Dear Mr. Shaeffer and Ms. Higgins,
On behalf of the City of Raleigh, we are requesting authorization from the USACE to use NWP 12 for
0.52 acres of temporary wetland impacts and 161 if of temporary stream impacts for replacement of
a section of the Mango Creek Interceptor sewer line, and oo1 acres of permanent wetland conversion
impacts for the permanent maintenance corridor. We are also requesting a 401 WQC for the impacts
listed above, as well as 526 sq of permanent buffer impacts, 11,491 sq ft of temporary buffer
impacts.
The proposed project consists of the replacement of approximately 6,500 if of sewer line which runs
along Mango Creek and the Neuse River. The proposed sewer replacement begins at the Neuse
River Siphon on the east side of the Neuse River (Lat: 35.768561 °N; Long: - 78.539964 °W) to Hodge
Road (Lat: 35.777728 °N; Long: - 78.525922 °W) in Knightdale, Wake County. The proposed alignment
contains portions of Mango Creek and unnamed tributaries to Mango Creek, which is located in the
Neuse River Basin. The Water Quality Classification for Mango Creek is: "C- NSW ", the Stream Index
number is: 27 -32, and the cataloging unit for the project is: 03020201.
Project Purpose
The overall purpose of this project is to replace an aging and undersized sewer line currently running
parallel to Mango Creek and the Neuse River. The proposed line is approximately 6,500 linear feet
Of 36 -inch diameter pipe. The line must tie to the existing sewer system on both sides of Mango
Creek at Hodges Road and with the siphon under the Neuse River on an NCDOT mitigation parcel
near US 264.
Project History
The Mango Creek Interceptor Sewer Replacement project was previously issued a Corps NWP 12 and
DWQ 401 WQC & Buffer Authorization in 2011. Copies of the previous authorizations have been

provided as Appendices. These authorizations expired on March 18, 2012, but were granted an
automatic 1 -year extension. Construction was never initiated due to difficulty securing easements
for the project, and the previous authorizations have expired. The easements for the project have
been secured and the City of Raleigh is ready to move forward with the project as was previously
designed and permitted.

Avoidance and Minimization
The alignment avoids un- impacted wetlands and streams by following the existing sewer easement
for most of the alignment. Forested wetland impacts will primarily be temporary in nature as the
permanently cleared maintenance corridorwill be located within the current cleared easement. The
only exception to this is a small (o.o1 acre) maintenance corridor adjacent to Hodges Road at Mango
Creek (Site 7).
Stream crossings will be installed using open cut construction techniques. Open cut construction
will be used at the two Mango Creek stream crossings, one of which is on the NCDOT mitigation
parcel. Directional drilling or boring was evaluated but deemed not practical. This crossing will be
constructed to eliminate the existing 18 -inch pre- stressed concrete cylinder pipe aerial crossing just
upstream of the 1 -264 Neuse River Bridge. The downstream terminus of this project is a recently
constructed siphon box that crosses the Neuse River and discharges to the City of Raleigh
interceptor on the west bank of the Neuse River. The siphon elevation is fixed and to some extent
dictates the vertical alignment of the proposed 36 -inch gravity sewer. The proposed vertical
alignment of the sewer line through the mitigation parcel is 0.15 percent. At this grade, the top of
the 36 -inch sewer line would be approximately one foot below the creek bed at the crossing.
Due to the shallow depth of both Mango Creek crossings, they will require an open cut installation.
A relatively shallow bore would not allow for sufficient cover or depth under the creek to successfully
install a casing pipe. These crossings would require a 54 -inch casing pipe that would protrude
above the bottom of the creek bed. Based on geotechnical investigation, there is a sloping rock face
in the immediate vicinity of the proposed stream crossings. There is roughly 1 foot of partially
weathered rock 13 feet below grade over laying a layer of hard granite. The sloping face makes it
virtually impossible to successfully bore through rock on a consistent grade due to the tendency of

the bore to follow the angle of the rock face. The geotechnical report also indicates that a
directional drill with these conditions will be extremely difficult. Several contractors have also been
consulted with regard to this crossing. The consensus is the creek cannot be bored successfully and
therefore open cut methods will be used.
Riparian buffer impacts have also been minimized by limiting the construction corridor to the
existing sewer easement as much as practical. Stream crossings are perpendicular to limit both
buffer and stream impacts. A minor amount of Zone 2 clearing will be required at Site 2 where the
alignment is constrained by the fill slope and bridge abutment of US -264.
Mitigation
Wetlands & Streams
Wetland and stream impacts for replacement of the sewer line are temporary and do not require
mitigation. Permanent wetland impacts from permanent conversion of forested wetlands to
herbaceous wetlands for a permanent maintenance corridor are less than o.10 acres and do not
require wetland mitigation.
Buffers
The proposed buffer impacts for sewer crossings are Allowable, and therefore, buffer mitigation is
not required.
The current request is for 0.52 acres of temporary wetland impacts, 161 if of temporary stream
impacts, 526 sq of permanent buffer impacts, 11,491 sq ft of temporary buffer impacts and o.o1
acres of permanent wetland conversion impacts (see the attached maps and PCN for details).

The project corridor is primarily an existing sewer easement. It passes through a forested NCDOT mitigation parcel, then
runs adjacent to a rail corridor and residential development before crossing Mango Creek adjacent to Hodges Road.

The project purpose is to replace the existing sewer interceptor that is undersized and aging with a larger gravity sewer
line. this new gravity sewer line will enable the City of Raleigh to continue to provide sewer service to the Town of
Knightdale.

The proposed sewer interceptor will be constructed adjacent to the existing line with minor deviations to minimize
impacts. The existing sewer easement will be used for construction and additional easement will be required due to the
sewer size and depth. The new easement will be 40 feet wide and will be retained by the City. All easements not to be
retained will be allowed to reforest. Standard construction equipment will be used.

See attached cover letter for complete description. Sewer line replacement was chosen to reduce permanent impacts as
compared to a parallel line. The alignment minimizes uplands forest on the NCDOT mitigation parcel, riparian buffer, stream
and wetland impacts by avoiding undisturbed areas as much as possible.

Construction will be limited to areas shown through the use of orange tree protection and silt fencing at the limits of

The purpose of this project is to replace an existing sewer. While the sewer is being replaced to provide additional
capacity, the upstream sewer segments are not being upsized at this time and the area adjacent to this project is either

Special Permit Condition: If riprap stabilization is needed, it should be placed only on the stream banks, or, if it is necessary
to be placed in the stream bed, the finished top elevation of the riprap should not exceed that of the original stream bed.
This verification is valid until the NWP is modified, reissued, or revoked. Al] of the existing NWPs are scheduled to be modified,
reissued, or revoked prior to March 18, 2012. It is incumbent upon you to remain informed of changes to the NWPs. We will issue a
public notice when the NWPs are reissued. Furthermore, if you commence or are under contract to carmnence this activity before the
date that the relevant nationwide permit is modified or revolted, you will have twelve (12) months from the date of the modification or
revocation of the NWP to complete the activity under the present terins and conditions of this nationwide permit.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. You

1. The Corps of Engineers believes that there may be jurisdictional waters of the
United States on the subject site, and the permit applicant or other affected party
who requested this preliminary JD is hereby advised of his or her option to
request and obtain an approved jurisdictional determination (JD) for that site.
Nevertheless, the permit applicant or other person who requested this
preliminary JD has declined to exercise the option to obtain an approved JD in
this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or
a Nationwide General Permit (NWP) or other general permit verification requiring
"pre- construction notification" (PCN), or requests verification for a non - reporting
NWP or other general permit, and the permit applicant has not requested an
approved JD for the activity, the permit applicant is hereby made aware of the
following: (1) the permit applicant has elected to seek a permit authorization

line, as described in your application dated August 5, 2011 and received by the Division of Water Quality (DWQ)
on August 9, 2011 and additional information dated September 13, 2011, October 11, 2011, and October 13,
2011. After reviewing your application, we have decided that the impacts are covered by General Water Quality
Certification Number(s) 3819 (GC3819). The Certification(s) allows you to use Nationwide Permit(s) NW 12
when issued by the US Army Corps of Engineers (USACE). This letter shall also act as your approved
Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 2B .0233. In addition, you
should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with
your project including (but not limited to) Erosion and Sediment Control, and Non - discharge regulations. Also,
this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your
application shall expire upon expiration of the 404 Permit.
This approval is for the purpose and design that you described in your application. if you change your project,
you must notify us and you may be required to send us a new application. If the property is sold, the new owner
must be given a copy of this Certification and approval letter and is thereby responsible for complying with all
conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of
stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). This approval

2. No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the
footprint of the impacts depicted in the Pre - Construction Notification. All construction activities,
including the design, installation, operation, and maintenance of sediment and erosion control Best
Management Practices, shall be performed so that no violations of state water quality standards, statutes,
or rules occur.
3. Erosion and sediment control practices must be in full compliance with all specifications governing the proper
design, installation and operation and maintenance of such Best Management Practices in order to protect
surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Sediment and Erosion
Control Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control measures
must be such that they equal, or exceed, the requirements specified in the most recent version of the
North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all
construction sites, borrow sites, and waste pile (spoil) projects, including contractor -owned or leased
borrow pits associated with the project.
c. Sufficient materials required for stabilization and /or repair of erosion control measures and
stormwater routing and treatment shall be on site at all times.
4. Sediment and Erosion Control Measures
Sediment and erosion control measures shall not be placed in wetlands or waters without prior approval
from the Division. If placement of sediment and erosion control devices in wetlands and waters is
unavoidable, design and placement of temporary erosion control measures shall not be conducted in a
manner that may result in dis- equilibrium of wetlands or stream beds or banks, adjacent to or upstream
and down stream of the above structures. All sediment and erosion control devices shall be removed and

the natural grade restored within two (2) months of the date that the Division of Land Resources or locally
delegated program has released the project;
5. Diffuse Flow
All stormwater shall be directed as diffuse flow at non - erosive velocities through the protected stream
buffers and will not re- concentrate before discharging into the stream as identified within 15A NCAC 213
.0233(5)
6. Protective Fencing
The outside buffer, wetland or water boundary and along the construction corridor within these
boundaries approved under this authorization shall be clearly marked with orange warning fencing (or
similar high visibility material) for the areas that have been approved to infringe within the buffer,
wetland or water prior to any land disturbing activities to ensure compliance with 15 NCAC 2H, Section
.0500.
7. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules,
and any subsequent modifications, the applicant is required to return the attached certificate of completion to
the Wetlands, Buffers, Stormwater, Compliance and Permitting Unit (WeBSCaPe), North Carolina Division of
Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699 -1650.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct impacts to
waters as depicted in your application and as authorized by this Certification, shall expire upon expiration of the
404 or CAMA Permit.
If you wish to contest any statement in the attached Certification you must file a petition for an administrative
hearing. You may obtain the petition form from the Office of Administrative Hearings. You must file the
petition with the Office of Administrative Hearings within sixty (60) days of receipt of this notice. A petition is
considered filed when it is received in the Office of Administrative Hearings during normal office hours. The
Office of Administrative Hearings accepts filings Monday through Friday between the hours of 8:00am and
5:00pm, except for official state holidays. The original and one (1) copy of the petition must be filed with the
Office of Administrative Hearings.
The petition may be faxed - provided the original and one copy of the document is received by the Office of
Administrative Hearings within five (5) business days following the faxed transmission.
