HomeMy WebLinkAbout20151103_Walkertown Attorney Existing BUA ClarificationTOWN OF WALKERTOWN November 3, 2015 Marilena Jensen-Cuthold City of Winston-Salem Attorney's office Post Office Box 2511 Winston-Salem, NC 27102 Dear Marilena: As Segal Counsel for the Town of Walkertown, I have been asked to issue a letter interpreting the Town of Walkertown's Watershed Protection Ordinance, Chapter C.3 of Walkenown's Environmental Ordinance ("Watershed Ordinance"). A question has arisen in relation to a private development proposed for 24.06 Old Hollow Road, within the Town of Walkertown's land use development jurisdiction.. There is an existing structure or structures situated on the property, currently exempt from regulation under the Watershed Ordinance:, Section 3-1,5(A)(1)(d), The developer. proposes to demolish the existing structure and build a new structure or structures which will result in no net increase in the built -upon area (BUA). After review and consideration, it is the interpretation of the Town of Walkertown that such demolition and new construction. shall be deemed to constitute "Existing Development" under Section 3-1.5(A)(1)(d) and Section 3-1.8(B) and is not an. "Expansion" under Section. 3-1.8(B), because there is no net increase to the BUA as a result of the project. Please accept this letter as the interpretation of the Town of Walkertown and forward it to the Inspections Department, the Erosion Control Supervisor and such other persons who may rewire an interpretation of Walkertown's Watershed Ordinance.
