pipe 002. Pipe 002 is a batch discharge; Siemens Energy, Inc. did not discharge during the January to June 2020 compliance period or the July to December 2020 compliance period, therefore no self -monitoring or Control Authority monitoring was conducted. The SIU filed the required TTO certifications in lieu of monitoring. The annual inspection was conducted on 12/08/2020. 0364 S-L Snacks NC, LLC The SIU was not in SNC for the January to June 2020 reporting period. 27 The SIU was not in SNC for the July to December 2020 reporting period. The annual inspection was conducted on 08/05/2020. S-L Snacks NC, LLC was a recipient of the CLTWater Environmental Excellence Silver Award for 2019. 3029 Union County The SIU was not in SNC for the January to June 2020 reporting period for Pipe 001, Pipe 002, Pipe 003, Pipe 004, and Pipe 005. The SIU was issued a permit on 01/13/2020 with an effective date of 02/01/2020. The SIU appealed the permit on 01/28/2020. As part of the appeal process, an Informal Review was held with the SIU on 03/05/2020. The SIU sought clarification and challenged several permit conditions. The administration of fees and charges was also discussed. An additional meeting was held on 07/14/2020 to address outstanding issues, including the administration of fees and charges. As a result of the appeal, the permit was modified on 08/01/2020 and is effective until 01/31/2025. The modification included an addition made in the Special Conditions to further define a "change in conditions" and the removal of the language found in Part I, E. regarding the assessment of penalties for interruptions in flow records. The Control Authority did not conduct monitoring during the permit appeal process; no monitoring was conducted during the first or second quarters. The SIU was not in SNC for the July to December 2020 reporting period for Pipe 001, Pipe 002, Pipe 003, Pipe 004, and Pipe 005. During the Control Authority's fourth quarter monitoring event only grab samples were collected due to a communication issue with the meter and the sampler at Pipe 001. At Pipe 003 the sampler tubing was clogged and grabs were unable to be collected during the third day of sampling. One Oil and Grease result was rejected due to lab error. For Pipe 005 one CBOD result was rejected due to a greater -than value. The annual inspection was completed on 12/07/2020. 28 MALLARD CREEK WWTP 2004 Avago Technologies Wireless (USA) Manufacturing, Inc. The SIU was not in SNC for the January to June 2020 reporting period. The SIU was not in SNC for the July to December 2020 reporting period. This permit was renewed on 12/01/2020 and will be effective until 11/30/2025. Mercury monitoring was removed due to previous samples being below detection limit, and Ortho-Phosphorus monitoring was removed due to total Phosphorus already being sampled. The SIU filed the required TTO certifications in lieu of monitoring. The annual inspection was conducted on 09/02/2020. Avago Technologies Wireless (USA) Manufacturing, Inc. was a recipient of the CLTWater Environmental Excellence Gold Award for 2019. 2003 Carrier Corporation The SIU was not in SNC for the January to June 2020 reporting period. The SIU was not in SNC for the July to December 2020 reporting period. During the Control Authority's fourth quarter monitoring event, one day of composites was unable to be collected due to insufficient aliquots. Additionally, one day of Oil & Grease was rejected due to instrument failure. The annual inspection was conducted on 11/23/2020. Carrier Corporation was a recipient of the CLTWater Environmental Excellence Gold Award for 2019. 2000 Mallard Creek Polymers The SIU was not in SNC for the January to June 2020 reporting period. During the Control Authority's second quarter monitoring event, one day of composite samples was missed; the sampler did not collect sufficient aliquots. This permit was renewed on 06/01/2020 and will be effective until 05/31/2025. The flow limit was increased from 0.118 MGD to 0.135 MGD. A maximum flow rate of 100 GPM was also added, and all the OCPSF limits were increased due to process flow increases. 29 The SIU was not in SNC for the July to December 2020 reporting period The annual inspection was conducted on 01/16/2020. 6001 Wallace Farm, Inc. The SIU was not in SNC for the January to June 2020 reporting period. The SIU was not in SNC for the July to December 2020 reporting period. The annual inspection was conducted on 12/10/2020. Wallace Farm's wastewater is discharged to the Rocky River Waste Water Treatment Plant, NPDES # NC0036269, under an Agreement with the Water and Sewer Authority of Cabarrus County. Wallace Farm, Inc. was a recipient of the CLTWater Environmental Excellence Gold Award for 2019. 30 McDOWELL CREEK WWTP N/A Burkert USA Corporation d/b/a Burkert Fluid Control Systems The SIU was not in SNC for the January to June 2020 reporting period. The Control Authority identified Burkert Fluid Control Systems as a potential SIU during an Industrial Waste Survey follow-up in November 2019. Upon initial inspection of the facility on 01/24/2020, it was determined that the SIU performed a categorically regulated passivation process and was discharging without a permit. The Control Authority informed the SIU that they were discharging without a permit and instructed the SIU to cease discharge and required the SIU to complete an Industrial User Wastewater Survey and Discharge Permit Application (WWS). The SIU immediately ceased discharge and all operation of the categorical process. The SIU notified the Control Authority that it intended to operate as a Zero Discharger before beginning the passivation process again. The SIU completed the WWS and applied for Zero Discharge Certification on 02/18/2020. The SIU achieved Zero Discharge on 03/16/2020. Due to COVID- 19 restrictions, the Control Authority was unable to conduct a follow-up visit, however, the SIU provided detailed photographic verification of the Zero Discharge containment system. No Control Authority or SIU monitoring was conducted as the SIU ceased all process discharge upon identification as CIU on 01/24/2020. The annual inspection was conducted on 01/24/2020. 0707 Ingersoll-Rand Industrial U.S., Inc. (formerly Ingersoll Rand Customer Solutions Center) The SIU was not in SNC for the January to June 2020 reporting period. The SIU did not discharge during the January to June reporting period, therefore no monitoring was conducted. The SIU has not discharged since June 2019. The SIU will inform the Control Authority if they plan to resume discharge. The SIU was not in SNC for the July to December 2020 reporting period. The SIU did not discharge during the July to December reporting period, therefore no monitoring was conducted.
