Dear Mr. Marro:
On February 28, 2013, the Division of Water Quality (Division) received your application
requesting a 401 Water Quality Certification and Buffer Authorization from the Division for your
project. The Division has determined that your application is incomplete and cannot be
processed. The application is on -hold until the following information is received:
1. Please provide full -sized plan sheets that are stamped, signed and dated.
2. The impact shown on Sheet 2 of 5 for the proposed stormwater drainage pipe does not
appear to meet the requirements listed in Item (6) of the Neuse Riparian Buffer
Protection Rule (15A NCAC 2B.0233) for a new stormwater outfall. Per the Neuse
buffer rule, a stormwater outfall is allowable "provided that a stormwater management
facility is installed to control nitrogen and attenuate flow before the conveyance
discharges through the riparian buffer." Please either show that this requirement has
been met or provide an alternative design that meets the requirements of the Neuse
Buffer Rule.
3. The impacts shown on Sheet 2 of 5 do not appear to satisfy the avoidance and
minimization requirements for stream and Neuse Riparian Buffer impacts. Please
provide additional information regarding how these impacts have been avoided and
minimized and how sediment will be prevented from entering the stream; or provide an

alternative design that removes the cul -de -sac and sewer line from the Neuse protected
buffer.
Pursuant to Title 15A NCAC 02H .0502(c) and Title 15A NCAC 02B .0233 (8), the applicant shall
furnish all of the above requested information for the proper consideration of the application.
If all of the requested information is not received in writing within 30 calendar days of receipt
of this letter, the Division will be unable to approve the application and it will be returned. The
return of this project will necessitate reapplication to the Division for approval, including a
complete application package and the appropriate fee.
Respond in writing within 30 calendar days of receipt of this letter by sending five copies of all
of the above requested information to the Wetlands, Buffers, Stormwater — Compliance and
Permitting (Webscape) Unit, 1650 Mail Service Center, Raleigh, NC 27699 -1650.
Please be aware that you have no authorization under Section 401 of the Clean Water Act for
this activity, and any work done within waters of the state may be a violation of North Carolina
General Statutes and Administrative Code.
