I reviewed the PCN and believe the approach will fit the terms and conditions of NWP 14. However there are a few items that require clarification before I can verify the use of this NWP: 1) The PCN does not list the stream impact related to the 30” RCP extension and outlet protection, although Permit Drawing Sheet 11 does. Please confirm that compensatory mitigation is proposed for this impact, and if so, ensure that these impacts are included in the compensatory mitigation proposal. If not, please provide justification; 2) It is not clear from the PCN and plans whether or not all of the impacts related to permanent fill in the main channel for Bank Stabilization and Floodplain Bench require compensatory mitigation, although that is what appears to be proposed in the compensatory mitigation proposal. Generally, compensatory mitigation will be required for stream impacts related to permanent culvert fill, re-alignment of channel, and above grade rip rap placed in the channel bed (situation dependent). Please provide additional detail regarding the breakdown of impacts proposed for compensatory mitigation to enable consistent application of our regulations. Please provide the above additional information above within 30 days of receipt of this Notification, otherwise we may deny verification of the use of the Nationwide Permit or consider your application withdrawn and close the file.
