PROJECT SUMMARY: The applicant proposes to rebuild a private docking facility destroyed by a Hurricane Floyd. Edward J. Ricciardelli Page Two 9. PROJECT DESCRIPTION: The project site is located at 1629 Sunrise Lane, adjacent to Myrtle Grove Sound and the Atlantic Intracoastal Waterway (AIWW), in New Hanover County. The 0.77 acre lot is 92 feet wide and approximately 371 feet in depth from Myrtle Grove Sound. The applicant maintains asingle-family residence. Upland vegetation along the shoreline consists of lawn grass, small oaks, and fronted with shrubs including: Marsh-elder (Iva frutescens), and Grounsel-bush (Baccharis halimifolia). There is a marsh border, approximately 500 feet wide, waterward of the shoreline of the property. Black Needle Rush (Juncus roemarianus) dominates the high coastal marsh intermixed with Spike Grass (Distichlis spicata), Sea Oxeye (Borrichia frutescens), and Salt Meadow Grass (Spartina patens) at the transition to highground. Smooth Cordgrass (Spartina alterniflora) dominates the remaining 400 feet of marsh to an old shell berm, which has formed along the perimeter of the cove. This berm's elevation is above mean high water (MHW) and supports shrub vegetation, Marsh-elder (Iva frutescens), Grounsel-bush (Baccharis halimifolia), and Sea Oxeye (Borrichia frutescens). South of the project site, the berm is of sufficient height and width to support several large Live Oaks, Red Cedar, and Yaupon. There are breaks in the berm, both north and south of the project, which allow tidal flow to the extensive marsh landward of the berm. Properties in the project area lay within a cove of Myrtle Grove Sound, which complicate the determination of riparian corridors. On March 6, 1998 a riparian survey was established for the applicant and his neighbor for a CAMA Major Permit application at the time. The applicant received State Permit No. 114-98 on August 25, 1998 for a private docking facility, which utilized the riparian survey (See Riparian Survey dated 3/12/98). The applicant's docking facility was built and then mostly destroyed during Hurricane Floyd in 1999. Presently, a remaining section extends from the shoreline approximately 300' over the marsh, which stops short of the AIWW. An additional section of pier approximately 57' in length remains just waterward of the marsh within the cove. The application states that the existing water depth at the projectarea is -0.5' @ Mean Low Water (MLW). The Wilmington-New Hanover County Land Use Plan classifies the area as Conservation. The waters of the AIWW in the vicinity of the project site are classified as Outstanding Resource Waters (ORW) by the NC Division of Water Quality. The area is designated as a Primary Nursery Area (PNA) by the NC Division of Marine Fisheries, and is OPEN to the taking of shellfish. PROPOSED PROJECT: The applicant proposes to rebuild a private docking facility destroyed by Hurricane Floyd. The application states that the existing 289' section would remain in place, however the applicant would like the option to rebuild the remaining section if the need presents itself during the construction process. Anew 287' pier would extend from the existing pier over the marsh towards the AIWW for a combined distance of 576'. The 44' section of the pier over open water would turn southeast into the cove due to the established riparian corridor. The pier would then terminate in a gazebo, 16' in length by 16' in width. An access ramp would lead onto a floating dock, 16' in length by 6' in width, which would be installed waterward of the gazebo. A boatlift, measuring 13' in length by 13' in width, would be installed on the northern side of the floating dock. Based on the limited amount of water, the application states that the floating dock would be supported by the system pilings at low tide to prevent the dock from touching the substrate. The total length of the structure would be 619' in length and would accommodate up to two (2) vessels. Edward J. Ricciardelli Page Three 10. ANTICIPATED IMPACTS: The proposed pier would incorporate approximately 521 square feet of estuarine waters and public trust area. There would be some disturbance of the marsh and shallow bottom along the proposed pier alignment during initial construction, and the proposed structure would shade approximately 1,240 square feet of coastal wetlands. However, provided there is adequate elevation of the walkway, no long- term adverse impacts are anticipated. The proposed structures would extend approximately 87' into a waterbody, which measures approximately 2,220 feet across. This proposed distance would conform to the 1/4 width rule and would not encroach into the AIWW 80' requirements. Based on the riparian survey, the structures would not encroach into the 15' Riparian Property Setback requirement. Box 15375 Wilmington, NC 28408 910-443-1106 T`he purpose of this application is to obtain a CAMA Major permit to rebuild a single family residential pier with two slips for Edward J. Ricciardelli at 1629 Sunrise Lane in New Hanover County, NC. The site is located in an adjacent bay, approxi- mately 1200 ft. to the west of the AIWW. This pier was previously permitted under CAMA Major Permit No. 114-98 and was partially destroyed during a hurricane. The pier to be reconstructed will be 5 ft. x 576 ft. in length with a 16 ft. x 16 ft. gazebo at the terminating end of the pier. From the Gazebo will be a 3 ft. wide ramp leading to a 6 ft. x 16 ft. floating dock with a boat lift located to the North side of the dock. At the present time, the first 289 ft. of pier still remain intact. The owner would like to rebuild the pier starting at the point where the pier still remains. This would mean that the total length of the newly constructed pier would be cut down to approx- imately 287 ft. The owner would like to leave the option available to reconstruct the entire pier of 5 ft. x 576 ft. if the need presents itself during construction. We will be following standard pier and dock construction techniques. We ~~ill be using CCA 2.5 treated round pier pilings that will be set to a min. 8 ft. penetration using a water jet and pneumatic piling hammer. The framing, decking and handrail will be done using ACQ .40 treated material, hand nailed using stainless steel ring- shank nails and H.D. gale bolts. Crossbracing will consist of CCA 2.5 treated material and H.D. gale bolts. The floating dock will be constructed using ACQ .40 treated framing and decking, rotary molded floatation and anchored by four CCA 2.5 treated system pilings. All framing will be done using stainless steel ringshank nails and H.D. gale hardware and bolts. Due to the limited water depth of less than 2 ft. at low tide, the floating dock will be constructed in a way in which the dock will be supported by the system pilings at low tide to prevent the dock from resting on the hard bottom. This pier conforms to a guidelines for pier construction. The owner only desires 2 slips and is keeping his allowable square footage to a total of 256 square ft. out of a possible 368 sq. ft. The only reason for having to obtain a CAMA Major permit is due to the piers' total length of 576 ft.
