I am writing in response to your March 12, 2013 letter of non - compliance at Site 5 (Sta. 129 +60 to 130 +20 -L -) on
the X -2C Fayetteville Outer Loop project.
Barnhill Contracting worked diligently on Thursday and Friday, March 7`h and 8`h, to replace the vandalized skimmer
at Sta. 130 +40 Rt. Additional sediment control fencing with hardware cloth and #57 stone were also installed. The
silt fence behind the hardware cloth has been removed to allow proper filtration and alleviate the possibility of water
becoming trapped and causing erosion between the hardware cloth and this silt fence. The small `barlike' deposits
you pointed out during your inspection have also been cleaned.
In order to prevent further unauthorized discharges to surface waters to the unnamed tributaries to McPherson Creek,
Mr. Randy Wise has also discussed the NPDES reporting requirements with Barnhill Contracting personnel. He has
reminded them that the erosion and sediment control/stormwater devices and stormwater discharge outfalls shall be
reviewed at least once every 7 calendar days and within 24 hours after a significant rainfall event of 0.5 inch that
occurs within a 24 hour period.
